I don't know that any fans know for sure, but I wouldn't be shocked. I would be surprised if they had an option on future X-Men characters. That would likely be viewed as a hassle. If it was me, I would have said "give me all the mutants" or give me this list of x-characters and I get anyone who becomes an X-Man/Factor/X-whatever later.
I can't help but be reminded of when Superman defeated Amazo by disbanding the Justice League.. Ooops, no more powers for you..

It would be fun to watch if Marvel tried a bunch of convoluted story ideas to get Storm out from under that Fox contract. Change her name, change her powers, change her costume, change her race. Basically, give Ororo the Clone Saga treatment.

I'm pretty sure 20th Century Fox has enough high priced lawyers to ensure that nothing Marvel does to Storm or any of the X-men in the comics will cause them to lose their rights. They just make way too much money off X-men to risk any chance of the rights reverting back to Marvel. It's a shame too because Marvel really butchered the X-men movies in ways that are inexcusable. I have no faith in Fox's ability to make good X-men movies until they officially announce a reboot akin to Spider-Man and Fantastic Four.

Kevin Feige when asked about Scarlet Witch and Quicksilver at the European premiere of Avengers Assemble. "If they want to use them in an X-Men movie they could, if we want to use them in an Avengers movie we could." Well, I don't think any of us were expecting that! He also reveals that the same applies for the Skrulls (more than likely due to their connection to the Fantastic Four) but that doesn't come as too huge of a surprise. Scarlet Witch and Quicksilver are the children of Magneto and originated in the X-Men line of comics as a part of the Brotherhood of Evil Mutants.
The monster saved them all. And in their fear, they betrayed him. As they always have. As they always will.

Wanda and Pietro have not yet appeared on screen. From what Feige says, Fox haven't exclusively optioned the rights to those specific characters, but they do fall within both camps, so at present either company could use them in a film. However, when one of them does, their rights will, most likely, then be exclusively held by the production company that uses them, and if that's Marvel Studios then they will not have a connection to Magneto.

Fox owns the movie rights to the X-Men characters, including Storm. That means any live-action movie adaption of the characters are the sole license of Fox Studios.
