These toys aren't at big box retail right now. Stores don't want to carry them.
The toy sucks, honestly, It just recycles the same cartoony junk parts from every other Mattel figure, but with a weird little head and a small cape. I recommend getting the DC Collectibles version that Jim Lee helped design.
If you really want this thing, it is available in DC Universe Classics wave 21, and Batman Unlimited wave 1. Most online stores have them in stock. I doubt you'll find them anywhere local but at a comic shop that stocks a lot of toys for about $25. Buyer beware, as I mentioned earlier, they're junky and they tend to break from their joints being stuck together.
I Have a similar Batman. It's the newest for DC Universe All-Star Batman. I think the one you showed looks very similar. Oh, and that Jim Lee designed new 52 Batman toy is terrible. Don't get that one.

Couldn't disagree more. Those Jim Lee designed figures are so ugly. Batman's ears stick so far out on the side of the cowl, that he looks like Alfred E. Newman. I have the wave 21 figure, and the articulation is fine (plus the figure is better proportioned). It's a great figure (just wish it had some batarangs).
Just looked it up, and the figure you want is just a re-deco of the classics wave 21 figure. So, I highly suggest it.
