The story is making the rounds (http://www.npr.org/templates/story/story.php?storyId=103694193), though it's not official, that Associate Justice David Souter, appointed to the Court by President George H. W. Bush in 1990 (and, to the disappointment of his patron, a member of the Court's now four-member liberal wing since), will leave at the end of the June term.

This will be sure to increase the volume on Capitol Hill and in the media by a few decibels, as the first Obama nominee to the Supreme Court would be in the cards.

Good news. Hopefully the other "liberal" old farts will retire before Obama leaves office as its bad enough the court pretty much decides everything by 5-4 and usually without much support from the law like the recent "fleeting expletives" decision that came down to a "think of the children" argument.

Much like Congress, it is best with sides are battling each other to a final decision (or law). Right now 4 out of the 9 judges don't even really bother and might as well not show up to court as how they are going to decide is pre-determined.
