1.) I notice sometimes the super villains keep their costumes on and sometimes you see them in their asylum/prison uniforms. Why is that? The doctors are trying to cure them, right? I don't think it's wise to allow your patients to keep their costumes and let them continue to take on their personas.
Edit - They sometimes let Two-face keep his coin.
2.) I notice in Batman the animated series, you never see Freeze, Catwoman, and Penguin in Arkham. I guess they find those bad guys to be sane. Is it like that in the comics?

I think Joker is lucky in a way. He get to be locked up with his girlfriend. He should be thankful he's not in an all-man prison.

I think it's mostly used as an easy way for artists to make sure every villain is recognizable. Alan Grant offered a decent explanation in The Last Arkham, where all the villains are said to have incredibly fractured egos and that their fragile sense of human identity would be traumatized by removing their costumes.

Penguin and Catwoman (although they are very rarely in jail, for different reasons) aren't homicidal, and said to be sane enough to stay out of Arkham and be put in the "normal" prison Blackgate instead. Freeze is traditionally put in Arkham, but that might be because they're the only prison facility that can accomodate his need of a refrigerated environment. He's definitely portrayed as more deranged in the comics than in his two Batman: TAS appearances though.

I differs by writers/artists. It all goes with how they want the prisoners to be viewed in contrast to the story. Really is no rhyme or reason why it flips back and forth.

I'm pretty sure that at the end of 'Heart of Ice', Freeze was in a refrigerated cell in Arkham.
