To be fair that was just me extrapolating a scenario from your lofty expectations of what a hero should be.
At the end of the day it seems that a majority of people (both in the comics and as readers) viewed Banners treatment as totally justified. If you've honestly never got violent with someone you may not understand what that anger can do until you lash out and as said earlier; hundreds of innocent deaths because one man "just wanted to feel big" is totally inexcusable.
Here's a thought though: do you think Cap was justified when he beat the snot out of Pym?

Then should they not have killed Magneto at the end of Ultimatum? If Peter were to run into the guy who killed Uncle Ben again, wouldn't he deserve to be punched in the face?
You're really getting rather nitpicky. Yes, Banner was beaten, but that didn't mean he was clean. It was his fault that all those NY citizens died. The legal system is fine and all, but that doesn't mean he didn't deserve a kick in the jaw.

So Magneto - the guy who killed thousands of people, was "rehabilitated," killed loads of people, went to jail, escaped and killed millions of people - should be spared in an effort to be "heroic?" At what point does heroism become stupidity?
I love Spider-man and Batman, but a hero having a no-kill rule is naive. If you have a recurring villain who continues to beat the system, there's no need for him to keep living. "Fool me once" and all that.

So you don't like Spider-man and Batman? That's all I said about what I like. You didn't answer the question. Do you really think it makes sense for them to try to imprison Magneto AGAIN? Had they killed him the first time, nobody would have died in Ultimatum, because there would have been no Ultimatum. I can understand their logic at that time, but to think that imprisoning him again would work the third time around would be plain ignorant.
Is it heroic to leave a terrorist's fate up to the system, even when the system has been proven time and time again to not work?
