how did this happen? what are the odds that they are both named Elliot Franklin? sorry but that just bugs the hell out of me.

It doesn't sound too unlikely. A Google search on the name reveals several in the US.
Besides, it sounds like fodder for a neat story.

maybe not in the real world. but wouldn't you think it was unusual if a new character was named 'Jennifer Walters?' Jennifer Walters is a perfectly cromulent name but still..

Yeah, I’m amazed that you don’t see that kind of thing more often especially when a character’s secret identity is a relatively common name. If Tony Daniel the comic artist is often mistaken for Anthony Daniel from Star Wars then you’ve got to figure there’s another Pete Parker out there being mistaken for the guy who takes all the pictures of Spider-Man.
Of course “realism” is only really ever invoked in comics when writers want to justify making things unnecessarily dark. Odd but still fairly plausible coincidences don’t really enter into it.
