Can't really talk about it. . cause I'm not sure of legal repurcussions. . . but bottom line is that I'm getting sued over that fender bender from back in March.

really depressed/scared/angry about it. .. yeah, all at once :(

not really much to share, but I wanted to share . . you know?

no, I have insurance. (one of the "big" companies)

The insurance people are telling me not to worry. . .and that the offer they had made him, based on the circumstances, was the best they were willing to go.

But since thier offer was well below what he wanted (over 60K below what he wanted), he has sued me.

As I said, I'm not sure how much I *can* talk about online. . so I'm trying not to say much of anything. But I'm so upset about it, Nick isn't really sure what to do. . . .

so I came online to be w/ my "family"

not quite. . .

My insurance offered to settle, but he didn't accept thier offer. . and instead is suing me (I suppose he can't sue the insurance company). . .my understanding is that they are going to fight it FOR me. . . but who knows ?)

Bert, you should talk to your insurance company and make it clear to them how confused and worried you are over this. Ask them to explain everything to you in simple, non-jargon terms so you understand what is happening.

Otherwise you die a thousand deaths from worry if you don't know what's coming. Or not coming. If you know where you stand you can
1) Breathe a sigh of relief
2) Gather support
3) Mount a fightback

60 grand seems excessive. I can make some guesses at where he's heading and I don't know the laws of your country well enough to make any guesses on the outcome. Get a professional to advise you and you'll be better off.

Meantime you can always dump here.

$60k seems like a lot, but it really depends on all the circumstances involved. A fender bender could mean slamming into someone at 60 mph just as much as it could mean 30 mph.

Unfortunately, there's a 2 year statute of limitations for personal injury in Texas. So someone could decide a year and a half later that they want to sue over a slight twinge.

Sorry to hear that the jerkoff didn't want to settle with the insurance company. He probably hired some TV lawyer who convinced him to sue.

I"m sorry you're going thru this, and I agree with Melissa---talk to your Insurance company. Get more info on what's going on, and how the process works. That will help a lot.

Mrs Hod works in this field, and the number of people she has coming to her expecting to, basically, get something for nothing is mindboggling.

They always follow it up with "Its not the money, its the principle."

Well, if its not the money, why are you sueing in the first place, and asking for a small fucking fortune.

Bert, the same thing happened to my mom a couple of years ago. The insurance company will fight it for you. They kept after this woman until they proved that she was faking her so-called injuries & forced her to drop the case. Hang in there!

It took my insuarnce company nearly 2 months to agree to pay off my stolen truck. 2 weeks before the payoff , I got a call telling me that cops had found my vehicle 2 states away and were bringing it home. I wasn't a happy camper!

Sorry, bert, that sucks. Calamas is right, though. This jerk is probably just trying to squeeze a bigger settlement out of the insurance company. Best to talk to your insurance agent about the suit so you know exactly what your insurance company is going to do and how or if it will affect you. Generally, the insurance company will defend you in the lawsuit and your involvement will be fairly minimal unless it gets to the point of depositions and/or trial.

I believe that is the situation here.

I faxed them a copy of it this morning, and the lady I've been dealing with told me to just relax, and that I would probably hear from the insurance company's lawyer (representing me) in the next couple of weeks.

I wish I could go into detail, because maybe y'all could set my mind more at ease. . but I'm afraid that maybe I've said too much already.

I really do appreciated the messages tho. . that's why CBR has been my home on the web for so many years now.

Most motor policies include legal help, like yours appears to. Don't whatever you do negotiate or even communicate with this guy other than through your insurance company, and forward everything that comes in straight to them. (Keep copies, though.)

Not that you won't have a worrying time, but they're trying to intimidate you into standing apart from your insurers - even the Christmas-is-coming timing is calculated to this end. Don't let it happen. And see if you can't counter-sue for harrassment, etc. - again via your insurance company - while you're at it.
