I'm not saying that they'd be elite high quality rats. Not the rats of NIMH or anything respectable like the rats of Redwall. No these would be the greasy, yellow toothed, scaly, fat, plague carrying, sewer rats with the long scabby tales and the black, beady, souless, little rat eyes...thousands of them moving towards you like some hellish living carpet of crawling hungry death....

I just can't fathom it. I mean, fans of what? A single issue of a comic featuring the cliched, overwrought origins of some of the most uninspiring characters ever seen in comicdom? I mean, Wolff? A character named after a real word but with a not-so-clever misspelling? Geez, is it 1994 again?

I'm actually veeeeeery tempted to go into full-blown rabid J-bolt fanboy mode on the Jbolted forums just to see how far I can push it. I figure I'll smack my head against the screen every time I start a sentence, just to give myself a little daze and screw up my grammar a little. And I'll do all my typing with a good, thick pair of oven mitts, just to get those authentic J-Bolt fanboy typos. I've already made a few posts, though, so my previous good spelling would probably spoil it.

Those forums (both IMDB and J-Bolted) are like a train wreck. I know I shouldn't look. I know by craning my neck I'm just going to see something I'll regret, but by God, I just can't resist.

Oh, yeah? Get ready for the comic, movie, novel, billboard, placemat, and wallpaper debut of.....CAYNINE! Once, just an ordinary man who dreamed of no more than his ordinary life. Then one day, crossing the street, he forgot to look both ways!! Oh no! Look, out, ordinary guy! He was hit by a truck carrying vats of dog blood--irradiationed dog blood! The impact flew him up, up , up, into the air and finally ... several panels later....into a vat of dog bloood just as a lightniening bolt struck! ZAAM! NOw, when night comes, an ominous transformation takes over, and he puts on his pants and becomes--CAYNINE!

Yep, if you have the slightest questioning tone, he's going to assume you're part of the basher entity. He thinks he's chopped off the head (MacQ) of the bash body, and he's having a blast spitting on the corpse (everyone else). I believe that's why he's just defaulting to rude remarks now. Let me just say, that you have played the wrong game with the wrong person.

I posted to this board because I ran across the name 'Bombshell', which is a character I had drawn for tv executive Craig Nevious. After the help of some of your posters, I was given the link to your ludicrous website which was non-functioning and discovered your character and your artwork WERE NOT mine and not part of any agreement I have ever entered into.

You are very unprofessional and your posts are frankly rediculous. If there are actually people in this world that would waste their time looking at your load of worthless unpublished and unproduced material, so be it, but do not ever implicate anyone that actually has a career in your endeavors or you will most definitely be pursued to the fullest extent for slander.

So to end your game, keep this fact in your mind , 'neighbor' because as I said, I have never entered, pursued or been involved in any sort of agreement with you through email or otherwise, and I doubt there is any truth that anyone else has either.

you were not reading the post correctly on IMDb.

whoever J-Bolt is, wrote a ludicrous post about some sort of agreement being entered on a contract for work... non-factual/fictional in regards to jarvinenk, after jarvinenk posted asking for details about the comic and movie.

I posted to this board way back, further asking for details about the character Bombshell, because my husband had worked on story boards for a character by that name in 2000 and 2001. All the links that pointed to the LightningBolt website were non-functioning at the time, so I asked for help in locating some more data on the Bombshell character. Another poster, I believe 'McQuarrie' actually got me a photo reference from the CafePress website, which determined that this was not the same Bombshell character Kirk had worked on.

Whatever this J-Bolt's game is, we do not want to be implicated in anything that is fraudulent and not serious work being published. Kirk is a professional artist with a long line of credits to his name. The actors on the IMDb, are also professionals who deserve not to have their name slandered into some false light if they are not involved in it. The last post on IMDb was to insure that "J-Bolt" considers that the lives he is involving need to be as imaginary as the characters he creates or he will risk being prosecuted

All is good fun, till the joke is put on someone innocent with something to actually lose.

This afternoon, behind closed doors, Gail Simone and Jim "J-Bolt" Fischer settled their differences without the need for a court case. They both agreed to settle in a very calm, and orderly manner. How did they you ask?

By the way, if the jbolted site is a cruel joke on him (which I assume it is), now might not be a good time for its authors to reveal the truth. That guy's unhinged enough as it is.

J-Bolt is an artist, a writer, a humanitarian, a filmmaker, and an actor.

