Ahero that's more ruthless, or in the case of Rule 16, gets to the Time machine before the Overlord can. But yeah. After a certain level of villian compitence, the best course of action for a hero to defeat them is simply "More firepower than the Overlord can protect himself from". And for the Love of Good DON'T give a Heroic Speach!! It'll just give him time to shoot you.

Also, just because he KNOWS the list doesn't mean he's capable of living up to every decree in there (and a few are contradicted by others). Sometimes magic/tech in a Universe works a certain way, and trying to get rid of the flaws to avoid a cliche just doesn't work. Others defeat the whole POINT of being a specifically Evil Overlord. (If you're not going to ever have sex, you won't Evil Laugh, Enjoy your Power, or make yourself Invincable, WHAT'S THE POINT?? You might as well be a Good King at that point. At least they have a 66% (or so) chance of their offspring being both Good and Loyal to them.)
So yeah, some of it depends on the Universe and charecters in question, but in general I stand by my "Overwhelming Firepower" being the best idea.

It depends on the villain. As Munchy said, a stronger hero can simply overwhelm a weaker villain, even if said villain was pretty competent.
(Oh, but you can make yourself invincible. It's just standing there yelling "You can't defeat me! I am invincible!" is a time-tested method of tempting fate to prove that you're not. Just beat the heroes up instead of bragging, and you'll be fine.)
Be a better Evil Overlord.

Why he keeps picking up ridiculous arguments and then try to defend them, I will never know.
The problem with the Evil Overlord list is that it tends to view victory as just winning the fight without any respect for a character's actual motivation. For instance, we're given to understand that Gurren Lagann's anti-spiral didn't have to play the final battle on equal terms like it did. The Evil Overlord list would say then that it shouldn't have, but would whatever it did have qualified as a victory then? Its stated motive was to induce despair to hold spiral beings down, since it knew it could never prevent evolution by sheer brute force. Showing the height of its power would just show them what they needed to overcome - showing that it could beat them on their own terms makes a more powerful statement. Sometimes using your superweapon as early and frequently as possible is just dumb.
It often misses lots of angles too. Like sure, marrying the princess immediately in a small civil ceremony sounds good, but if you're trying to use that marriage to legitimize your position, it may be a useless gesture without the lavish ceremony held in three weeks time. If you don't need the lavish ceremony, odds are you don't need the princess. Besides that, conspicuous consumption is a big deal for showing that your rule is invincible. Showing weakness may empower your political opposition.
Anyway, there's all kinds of issues like that with the Evil Overlord List, so I wouldn't count on it too much. Lasting victory requires more than what it gives you.
