    Default Wallpaper Challenge: CBR Artwork

    Welcome to another Wallpaper Challenge. I thought we'd show some love to the fantastic artists that are here at the forums.

    So just to be official, this rounds subject is:
    CBR Artwork

    You have a whole forum as a resource. This Challenge will end October 6th.

    Have Fun.

    EDIT: Seems that I posted this and started doing walls when I was drunk. Hahahaha. Oh well, it's a good idea.

    I'll unfortunately be sitting this one out, as I'm leaving the country in a few days and not getting back until the 6th, but I'll still have net access so I'm looking forward to what everyone comes up with!

    I'm still pretty new with this whole "wallpaper" thing.

    So, do you mean just look around this forum and use a members art for wallpapers, or do you mean use art from one of the "pros" that hang out at cbr?

    Either way could be fun; but I wouldn't want to use someone else's art if it might annoy them?

    As long as you don't alter the artwork, you should be fine I think. And it goes without saying that you need to credit the artist. If you're still uncomfortable you can PM the artist to ask permission.

    Personally, I think you should ask permission in every case. The fact that we post our artwork here doesn't give tacit approval for people to use it any way they see fit.

    I agree with you, but I'm not sure of any real legality involved. AFAIK the internet is public domain. If an artist complains to me that their work was used without permission, however, I'll certainly remove it.

    That's kind of what I was thinking. Not so much the legality, but more do they want some one they don't know messing with their artwork.


    Giving "credit" is an automatic; but yeah, I'm thinking ask the artist first.

    Yeah I should mention that the only reason I did the one I did was because permission was already given.

    I'm personally a "public domain" person too. I was wondering when this was going to come up. I personally believe that if it's on the net, it's fair use. As long as you don't use the work for profit, legally, you can use it. That is of course the law. However, if you feel you should ask permission, do it. It couldn't hurt to ask.

    Another thing, I thought it would be cool to do this one because it allows a mutual appreciate of what we each do best. But if someone gets all uppity about it, then they have no spirit of community in my opinion.

    I will say one thing, I'm not uploading anything to my photobucket that I make here if that helps confuse anyone more.

    Well, sure. And using it for profit legally entails getting the permission of the copyright holder.

    Sorry, meant to say "don't use for profit" I'll edit the comment.

    Oh and this:
    Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—

    1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
    2. the nature of the copyrighted work;
    3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
    4. the effect of the use upon the potential market for or value of the copyrighted work.
    I personally believe it would strengthen the very community that was exposed to the work personally. Also, I may point out one other thing that technically, if the artist in question gets beef with a wallpaper artist over a picture that uses a already copyrighted character then that artist has no beef unless he got explict permission from the copyright holder.

    So I believe that is that really.

    But like I said before, if you feel you must ask permission, do so.

    Okay, thanks for clarifying. One thing, though - I don't think making wallpaper from someone's artwork falls under "criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research."

    And part of the reason I brought all this up in the first place is so that somebody didn't end up getting in shit because they misunderstood the legal ramifications.
