Explain. Through practice or briefing? I'm assuming by practice.
Practice...Practice.
Got appointed to a MAJOR pain-in-the-ass on two felonies and a misdemeanor. Guy's a total dirtbag, but the State's cases are weak on all counts. One of the charges is Felony Domestic. But now the "victim" is in LUV with him again. So, as they're talking on the phone while he's in jail, and he's reminding her that he's never beaten her and the marks on her neck were hickies, the jailors are listening in (no expectation of privacy while in jail). So the Prosecutor files a new charge of Felony Witness Intimidation.
So I'm going over the affidavit attached to the complaint and this is the biggest P.O.S. charge I've seen in a long time. But the statute reads:
3) Any person who, by direct or indirect force, or by any
threats to person or property, or by any manner wilfully
intimidates, influences, impedes, deters, threatens, harasses,
obstructs or prevents, a witness, including a child witness, or any
person who may be called as a witness or any person he believes may
be called as a witness in any criminal proceeding or juvenile
evidentiary hearing from testifying freely, fully and truthfully in
that criminal proceeding or juvenile evidentiary hearing is guilty
of a felony.
The P.A. is hanging his hat on "influences" because there is NO intimation that he's threatened or harrassed her. To me the statute is clearly over-broad. Virtually anything could be "Influencing" the witness. Me prepping her for trial could be "influencing" her. Surely the P.A. telling her he's going to file charges for filing a false police report is "influencing" her.
So, we'll see how it goes. It's early.

What good would it be to try using logic on a three-year old. It's the same thing I go through with the inmates that I work with. I usually solve the problem by taking their juice away from them though, or making sure they dont' get it in the first place. I'm sure they think I'm a big poo poo head, though none have called me that yet.
I know logic and three-year olds, and never the twain shall meet.
And I would think any inmate using the term poo poo head might have his black market value in cigarettes raised considerably.

I've come to somewhat of a conclusion that the validity of opinions increases with the number of people who share in that. The less women who believe he's attractive he turns into not being attractive and those who believe he is throw hissy fits because daddy or mommy told them they are always right.
It's that way with a lot of things, really. Why I know people who only watch movies that score high on Rottentomatoes.com.

That seems to be a reach. A birthday card could be seen to be influencing the witness in this case, among other non-determinative acts.
Is "influences" mapped out in the legislative history of the act or defined elsewhere in statute? I agree it seems to be an overbroad reading.

Great. Today he was blowing bubbles into his formula bottle. I found it mildly irritating that he was doing that instead of drinking it, but I thought it was cute that he figured out to do that on his own. The little guy isn't interested in crawling, but he can already take two or three steps before crashing and burning. He might just skip crawling.
Doh! Now I really do have to go to work! Shit! Fuck! I hate work!

I haven't had a chance to see if there is any legislative history yet, but i'd doubt it. There is Jack-Shit for caselaw on the statute at all (4 cases dealing directly with it) and absolutely zero dealing with what "influences" means.

As a non-lawyer person, doesn't that go against the whole "Innocent until proven guilty" thing, unless he's been previously convicted and it's prior bad acts or whatever.

The training I have had has been from my backyard as a kid catching all sorts of critters. My family thought I was going to be like The Crocodile Hunter (before he was known). I just never had a fear of animals and reptiles, I would just grab them. We did a field survey a few months ago for the DNR and my GF thought I was going to pick up a rattle snake . (I am nuts but not crazy)
We are members of our local herp society as well. My girlfriend works at the local herp center here a few hours a week. And we are the go to people for our area for picking up reptiles for the Humane society and for the area police departments captured from Raids. So I am getting plenty of training as I go along the way.

Depends on how much of a prick or prickette the prosecuting attorney or other attorneys want to be. Most legal statutes are open to reasonable interpretation (and unreasonable interpretation) beyond a "plain reading" of them. That's where you make arguments through motion, briefing and/or oral argument to a judge or panel of judges and a decision is made providing the court's interpretation, which is generally final before any appeal can be made.
In this case, a statute was read pretty broadly in order to unduly impact a case in pre-trial prep. Slam may need to argue that it was too broadly interpreted and applied and the judge needs to agree with him.

Thanks for the praise. Its a lot of hard work and a lot of reading and keeping updated. But we do enjoy going to schools and talking to the kids.
I did one cub scout troupe show were all the kids were quiet for over 40 minutes. A friend of mine who arranged it said that was the longest any of the kids sat still and were quiet for any length of time.

The highlight of my work day (I'm now home since the office was dead and nobody noticed or cared if I was there or not) was mediating an argument between the guy I supervise and this crazy lady who's at the same hierarchal level as me. The crazy lady has been out for the last three months on a suspicious claim of a worker's comp. injury. So, they borrowed my guy from me and the corporate side of things and and had him fill in for her on the transactional side of things. Since her return, the crazy lady has been giving him shit about deal details that have fallen through the cracks while she was out healing from her "injury". The poor kid (he's freshly out of college) had a huge learning curve going into her job, but did a magnificent job covering for her - good enough that we'd be alright if the company fired her (which I heartily endorse because she's extremely difficult to work with and she's now driven away two transactional lawyers). Hell, we'd be better off. Anyway, I tried to be as rational as possible and not let my feelings get in the way, which is really hard to do because I really don't like the woman. Anyway, we settled it for now, but despite my pointing out to her (with her agreeing) that she acts through her emotions thus complicating even the simplest of things, I doubt anything is going to change anytime soon.

That doesn't mean anything. If the rewriters don't change more than "50%" (or something crazy like that), they don't get a credit. And Hayter gets the credit for all of the character names, and situations that came from the actual comic.
Uh no... he gets credit for the screenplay with some other guy and Alan Moore and the other person he worked with gets credit for the comic and the creation. Hayter basically gets adaptation credit.
There were like 4 script doctors on X-Men and X2... one of which was Carrie Fisher.
Tweaking and tightening don't count as writing so much as editing.

He makes me nervous, because as a writer, he should have insisted on changing 99% of the horrific dialogue from the metal gear games.
He also starred in Guyver 2.
Plus I like the over the top cheesiest in some places. It almost sounded like "what kind of stupid video game did I walk into" ya know.

I know that but he's still credited on imdb and Hayter wouldn't ever say he created Watchmen. He's Canadian after all. Well, born in California but his parents are Canadian and he has dual citizenship and he's always on The Spaceys which is the best damn genre award ever.

Add to it that it features the greatest Christmas song of allptime (Christmas in Hollis) and you have a winner.
Lethal Weapon is another good Christmas movie.
