Jean wasn't legally declared dead. Everyone in the MU thinks she was on Osborn's Dark Avengers and had been undercover, which technically means that Cyclops is also married to Mystique.

This was mentioned in Incredible Hulks when Betty came back. She said that she and Bruce were no longer married since her father had her declared legally dead. Plus, present day Jean is still dead and the O5 Jean is probably hooked up with O5 Scott.

Though when she find out how her Marriage to Scott ends(Scott cheating on her with Emma), she might break it off with her Scott.

According to the most recent canon to date (Dark X-Men) no one knows if Jean Grey is dead or alive and was not legally declared dead.

If law recognizes time-travelling Jean as the same person that married Scott, then she is legally the same age as Scott. And anyway, I´m quite sure that in any modern western country any person old enough to marry is also old enough to legally divorce/annul his/her marriage without anybody´s permission; MU USA is not some medieval shit age country in which parents can give and take back their daughters as if they were property.
