It clearly shows a unmasked Spider-Man, and if that isn´t Peter Parker than I don´t know who´s suppose to be!

Age of Utron has apparently been done (at least artistically) for a while. It seems the Marvel NOW event pushed it back sometime, so I doubt many characters are going to represent their new SQ.
So, the age of ultron is an event set in the past?
It´s one thing to have the same character design as the one prior to Marvel Now, but using a character that´s not suppose to be the current Spider-Man it´s kind of different, at least i think that way.
But you could be right

Well it cant be in the before NOW! since Iron Man has his NOW! armor.
Slott has commented on this. Apparently this takes place pre-700, but then will jump to post 700.
Iron Man has his NOW! armor and it features tie-ins to current series, INCLUDING Superior Spider-Man with issue #6.AU. This could mean many things, such as:
1) Peter will be replaced during the actual series.
2) Peter is the Superior Spider-Man, the fact that it's the old suit is an artistic oversight due to artwork being completed early.
3) Editorial oversight, explained as it takes place after NOW! but before Superior, the Superior Spider-Man tie-in takes place during Amazing Spider-Man
4) The Superior Spider-Man returned the mantle to Peter
5) spoilers:end of spoilers
It's Doc Ock in Peter's body still, the fact that it's the old suit is an artistic oversight due to artwork being completed early.
or
6) The story has segments taking place before and after NOW!
