Aren't most of Marvel's heroes ostensibly working for the government post-Civil War? Or is that retconned?

They were ordered to, but many didn't. There were still Initiative teams around. Secret Invasion started and ended, and then during Dark Reign/Siege, it became REALLY mandatory as Normie sent out Thunderbolts to catch/kill non-complying folks that he didn't like. After Siege, Cap takes over and rescinds the SHRA, so nobody does anything they don't want to do. Of course, if you've beaten Stilt-Man at least once, Cap wants you on the Avengers, so...
Seems like this would basically be SHIELD vs. Checkmate/Suicide Squad. I like the DC setup better personally. Either one has tons of operatives that crap all over Bourne and Bond.
Marvel wins because there're so many secret DC government organisations that they can't decide who's in charge and fight eachother.
Well, if we're talking "All-Time" then Marvel wins because Sentry: Agent of SHIELD says shut up.

But both companies borrow ideas from each other quite often, so I don't see why NU52 is being singled out when this can be pointed out as a thing that has been happening since the inception of both companies.
I mean can I pretend its the 60's for a it and bitch about how the Avengers are totally a rip off the JLA and not be fair whatsoever in regards about how they are being written?
