Default Woman loses case vs RIAA, fined $222,000

Or, $9,250 per song for 24 songs.

In related news, the Bush administration lauds the decision as effective copyright law.

And as usual, some relevant Slashdot commentary.

Because millions of people do exactly the same as them and if everyone were prosecuted to such a degree, US civilisation would go bankrupt en masse. The penalty is inherently selective in targeting only example cases, because any consistent application of it would devastate the country. Punishments designed to scare people are not in proportion to the crime, because that is not their purpose. The interest is in creating the very greatest degree of punishment that is achievable.

You're better off stealing physical copies from retailers. Hell, Wal-Mart might not even prosecute you if you steal under $20 of merchandise at a time.

She was clearly guilty of file sharing. The punishment, though, in no way fits the crime.

The RIAA and its members aren't wrong for wanting to stop intellectual property theft. But how they go about doing this -- relentlessly targeting single parents, grandmothers, etc. -- is nefarious at best. Not only that, but it's utterly ineffective and creates nothing but animosity among potential customers.

All the more reason to boycott these dinosaur record labels though.

My favorite part is that she's refusing to accept donations to pay the fine...

i.e. with low income and kids... good luck collecting.

Thing is that the punishment doesn't fit the crime. It's more corporate terrorism against low to middle class. They're putting up a few examples for the crowd to try to scare the masses in line. I try to get my media as legal as feasible, but even the stuff you get legally is laced with all these junk scare tactic ads and layers of stuff that make it hard to use what you buy. At least some of them are seeing the light and going DRM-free on some of it.

It goes into the ethics of giving these companies money so that they can hire lawyers to do stuff like this. There are times when I think boycotting is the only way. If I could find a way to pay the artists without feeding the sharks... there's always local music.

It says she shared over 1,700 songs on Kazaa but they tried her on 24 of them. Could you imagine had they tried her on 1,700 ? Odds are she'd be owing Bill Gates type money.

Speaking of Bill Gates, a while back someone did the math for how much a month of Bittorrent music piracy theoretically loses the industry, based on the $150,000-per-infringement max damages sometimes sought by the RIAA.

If they've calculated that accurately, I think that graph says it all really.

I don't think so. If someone downloads something it doesn't mean they would by it if they couldnt download it.

No, I mean it says that the record industry is talking shit. Six times the GDP of France? Six times $2 trillion?!

Did this lady fight the RIAA or did they sue her straight up? I was under the impression that if you got caught all you had to do was say "Sorry, I won't do it again" and they'd let you slide. A guy I work with got caught downloading movies and that's all that happened to him.

She did, indeed, fight them. However, while they are usually quite willing to settle, they usually do not settle for nothing - just usually something like $3,000 or thereabouts.

Why, in the name of all that is Dio's "Holy Diver," did that woman try to fight them?
