Can you get an STD just from swallowing the stuff? I'm not trying to deminish the horror of the story but is the child's health in actual danger her now that the choking threat has passed?

I am pretty sure that for HIV, you can't (unless there was an open sore in your mouth or something) as there isn't enough of the virus in semen to do it without entering the bloodstream. It might differ from STD to STD though...

Agreed. Though I do have to roll my eyes at the "mental distress" part of the lawsuit - yeah, your baby nearly choked to death, OF COURSE it's going to cause mental distress. ANY serious problem or stressful situation is going to cause mental distress.
So, yeah, cleaning crew effed up big time.

Like another poster said, it's highly doubtful you can get AIDS/HIV, but other types of STD's could possibly be spread.

HIV only last minutes outside of the human body, so I think for at least this one thing, the kid is safe. It's more conventional "germs" that would likely be the problem.

A: Anything and everything. When I had to baby sit my brother's kid, I had to watch him at all times as it was one of the most stressful yet rewarding experiences I've ever had.

Putting things in their mouths is how children experience the world, for some odd reason.
Some adults never grow out of that and develop all sorts of oral fixations: gum, cigarettes, thumb-sucking, etc.

Not many details there but the whole thing sounds like one of those set ups for a law suit. How can you not notice something like that on the floor when you check in? Plus I wouldn't let a child crawl around the floor in the first place. They probably shampoo the rugs once a decade in those hotels. Haven't the parents heard of those fold up play pens for traveling???

Okay, while the first one may be a real risk, I don't think suicide-due-to-embarassment is really going to be a concern. By the time he's old enough to be embarassed by this sort of thing, it's going to be so far in the past that few people will remember it.

If it was under furniture, etc... kids find all kinds of stuff that way.
Re: putting stuff into mouths... we had a terrible time breaking Finn of that---there were still times at 5 yrs he'd stick something in his mouth. Argh.
And you wouldn't *believe* some of the gross things I've seen toddlers and babies put into their mouths. Seriously.
It's a natural way little ones sense the world... but at the same time, one that can be very dangerous for them.
Re: The Case:
On the one hand, if it'd been a gun, people tend to look at something like that as "not normal to the environment, and a life-danger"... so one could assume responsibility on the part of the hotel for not finding and removing it from the room during cleaning.
On the other hand, parents too have a responsibility to try to safeguard their children. For instance, when staying in a hotel, they should make sure blind cords are out of toddler reach, that the child doesn't get near the plugs and outlets, etc.
In the end, though, I think I have to come down on the side of the parents. If it had been a gun, or a hypodermic needle (maybe not from drugs but from a diabetic, for instance), a razor blade, or a stash of dope, the hotel is still responsible for ensuring that nothing like that is left in the room for the next occupant. I think a used condom qualifies as enough of a health risk (both from choking and from infection) to be grouped in with those other things that the hotel is responsible for insuring *aren't* in a room you rent for the night.
The parents are responsible for *reasonable* "childproofing" (i.e. putting blind or curtain cords out of toddler reach, etc.), but a used condom doesn't fall into the "reasonable" category, as in "something that is a normal and integral part of the room."
So yeah, I think they have a case.

There are people who do all sorts of weird things to create a law suit, like the lady who put a friend's severed finger tip (from an accident at work) in a fast food restaurant meal and then claimed to have found it in the food when she really planted it.

I would imagine the easiest way to rule out what you're saying would be for them to try to get a DNA sample off the condom (if there was any semen left in it), and one from the father, and compare.
