Didn't Wolverine kill him during the Apocalypse arc? Or are you referring to his younger counterpart who was in prison?

I just skimmed through the end of Ultimate X-men before the banshee story and it seems that he died but Phoenix revived everyone that died a couple days prior. And he was assumed to be one of them that was revived. Even if it isnt future Bishop, im fine with just normal Bishop.
