    What the Avengers think matters because we're trying to figure out whether Nova could lead the Avengers and be America's First Hero. Filling Cap's shoes, as it were.
    Last time I checked, Leadership sorta requires either the consent of those who are to be led or the power to enforce their obedience anyways.

    It was the case, by the way. If Nova wanted to ignore Tony Stark and his forces in Nova #2 and 3 (during Civil War), he could have swept over the whole of the SHRA there and then and been the director of what comes after. I guarantee you Captain America would have been his best buddy, as well as all the Anti-regs.

    That would not occur If he went against the SHRA he could have helped the ant reg side but beating up Tony's side does not get you appointed to take his place. That was the problem with CW there was no way to punch the law away.

    Hypothetically speaking, no you can't punch the law away. What Nova could do is walk all over the authority in the USA and just say "screw the law, and anybody who makes it. No more Capekillers in the air and no more arrests of super heroes. That's my law".

    Sounds like he is replacing Doom not Cap in your story.
