I think it is because they are too unpredictable. The last thing Luthor wants is a "wild card" screwing things up since he has obviously made plans well in advance.
Two-Face - One minute you could be talking to Two Face the next to Harvey Dent.
Joker- The Ultimate Wild-card. No one knows what he is doing..ever. Maybe even himself.
Riddler - I hear he's currently doing his thing in Ollie's home town.
Though Talia undoubtedly counts as a Bat villain.
Any thoughts?

Well Mr Freeze in it..read Issue 1
Clayface too it "Seems" at least from Superman/Batman 20 and maybe Harely Quin
Ivy- Dead for now
Joker- not in the best shape right now
So basicly got a bunch of them
Black mask got the green K that was stolen..so he MIGHT be connected
Even then that 3 deffinant batman member on the team

I guess I missed him. I guess what I meant was the core VU. Not the ones they "contacted."
I do really need to re-read #1 and 2.
The was aVU Tie-in in Nightwing. So I'm not completely sure what to think is going on quite yet.

Paul has a great thread over in the main DCU forum that has all of the Counselling segments no longer on the DC site.
Also it looks like Black Mask is officially part of the Society now to:
"NIGHTWING #109
Impressed by Dick Grayson's "work" for the mob, Black Mask — now a member of Lex Luthor's Society — hired our undercover hero to help expand his criminal web into Bludhaven (the new home of Batgirl and Robin)!"

Isn't Penguin involved with the group? I just finished reading "Prelude to Infinite Crisis" and it looks like he's one of their arms dealers.

Harley and Ivy are in. Well, Ivy's dead now. I guess. I'm not sure how to figure out what's happening when between Gotham Knights and Superman/Batman.

Doesn't Catman technically count as a bat-villain? And hasn't Deadshot gone up against him, too...? They're not of the insane variety, but I always thought of them as Batman enemies.

I'm hoping the series doesn't go by without appearances from the big and getting bigger guns, namely Joker, Ra's Al Ghul, Vandal Savage, Captain Cold, Sivana, Circe, and Per Degaton.