:D

The explosive premiere of the comic that will change the comic book world FOREVER, When Lightning Strikes #0 is the greatest beginning to a comic book ever. The fight between good and evil has never been portrayed in such an amazing way. WLS #0 is not only a visual treat for the eyes, but the most thought provoking comic book ever written. I eagerly wait for more, but for now, reading this masterpiece over and over again keeps me satisfied.

So let's not be mean, k?

Step away for a few hours and wow!

Is it just me or did J-Bolt's posts where he "outs" Mac were clearer then the usual dribble?

It seems like 2 different people wrote under J-Bolt's username.

Which explains allot.

Aren't all the posters there just people from over here??

That's what it looks like to me. I mean, I just can't see how anyone could be such a rabid fan of a comic book "company" with a single issue. The J-Bolted forum posters have to be either J-Bolt sockpuppets or people having fun with him.

Gail-- thank you for your reply...
Kirk currently does work for an advertising pro in Michigan, but recently has also began re-entering the comic book work force. He pencilled two issues for Moonstone Books under the "Kolchak: Tales of the Night Stalker" series. He and Peter David were approached at a comic convention last year by Moonstone, and asked it they would consider doing something together again. As a result, Kirk did the recent issues 5 & 6 and is currently in production for a 'Kolchak' black and white anthology with Mr. David as the writer.

thank you for the compliment Abbas.Khan, I will make sure Kirk receives your comment. ;)

well, if asked, Kirk would definitely consider the job, but there are no current plans for him to do Spider-Man at the present. Kirk does have an especially good eye for drawing beautiful women ;) ...

Spider-Man is probably Kirk's most favorite superhero character... especially Steve Ditko's issues. Kirk drew two Golden Book adaptations of the character, in addition to the Marvel Swimsuit Mary Jane pin-up.

If I were J-Bolt, I think I would concoct a story about having been raised at the marine installation where Micah Wright served. He could claim that while he was raised speaking English, he learned to write in Vietnamese and so his spellings and punctuations are sometimes off.

Strange thought errors are generally much more forgivable among people who learned English as a second language.

Just for fun, I thought I'd translate some J-Bolt-isms into other languages and back to see if they'd make more sense.

"I'm a work-a-holic who doesn't cosider what I do as work because I love it to much: it's too much fun to be work."

English-Portugese-English

"I am one work-a-holic that he does not consider what I make[.] I eat the work because I love it very [much]: it is too much amusement to be work."

English-Korean-English
"Me it goes out and to love it in vast quantity in order it is a workholic who does not do to spare the fact that at day and it goes out it does: One which is will connect and too much many fun."

Another:

"People pay more attention to person wearing a mask-shaped pair of sunglasses an gothic wardrobe as opposed to... the rest. I like it that way"

English-Korean-English

"Person... Remainder and it prepares and Gothic cloth chapter to wear the shape pair which when the tinted glasses goes an attention in the person compared to it pays. I that method like it."

English-Japanese-English
"The people pay attention to the person who attaches the sunglasses of mask fixed form group to the Gothic style wardrobe body... vis-a-vis remainder more. I like that in such wind."

Finally:

Having been naturally endowed with ominous beauty, Jen Layton lived her life, in Tombell, Nevada, endlessly searching for respect and a love that would want to know her as a person...not just some blond bombshell. Jen works throughout her young life surpassing the expectations of those around her with superior drive for intellect and accomodations which end up in a respected position as a chemical scientist for one of the country's leading chemical research facilities, as an adult. This leads to even more ridicule and jealousy from her peers with the lone support of her best friends, Francie and Ronny. In an exhausted effort to prove her worth to those who look down upon her, Jen experiences a fateful accident which mutates her system into that of an explosive femme fatale, while finding that there was a real love with her all along, beyond her notice. The accident results in a detrimental "condition." Jen feels that all is lost as everything she's ever loved and worked for is blown away. Now its time that she shows everyone just how much of a "BombShell" she is. Can her family, friends, law enforcement, or even a new aquakinetic hero named Marinna, who was also mutated, stop BombShell's explosive rampage? You'll be surprised of the outcome.

English-Japanese-English

Unlucky beauty, being favored by Jen Layton her life naturally, Tombell, having lived in Nevada. you search love and the point we would like to know her.. as a bombshell person of the blonde exactly without the limit. Stopping the large raging of the explosiveness of BombShell, is the new aquakinetic hero where execution of her family, the friend and law, or and Marinna which is mutated it is shown good? Can her does family, friends, imposition of law, or even a new aquakinetic hero that is named Marinna, that was degraded also, does stop the explosive frenetic behavior BombShell's? You will be astonished the result.

