I am pretty sure that for HIV, you can't (unless there was an open sore in your mouth or something) as there isn't enough of the virus in semen to do it without entering the bloodstream. It might differ from STD to STD though...

Agreed. Though I do have to roll my eyes at the "mental distress" part of the lawsuit - yeah, your baby nearly choked to death, OF COURSE it's going to cause mental distress. ANY serious problem or stressful situation is going to cause mental distress.

So, yeah, cleaning crew effed up big time.

Like another poster said, it's highly doubtful you can get AIDS/HIV, but other types of STD's could possibly be spread.

HIV only last minutes outside of the human body, so I think for at least this one thing, the kid is safe. It's more conventional "germs" that would likely be the problem.
