I think that while I can see that the companies have a strong case for their work for hire practices (and they've been winning on it in the courts), I find it disappointing that they can't come up with some kind of arrangement where Ditko gets a check for his Spider-Man contribution, the Kirby estate for his,etc. Stan's case was different in that he was a company man for many years and essentially worked out a deal of his own. Or even if you don't give anything to the individuals, maybe there should be a way to contribute to a fund that helps a Dave Cockrum, Gene Colan, etc. who needed money when health problems arose in their retirement years.
JMS does sound like he knows its wrong but just accepts it. Heck, this kind of thing first hit the fan IIRC when James Gardner sued because he never saw any profit from the Rockford Files as its producer, etc. Sound like nothing has changed in that regard if JMS says he still hasn't seen anything from Babylon 5.

JMS signed the Babylon-5 deal before he was a proven commodity. I'd have to sign the same deal, most likely. And I would, without hesitation. I'm not familiar with Gardner's situation but there have been at least two industry-wide strikes since his issues came to pass.
I'm sure no one of the Stan Lee / Kirby era could have even conceived of the success their work is now generating. And now that it has gone mega-corporate, there's no way the big guns are going to back down or set some charitable precedents. That's just bad business. And it's a shame the industry didn't look out for it's own, early on. Remember also that it all nearly came to a screeching halt and went under. Should Kirby have kicked in to try to save it? Would he have been to blame if it had stopped?
I never thought Disney buying out Marvel was a good idea. But we're about to get a ton of Avenger movies that we wouldn't have gotten otherwise. The devil you know.