Actually, in the U.S. it does until contested.

A copyright is considered to exist on all work produced, registered or not, so long as it is not in violation of a previous copyright. Registering provides protection, however, and enhances the rights afforded, basically.

Well, I found the deleted thread, or at least what occupies its space. According to this (http://www.imdb.com/title/tt0282390/board/nest/15832203), the posts were all deleted by an administrator. I''m not up on IMDb's vernacular, but I have a feeling Samantha Fox's people complained to IMDb.

I wonder when she's scheduled to come to Vegas for acting lessons from Fisher? Wasn't he going to teach her how to be Bombshell?

I can't help imagining him at the airport with his mullet, mask, and a cardboard sign with her name scrawled across it. Sobbing in the corner day after day, he wonders what's holding her up. Maybe MacQuirkie got ahold of her, or worse yet, maybe she's a basher herself. "WHY WON'T THEY JUST LEAVE J-BOLT ALONE?!? DON'T THEY KNOW WHO I AM?!?"

True. For copyright anyway. Trademark is a whole nother beast.

Trademark is completely dependent on registration, and it costs a lot more than copyright. And since copyright does not cover names, titles or concepts, trademark protection is vital.

PatrickG
03-04-2005, 11:55 PM
Well... Trademarks are interesting. They can be registered at the state or federal level so Pamela's search might not cover the (cheaper) state trademark (which I doubt J-Bolt acquired) and unregistered trademarks can be grandfathered.

I could trademark a superheroine known as Bombshell but J-Bolt COULD use his ashcan to establish a prior claim that would allow him to continue distributing the ashcan.

However, I believe he could be legally blocked from doing much in the way of NEW Bombshell material in that scenario.

I believe he could use the character and even call her "Bombshell" but never on a cover or in a title or any promotional material. Ala DC's Captain Marvel which arises from a somewhat different but somewhat similar scenario.

MacQuarrie

PatrickG

Before anybody thinks I'm a Law student, I should suffix the above by saying that the above is my understanding from my interest in publishing as well as my parents' business.

My parents did some research before starting their restaurant. They chose what they believed to be a suitably untrademarkable, generic name. (To trademark something requires novelty. You can't trademark 'the' unless it has special novel meaning in the way that you are using it.)

A lunchmeat company later trademarked the name and sent my parents a cease and desist order. My parents were advised that while they could be grandfathered as their use of the name predated the trademark registration, the large company could still litegate and appeal to press the matter. Because my parents at that point could not afford the legal expenses of litigation, it was pointless to defend the limited rights that grandfathering would entail.

So my parents agreed to cease and desist and they chose a new name for their restaurant. In order to insure that a repeat would not occur, they chose a novel name. They secured internet domain rights as a first step and then filed for a trademark.

However, because they do not do inter-state commerce, a federal trademark could not be issued. (It's easy to loophole this by doing a single out-of-state sale but at the time my parents opted not to.) They applied for and were granted a state trademark of their name.

In the long run, I think their course of action has benefited them as the more novel business name has contributed to brand identity. They subsequently remodeled and have twice moved to larger and nicer retail units because of the growth that they have experienced. They have clout with vendors and in the community... And similar restaurant concepts have passed on the area, word being that they simply aren't in a position to start a new unit that could compete with my parents' restaurant for our market.

These are all strong benefits that have come with brand identity.

Now, even large companies don't always register trademarks for minor characters... But if you plan to merchandise or develop a property in any major way, it would be foolish not to lay down the $500 or so.

Enter J-Bolt and his Bombshell...

my comment was not that they could not 'claim' copyright, but that they did not have one according to the government...
and as your last post mentioned, if they were pursuing a movie---
their script should be registered, which it is not

however... why does some of the other links provided for J-Bolt say that he resides in Kansas? I missed something along the way there

in retrospect, I thought about the Samantha Fox deletion and wondered why the one post would not just have been deleted instead of the entire thread. I noticed on another thread, one post had been deleted, it would seem to make sense that if the Fox representative was not real, the single post would have been deleted instead of the entire thread related to her. Afterall, isn't that exactly what was requested was her name 'deleted' from the board?

you know when to tell if any of the Bombshell info is a lie?

Here's another side of that copyright argument...
click on the copyright link:
http://www.copyright.gov/records/cohm.html

and type Pacific Trust into the claimant slot,
you'll get a whole list of over 235 different film scripts that are copyright registered by just that one particular financing company. if you scroll the list, you will see that many of the titles are completely unheard of and some are for simple television series.

