Welcome Pop Syn, and the new folks I haven't greeted yet---my apologies for missing you.
(and Sean, that magazine cover is pure brilliance, wow.)
Americans have a sort of inbred cultural trait to back the underdog. Even *I* wind up pausing and thinking, "Daaaaaammmn this is a lot of heat to bring down on one guy." It's a reflexive twitch. I get over it quickly. I have a very well-developed mercy gland, but occasionally, some things just need stompin'.

I'm sure this is in reference to the article that Rick swiped from www.popsyndicate.com, put on his myspace, my calling him an attention whore, followed by Rick's lashing out at the wrong person.
Well it was the email where he told me to 'f-off' and that I'm a 'toy'...whatever that means. Then jumped my ass over something else. I didn't really have a clue what he was talking about since he didn't even register on my radar until three days ago. I know Ronee had some problems with him but that's about it.

I agree and it is more than a decent pinup. I'm the current bidder, and this is bad auction strategy, but I promise to bid at least $51 for this if anyone wants to drive up the price a bit.
It's a really nice piece, I hope to win it, but if not, I hope I lose it by a lot and not some snipe bid.

If the win means at LEAST that he'll discontinue his ranting about suing everyone and their brother... it'll be a huge step forward.I wouldn't count on that. Past wins against him have just been an excuse for him to claim victory on appeals that show no sign of ever existing, much less of being won.
But think of the satisfaction that might come of having tightlipentertainment.com pointing to unscrewedcomic.com, or realizing that if he ever checked the ocrafresh.net website again he'd simply find the words "Goos night, pukee"... or from knowing that he's lost the legal right to promote anything using the "Mighty Mini-Con" trademark ever again.

I'm 5'6 (and a half, darnit), and went through the exact same thing.
Generally, I wear wedges or platform type shoes because I like the look, but that pushes me up to near the 6 foot mark, standing.
Wheelchair-height the rest of the time, though.

I know lots of people who are pretty sizable... but never really notice. Remember - even Stephen King said Hugo Hurley was the coolest character on tv. And everyone loves Hurley because of his personality.
People's large size only becomes a detriment when they lack charm, character, and grace - and the bitterness underneath seeps out.

Heh. A very wise man told me last summer that he never noticed my weight until I pointed it out. I can't wait to see him again at Emerald City Con, as I've lost some weight since then and feel wonderful about myself. I wonder if he'll notice?

The Schulz's Youth book is looking really nice.
My burger moo'd as I bit into it. No guilt. :)
Any content differences between the softcover and hardcover editions of Schulz's Youth? Just took a look at the solicits. I buy my comics through mailordercomics.com (best place to preorder comics, IMHO), and the difference between the two editions isn't very big, and I love me some hardcover.

I'm afraid I'm stuck in Seattle. There's a very tiny chance, if finances improve dramatically, that I can go to San Diego Comicon this year (I have an offer for a place to stay and entry badges, I just have to get from Seattle to San Diego... which just isn't likely), but otherwise Emerald City is it for me.
That guest list makes me wish I could make it to Dragon Con, though.

The goal was not to create a deluxe and a mundane edition; it was mainly to offer a hardcover for those who prefer hardcovers (after talking to the folks at the Schulz Museum, who found that they were regularly selling many more hardcovers of the book Charles Schulz: Conversations than paperbacks, despite a significant price difference and no content difference.)
Besides, I wanted to have done a hardcover, to add to my skill set and comfort range. Same reason you're likely to see the first About Comics color publication next year. Haven't decided yet what it will be, mind you...
No dust jacket on the hardcover, just printed boards.

Let me help you out here...
Suppose everybody who has work in, say, Tales of the Spooky, were to sue Dickless, and they asked the judge to award them ownership of the characters, titles, trademarks, concepts and all other intellectual property associated with the stories they did.
Now suppose all those people got together and published UNSCREWED! PRESENTS "TALES OF THE SPOOKY!" and divvied up the profits afterwards.
Suppose they also acquired ownership of all Dickless' domain names and pointed them to UNSCREWED!
Even if there wasn't much in the way of money, the poetic justice alone would be a delight.
You guys HAVE to do this. It's a moral imperative.

Chowder's fine, but if you're a TRUE New Englander, you've got to have a well-broken-in stoneware Beanpot since it's impossible to make a decent batch of Baked Beans in anything else.

The true New England accent isn't even prevalent in CT (to be honest). Matt can verify, no accent here. It's more of a Mass and upper NE thing (especially VT and NH).

