    It's obviously intended to be the same character... quite a different thing from a male and female with the same codename.

    Who says they aren't the same character though? In EMH he has left the Frightful Four and look at how much older and deadlier he is in EMH. He is a seasoned villain because he has more years of experience.
    Klaw was introduced prior to getting his powers in Avengers, and is in his sound form in USM, so USM can't take place first.

    Cap has yet to appear in the show. We've only seen him in Peter's head as a "major hero".
    The point is that it establishes that Cap is an active hero in USM's present day, which means it can't take place before Avengers.

    Not only that, but it also proves another discontinuity: Iron Man is an established hero in USM, but just starting out in Avengers.

    Said who? It was never said that S.H.I.E.L.D didn't know who Spider-Man was.
    Maria Hill specifically mentions using the Avengers as an example for registering with SHIELD, so heroes whose identities aren't known like Spider-Man and the X-Men can be held accountable. If USM were to take place first in continuity, they'd already know his identity and how to get ahold of him.

    He already has his powers. His costume came first in the show, not in the comics. Harry Osborn wasn't Venom in the comics either, by the way.

    Did you even watch that clip you posted? He never uses any powers. He's using a gun, and when that doesn't work, he tries using hand-to-hand combat on Ant-Man and then runs away. Plus, he's clearly human - Ulysses Klaw becomes Klaw the supervillain when he turns into living sound.

    Never mind that he's also shown getting his powers in "Panther's Quest."

    Harry Osborn wasn't Venom in the comics either, by the way.
    I've been reading Spider-Man comics for 20 years, I'm well aware of that. That doesn't even have anything to do with the discussion.

    He's wearing his modern costume and has his modern shield, is shown fighting Trapster in modern-day New York, and Spider-Man's fantasy is in context of a conversation with Fury about becoming the ultimate Spider-Man so he can work alongside other heroes. He's obviously been thawed out.

    Once Tony becomes Iron Man, he takes his company out of weapons manufacturing as a result. In the video you posted, he references having done so recently. Rhodey and Pepper are reacting to him fighting supervillains like this is a new or recent development. He certainly hasn't been active long enough to become "one of the greats" that he is in USM, nor does he have the familiar relationship he has with Fury in USM.

    That doesn't mean S.H.I.E.L.D doesn't know it, it means that the PUBLIC doesn't know it.
    Obviously the public doesn't know it, but she's still talking about him like he's a wild card, not like he's somebody they've been hands-on training for a year or two. If he were already working for SHIELD, they'd have his information to register him.

    EDIT: I had responded to everything you said, but I just spent the last two hours debating politics with an extreme Democrat and an extreme Republican and I'm tired of arguing. Instead of going around in circles we will wait and see how it goes.

    This episode is written by Brian Michael Bendis. It also confuses the hell out of me since Wacker even confirmed that they're all in the same universe.

    Well the 4th wall stuff and that Peter doesn't seem to act much like himself unless it's a really serious situation. He's more of a caricature than a character.

    Not at all. The villains and heroes are written like complete idiots, thats why people hate the show. The 4th wall stuff is least of it's problems.

    We got a story where SHIELD is spying on Peter Parker, so what happens? Peter apologyzes Nick Fury for getting anger tamptrums while is personal space is getting invaded. Don't even get me started on Power Man.

    I agree on the characters written like morons comment but the bulk of the complaints I get for some is that Spider-Man acts more like Deadpool than Spider-Man.
