It was Xavier and the X-men who avoided that on 616, and since Morrison's run, the phoenix is Jean inevitable final form, so this was pretty much unavoidable... Originally Posted by Brian M.

It's really sad. If they didn't want to use Jean, they should have just had her use her powers to throw herself in front of the car that she telekinetically threw Annie into in 616. She could have heroically sacrificed herself instead of murdering her friend.
