Sadly, this is true. What is also sadly true is the ACLU defends these Amendments as individual rights BUT the 2nd (they believe it is a "collective right").

Many states don't have the "permit requirement" and many that do have the "private sale" loophole. I wouldn't disagree with a VERY quick universal background check hosted by the FBI/ATF and paid for by taxing the sale. This still wouldn't affect "private sales", though. Those are tough to regulate.

They don't defend the second because it's never been threatened, except in the minds of insane people