We aren't talking about just comic books in this scenario...
If there was anyone financing a Bombshell movie, they would REQUIRE the copyright protection, otherwise they would risk someone else producing a similar project and losing their return. A movie doesn't make money until its seen and if it gets scrapped because someone else beats them to a release, the investor or bank loses everything invested

When I started writing songs, I asked the appropriate branch of the German government how to copyright them, and they explained to me that as soon as I can PROVE that I wrote them, I have a copyright on them. They suggested I mail them to myself in a sealed envelope.

Beating the dead horse a little more....

Now that we've covered the intricacies of copyright and trademark law, the cold fact remains that there's no way J-Bolt can claim ownership of the titles.

Fact: Multiple properties can have the same title. For example, in the last 20 years there have been at least seven films with the title "Saving Grace" and none of them are remotely similar (the 1985 one with Tom Conti is great).

Since there is nothing unique or novelty about the common word "Bombshell," it would not be eligible for trademark protection as a film title. Perhaps when tied to the character design it might be defensible as a comic book trademark, but record searches indicate that it has never been filed. Aside from the fact that other comics, notably SpyBoy, have used characters of that name.

And get a load of this:

BombShell won't come out until we start filming, so that the story is fresh, which means.... by the time you get to the movie, you're at the same point in the comics. That'll make the next movie and the next comic a surprise for you, instead of telling, and re-telling , and twisting a story that we've already head a hundred times over.
At the same time, we'll put out When Lightning Strikes #0 Hard-Copy because we're going to time that just right for the reason being, that we'll be doing a When Lightning Strikes Movie right after the BombShell movie tallies come in and the WLS movie is going to take a LONG time since it'll have EVERY LBC character at least make an appearance in it. That movie will end up answering a question that the comic leaves off at.
Everything is timing. I don't want to tell you a story you already know, but I'm trying not to leave you hanging too long either. That's why a lot hinges on the BombShell film. It'll start EVERYTHING and everything will be timed from there.

Over at J-Bolted, J-Bolt is trying to be as controversial as John Byrne:

I haven't seen too many people actually DO Humanitarian acts that have influenced me. Oprah makes BILLIONS but will start a charity, then take credit for it, Maury Povich has done a few good deeds, but those get over-shadowed by his tendancy to make his show more like Jerry Springer. I've seen a few good deeds, in my time, but I've never really seen a good "humanitarian." So, I guess, I'll just have to influence myself and make sure that I keep doing what's right, on my own merit. I don't mean to sound boastful with that answer, but can anyone really think of a GOOD HUMANITARIAN to be influenced by? I was raised in the days when comics gave us hope and REAL heroes, not heroes that we're almost as afraid of, as the villain. Therefore, I modelled my sense of humanitarianism based on those comic book morals: "the needs of the many outweigh the needs of the few," "save whoever you can, no matter what the risk/cost to yourself," etc. Stuff like that is what I grew up with and it was a hard fall down when I grew up and learned that the Police, Fire Departments, Politicians, News Industry, all the people that we grew up believing in,... we're, in actuality,... as corrupt as the crooks, if not more. Now, in comics, characters, who had the highest morals, go nuts and start killing people, they don't show the reality of corruption in the World, as it should be...so that kids won't grow up, thinking they're safe, when the truth is quite the opposite. The "Humanitarians" do what they do for tax write-offs, even if they, personally, don't do it. So, I guesss I'm just gonna' have to keep an eye out on myself and make sure MY values don't get twisted... maybe keep looking up the word "humanitarian," once in a while... just to remind myself what I want to be. ah yes because this origin is clearly a very moral character:

Jen experiences a fateful accident which mutates her system into that of an explosive femme fatale, while finding that there was a real love with her all along, beyond her notice. You'll be surprised of the outcome

I just realised that Gail only mentioned, as far as I know, that she quit hairdressing completely here in YABS. And J-bolt knows obviously at J-bolted.com with his "lebian ex-hairdresser" remark.

So J-bolt obviously lurks here and I'd just like to say this:

Hi J-bolt! Hahaha! You're so deluded and you smell like a shoe. AND you just got ur ass handed to you by Sam Fox! Hahahahahaha!

I just want you to know how special you make my life with the work you produce....or claims of its existence at least.

