The Illuminati have them again as I recall they recovered the ones the Hood was able to obtain. I know they got together and talked about using them against the Phoenix Five but Reed convinced them not to.

All of them were considering it, but they'd agreed to conceal the Gems from the rest of the world. When the Hood began collecting gems, the rest of the superhero world found out about the Illuminati. At the end, Iron Man dissolved the group and appeared to will the Infinity Gauntlet out of existence, but in reality the Illuminati just quietly met and divided the gems again.

Thor and Red Hulk kick so much ass in this story.

Since Beast is taking Xavier's place, I imagine they'll give it to him.

My guess would be that Xavier confided in Beast before he confronted Cyclops, and that he brings the Mind Gem but doesn't keep it. Black Panther will probably get a Gem and there could be some 'reshuffling'

Bendis couldn't keep it straight, who got what particular gem. So, it may or may not be the Mind Gem. I'm betting Hickman will arrange the distribution as he wishes.

Maybe cause Namor had a gem? Or because it would be highly hypocritical?

I don't know enough about the infinity gems in general, I suppose, so what's the hypocrisy in using it?

Also, the response earlier about Reed implied to me that they had access but chose not to.
