Wouldn't that be an invasion?Technically it was Canadian (off-duty) cops who arrested Mark Emery (http://www.theglobeandmail.com/servlet/story/RTGAM.20050730.wxdope0730/BNStory/National/), but it was at the request of Uncle Sam. And the U.S. has tons of law-enforcement personnel working - supposedly in an advisory capacity - in our country. CIA, FBI, ATF, Texas Rangers...

And to answer your last question, yes. In my opinion, anyway.

This is a horribly written article. While the sub-headline says he was arrested, the body of the article says that he was cited and has a scheduled appearance. This, to me, would indicate that he was cited and released.

I would also point out that the previous "bust" appears to have resulted in the phenomenal penalty of $200 total fines and costs.

In my three years as a prosecutor, I've never seen anyone do jail time for holding personal use amounts of marijuana.

Out of curiosity, what constitutes "personal use amounts" legally speaking?

In any case, while I support marijuana legalization doing something idiotic like driving while under the influence is something I have no sympathy for. He should be arrested.

In Idaho, possession of less than three ounces of marijuana is a misdemeanor.

I'm actually surprised he wasn't charged with a DUI. The penalties would be stiffer than those for a simple possession of MJ.

Uh, Howy, he was talking about the CNN article about Art Garfunkel, not the Globe and Mail one about Emery (which in any case I can't read as I have to purchase the article or have a subscription).