The true New England accent isn't even prevalent in CT (to be honest). Matt can verify, no accent here. It's more of a Mass and upper NE thing (especially VT and NH).
As for Boston Baked Beans... ummm... I prefer the candy style... not so much the hot. Besides.. if I indulge in any bean product... I usually sleep alone... by demand.
I've lived most of my life within 30 miles of Boston and a good portion of my relatives are Vermonters and Maineiacs, so you pretty much know where I'm from as soon as I open my mouth.
As to the beans - yeah, I don't do "barbecue"-style; it's good old brown sugar and molasses. Damn - I'm getting hungry... good thing I've got leftovers from this past weekend in the fridge...
And being single, I can eat them whenever I want! (There are *SOME* small perks to singlehood... -he said, looking on the bright side...)

You know what would be really good? A form letter we could send out to anyone we hear of who gets sucked into Olneyworld. It should be brief, factual, businesslike, and signed by Kurt Busiek, Mark Waid, Gail Simone, Tony Isabella, Nat Gertler, Scott Shaw!, Chuck Dixon, Paul Smith, Val Staples, Heidi MacDonald, and anybody else I may have forgotten to list who has some name-recognition and has expressed an interest in the matter.
Joe Manga may disregard a note from Matt "Karma's Little Helper" Martin, but I think they'd pay a bit more attention to a letter from the Unscrewed All-Stars.
What do you think? Can somebody draft such a statement? We could send it to all the usual outlets, and also keep it on hand to fire off to the gullible.

I prefer books without dust jackets, actually. And I seriously detest slipcases.From a printing and distribution standpoint, a dust jacket is just another thing to get ripped.
One other thing about the hardcover -- it's only going to non-returnable markets. So you're not likely to see it in places which don't specialize in comics (which is not a problem for you, since you're pre-ordering through one.)

I checked out Jason's ComicSpace page - he's got some galleries up, along with links to his work on other artist sites. Not quite my thing, I have to say, so I'm not a final judge of the quality. Seemed a shade to busy in the panels to me, and the eyes are far, far too big, even for the exaggerated manga style. Other than that, not bad. Good sense of composition (and that can't be faked). Wish him well -- especially since we know how feeble & hollow Rick's endeavors are.
But Dave, I think you pegged it exactly: the microscopic one probably spent plenty of time filling Jason with his side of things, how he was wronged and cheated by all these people who hate his visionary ways. Wasn't my intent to be derogatory or demean Jason as he's done nothing wrong. If I offended some people I'm sorry for that. It was word play for the sake of comedy (ok bad comedy) and nothing more. Clearly if we continue to warn Jason it's just going to reinforce Rick's "I'm a victim" story. Sadly he sounds as if he has been brainwashed by the Cult of Rick. Eventually it'll become payment time or Rick will have found fresh new victims to manipulate and just toss him aside. Fortunately for Jason, there will be a group of people called Unscrewed who will be there to pick him back up after he falls.

As far as I understand it, they own Blue Beetle, specifically this version of him, as it's completely different than the Charlton version. This is a mix of mystic and sci-fi. (the Scarab is a sentient alien thing)
I do believe they only licensed Dan Garrett, and Ted Kord, but once Charlton went out of business they ended up purchasing the trademarks in the same way CrossGen did with Brian Pudello's Chaos! characters.
I could be TOTALLY wrong, but for some reason it *sounds* right.

Part of the problem is the very nature of the business, unfortunately. As a beginning artist without a creative team, what do you do?
And many artists try to go pro too soon, imo, usually a few years too soon.
And even seasoned pros can't get always get work at major labels. It's just this really negative chain of suck until you make it, most people don't, it chews you up and it's the people left standing who make it.
So it sets up newbies to be taken advantage of. A lot of beginners don't educate themselves and network beforehand before jumping in, not realising that the business is a lot meaner than the hobby.

It's the risk you take with hooking up with anybody unfortunately. Some people are too young when they try to go pro true, (hell, I'm wet behind the ears still *squeak) but it's a risk you have to take. You have marvel dc and everyone trying to line up there. Some sharks are going to get by.
The real thing that gets me with Olney is how he had a system that just seemed to rip people off and nothing else.

It's like everything else with Olney-- he doesn't understand how things work, he approximates and tries to fake it.
He doesn't get language or how to run a real label, or pay his bills, anything. He just fakes it. I dunno why, these things can be learned.

I'm not sure, but wouldn't 'mini-con' only be a problem if his MMC character was a robot instead of the little blue guy? The 'con' clearly relates to a convention, nothing else.
I think its worthwhile to go after him for the things he HAS done, rather than resort to grasping at straws.
And I really, really wish those people who continue to take shots at his family, especially his daughter, would give it a rest. Who cares if she can sing or not? It's got absolutely nothing to do with anything. Olney is vile enough in his own business practices and lack of integrity and his homophobic racist sexist diatribes.

And his business practices are exactly WHY I contacted Hasbro. They may not be very happy to even REMOTELY be associated with him. So, now it's up to their legal dept to decide what, if anything, to do about it.

