The Avengers have made a mess of things with their actions in trying to stop Hope from getting the Phoenix force, creating the P5. Then they couldn't leave well enough alone and decided to piss off the five god-like beings who weredoing pretty well until that point. A lot of X-fans think that their position has largely been ridiculous.

But what if the host the Phoenix was looking for was someone other than a teenage girl whose seizure could only be called kidnapping. What if it was someone like Magneto, who has a looooong history of mass murder and racism against 99% of the planet.

Even assuming that his reformation is genuine this time, and even if he also pledged to use the power for nothing but peaceful purposes, in that case I'd feel that the Avengers would be justified in doing whatever they thought was necessary to keep him from gaining cosmic level power. He cannot be trusted with that power.
