This looks great. I've been disappointed with X-Factor lately. That X-Cell story nearly killed my enthusiasm for the book, but everything seems to be back on track.

Well endangered species usually get their own nature reserves but i'd say this would be a rather unique situation since we've never had an intelligent species dying out while there is a bureacratic justice system in place. Not sure exactly what they'd be entitled to.

Perhaps mister Huber is after a mutant reservation zone, say .. a self-governing mutant town. It's not without precedence. X-factor made it pretty clear they run Mutant Town and Strong Guy is being set up as sherrif of Mutant Town.
