Well, if Fox refuses to deal, and Marvel gets DD back, then it just opens up the possibility of a really awesome DD TV series. DD would work beautifully as a series, not just as a movie.

I say let Fox try to play hardball. The longer they try to negotiate with Marvel the less likely it is that they will get DD off the ground in time. So they will lose DD and we get a better DD film in exchange.

Damned if you do and damned if you dont then. We get a dark Daredevil then some comic fanboys will be bitching that they are just cashing in on Nolan's Batman because Nolan's dark version of Batman made money. We get a lighthearted version then some comic fanboys will be bitching about how less dark and campy Daredevil is.

What fanboy is going to say that? Unless you mean Batman fanboys, Daredevil is a dark character, has been for 20 years.
They had to get Mark Waid to write it to make it less dark for the first time in forever, but all his most remembered stories certainly fit into the dark category.