Gee, I guess someone forgot to tell my son and my 6'3" martial artist, former bouncer husband that I'm a lesbian. Oh, and me, too. No one told me.

Could someone get a screen cap of wherever he said that, please? I'd like that just in case I need evidence.

Best,

Gail

Alsol, he said you were a lebian, not a lesbian.

Hey, here's a thought... maybe instead of dropping an "s", he dropped a "p".

Nah. Doubt he knows what "plebian" means.

Which is kind of ironic, really.

"Wollffe" did. And J-Bolt ran with it like a bunny on amphetamines, triple expresso and a bad case of the trots.

So have you guys made up your mind on him being a total delusional psycho or are you leaning more towards the theory that he's a creepy "wanna be a porn director" weirdo with a bizarre(and stupid) casting couch scam going on ?

I saw Dodgeball this weekend, and I think that Ben Stiller's character is pretty close to what our hero J-Bolt is like. laughing at his own jokes in, coming on way to strong, malapropisms galore, and following any controversial statement with "just kidding, but not really."

I think he has a bit too much confidence, and I am sticking with my theory that he has some type of behavioral medication. Perhaps he's bipolar.

As a bit of history, I'd like to point out that no one has been "bashing" J-Bolt for 5 years. I believe the story goes like this. J-Bolt appeared on several forums saying that he was creating a new comic ompany to compete with the existing ones. this was about 5 years ago. Several of the characters from this forum took him up on the challenge of proving him wrong. They did, he got angry. Shortly after that, he disappeared.

that was before i frequented this forum, so i could have some details wrong.

However, last year, J-Bolt came back to this forum asking for a second chance. He was humble and simply wanted to be given a second chance. He began making realistic claims and even admitted to being overwhelmed. He participated on this forum for a little while, and as he stayed, his claims got more ridiculous. Suddenly, he had a family of companies agian, dozens of employees, and he began to take offense at anyone questioning his answers. He then stormed out, as much as anyone can strom out of an electronic forum. But some of us followed to his forum to continue the conversation.

so the whole point of that summary is to remind everyone that ol' J-Bolt has twice asked for this attention. As far as I know, during the 3 or so years of "quiet time", no one hassled J-Bolt. Other than the nostalgic reference from time to time, no one even thought about him. In the last year, it's been pretty constant attention, but like I said, he did request it.

J-Bolt appeared on several forums saying that he was creating a new comic ompany to compete with the existing ones. this was about 5 years ago. Several of the characters from this forum took him up on the challenge of proving him wrong.

We weren't even that antagonistic. When a few curious souls went to J-Bolt's site and saw how bloody awful the first pages of the ashcan were, and how preposterous his claims of excellence were, they encouraged others to go see by themselves how ridiculous the whole thing was. A few people tried giving him pointers on artwork, storytelling and even basic grammar, but he was as dismissive of criticism then as he is now. At the time, nobody even doubted that he could produce books; we just thought that they wouldn't be very good without a whole lot of effort.

Then his stories became more and more preposterous and he became the butt of many jokes. Anyone remember when he'd blame his website problems on his defective mainframe, and how his "team" of technicians was handling it? God, it was painful to see him dig a deeper and deeper hole every time he posted.

However, last year, J-Bolt came back to this forum asking for a second chance. He was humble and simply wanted to be given a second chance. He began making realistic claims and even admitted to being overwhelmed.

It bears repeating that he was granted every courtesy and received a lot of honest encouragement by many posters, particularly Gail. I am personally convinced that given his own determination, and despite his lack of real talent, J-Bolt could have produced a comic-book or a direct-to-video little superhero flick. All he needed was to recognize his limitations and seek out help in the fields where he wasn't as good as he should, particularly when it was freely offered. (I mean, the guy refused a script by a professional comic-book writer! How full of himself can he be???)

By then, it was also obvious that hye was something of a con artist and not only a delusional and frustrated would-be creator. His only customer that I know, Mac, was deprived of his money and got nothing in return. Bolt had also impugned many posters' honesty, a sure way to ask for people to blow holes in one's own lies.

In the last year, it's been pretty constant attention, but like I said, he did request it.

It's also probably the ONLY attention he gets. And the poor man must feel so happy to have true and devoted fans over at j-bolted. I hope that he doesn't undergo a massive breakdown the day the Great Oz steps from behind the curtain.

I wish I could have read this. I would have loved to see that criticism and his response. I think he has some minor talent as an artist...but you can tell he got to a certain point and decided he didn't need anymore help from anybody so he stopped growing as an artist.