You know what would be really good? A form letter we could send out to anyone we hear of who gets sucked into Olneyworld. It should be brief, factual, businesslike, and signed by Kurt Busiek, Mark Waid, Gail Simone, Tony Isabella, Nat Gertler, Scott Shaw!, Chuck Dixon, Paul Smith, Val Staples, Heidi MacDonald, and anybody else I may have forgotten to list who has some name-recognition and has expressed an interest in the matter.
Joe Manga may disregard a note from Matt "Karma's Little Helper" Martin, but I think they'd pay a bit more attention to a letter from the Unscrewed All-Stars.
What do you think? Can somebody draft such a statement? We could send it to all the usual outlets, and also keep it on hand to fire off to the gullible.
I like that idea.

It won't surprise to me to learn that Olney has never fully trademarked Mighty Mini-con. Trademarks are a lot different from copyrights which you sort of get as soon as create something. Trademarks cost a lot more and it is usually adviseable to use an attorney skilled in trademarks. Neither of those two things seem like anything Olney has ever successfully dealt with.

So it sets up newbies to be taken advantage of. A lot of beginners don't educate themselves and network beforehand before jumping in, not realising that the business is a lot meaner than the hobby.Having dealt with, and working to educate gently, hundreds of small press and indy publishers...truer words have not been spoken. People get a portfolio together and think they can walk into a convention and walk out with an assignment, but 90% of the people simply are not ready to work on a pro level. The SPA was formed to change that. Slowly we are, despite how Rick Olney tried to destroy us.

This is a sad, sad day.
I went and read up on Mr. Dube for a bit. Tried (not very hard, mind you- I'm awake when I don't want to be, so I'm a bit irritable at the moment) to find something that wasn't a pinup, and couldn't do it. I'm not impressed with pinups anymore. I need to know if he can tell a story. So far, I've seen nothing.
As for the style, manga's not my cup of tea. Except for the coloring, everyone looks the same to me. Sometimes, you can't even tell a guy from a girl. The stories may be great, but comics are a two-fold buy: story AND art. Manga art kills me. No other way to put it.
Do I think Mr. Dube is blustering on his sites? A bit. Overblown, in the way that most websites overhype things. However, he doesn't deserve YOR. Hyperbole isn't an offense that's punishable by YOR. It's just not right.
So, Matt sends over a warning, which gets forwarded to YOR, which YOR then posts for people to see (Thanks, YOR! Everyone wave!), but Mr. Dube possibly doesn't take it seriously.
I sincerely hope that Mr. Dube gets as far away from YOR as soon as possible. It's almost scary. Think about it: what if he signed an "exclusive" contract, a la Mr. Leal? YOR more than likely promised him the world, but will only deliver a world of shit.
I hope Mr. Dube does at least the curious thing and goes to the site and thread that Matt directed him to. We're curious creatures, aren't we? I'd at least want to go and see what I'm being warned against. He can make his own decision from there.
If he makes the wrong decision and then the inevitable happens, all I ask of everyone is this: don't say "I told you so." It'll only rub salt in the wound. Let's just pick him up, dust him off, and start the healing process. He's going to need it.

Many trademarks are generic terms in some realm but can be trademarked in a realm where they are not generic. You can't trademark "chicken noodle" for soup, because it's a generic descriptive term there... but you could trademark it as the name of your line of pickup trucks.

Trademarks cost a lot more and it is usually adviseable to use an attorney skilled in trademarks.No, actually, in the US a trademark costs nothing; you can have a trademark simply by claiming it and marking it with the TM in trade usage. Registering a trademark (getting you the R-in-a-circle mark) does indeed cost more and gives you greater protection, but one legitimately has a legally-protected trademark without doing so.

I agree about sparing his daughter, but not his wife, who was co-partner of TLE while all the contracts were set up.
It's up to Hasbro to see if they want to step on Olney. Hey, if Hasbro does take steps against Olney, it's probably not that big of a deal to Rick. After all, everything's reversible, and he has TWO crack legal teams to defend himself, right?

Learning always begins with either "I don't know" or "I was wrong." If you can't say those things, you're doomed to eternal ignorance.

Nat can check me on this, but there are a few different trademark issues at play here.
First is infringement, using a mark that is identical to, or confusingly similar to, one already in use for the same class of goods. As you say, that's probably not an issue here.
Second is dilution, using a trademark as a generic term for a class of goods, for example, using "xerox" to mean "copy." Again, not an issue here.
Fourth is confusion, reducing the value of an established mark by using a similar one in an unrelated category, but in such a way that it implies an association or endorsement that does not exist. If, for example, you started a bakery that made tiny, chewy cookies, and called it "Micro-Soft Bakery," you can be sure that when the Microsoft Corp sued your ass off, "trademark dilution" would be among the terms used in their court papers. Since toys and action figures are part of the standard convention mix, an association with Hasbro could be implied by the name and they would have a cause to pursue damages under the Lanham Act.
