View Full Version : Rick Olney--Fibber or Mega-Giganta-Fibber?

What do you think will be the excuse for the deadbeat to cancel yet another convention? What is this, his sixth cancelled event?
1) 27th heart attack. Judging on the man's red sweaty face after climbing a set of stairs, this one might actually be a possibility.
2) Family member abducted by alients
3) Falls in love with goat
4) Is busy crying alone in his roon
5) Mommy refused to loan him more money
6) Battery in Van of Justice has weak charge
7) Is busy ripping off Monster Squad again
8) Stuck trying to come up with even lamer Mary Sue characters
9) Keeps naming Hawkman rip-off character H. Awkman, H.A.W.Kman, Hank Mann, Hockmann, Rick Olney, Hackman
10) People are mean

You know I am really annoyed. I know that's the purpose of these little "attacks" but being someone who lives very above board in all their dealings being called a liar is something that bothers me.
Of course I suppose it's like dealing with Bizarro in a way isn't it?
Our sincerest apologies to Bizarro for even associating his name with "the banned one."

Matt,
You can search for songs by typing in key words. You search for what Myspace has catalogued.
http://i9.photobucket.com/albums/a75/dannydonovan3/pwned.png
see?
You type in the search engien then just click the thingie that says post it on the blog.
Although to be honest he IS right about something. I have been spending more time posting here instead of doing things I *need* to be doing. I still need to get that write-up I promised JT ages ago.
just all this *gah*
Danny, believe me. NO ONE believes anything the deadbeat says. Again, google his name, or go to any convention. His name is mentioned only as a joke or in complete disgust.
He's failed at everything. Orca, MMC, and TLA are all failures and his pathetic designed-for-morons new club, which recaptures the excitement of watching a sub-literate tub of goo who doesn't know what decade it is, is the funniest spectacle yet. Watching the massive non-success from the get-go is a riot.
The more he blasts you, the more everyone figures you must be okay.
It's like getting flamed from Ed Gein. People tend to figure he only LIKES scumbags.

ORCAKids ™
I wonder if Olney has done anything to actually trademark ORCAKids. It's $400 just to start the process on your own and much higher if a lawyer does it. I know so because I'm in the process of trying to secure a trademark for my comic.
Also, the mini TM is intent to trademark if I remember correctly. I'm fairly certain you can only put a circle around the TM to signify that it is a registered trademark if the trademark application passes.
And Gail for reason #11 for the next failed MMC:
"Blacklisted by professional guests because of 90's, token female writer's lying and libel CBR thread" to which Olney will start an investigation and legal proceedings and that token female writer can expect to hear from his lawyers soon...

Actually, on that he's somewhat right... However not quite.
I believe the line for public domain is like 1953 now. If it's unpublished by the copyright holder, or is renewed after I think it's 40 years now... It falls under Public Domain.
Wrong.
Prior to 1978, copyright was for two terms of 28 years each, for a total of 56 years, after which it goes into the public domain. In 1978 this was extended to the lifetime of the author plus 70 years; for anonymous or work-for-hire, the term is 95 years from first publication or 120 years from creation, whichever expires first.
This means that basically everything published prior to 1922 in Public Domain. Works published after 1922 would have reached the end of their first Copyright term beginning in 1950. If not renewed, any such works would have become Public Domain, as long as the first term expired before January 1, 1978. This means that anything created prior to 1950 and not renewed would be out of Copyright. Anything protected by Copyright on January 1, 1978 got an automatic extension of the second term to 67 years, for a total Copyright of 95 years.
So here are your guidelines:
Published prior to 1922: Almost certainly in the Public Domain.
Published between 1922 and 1950: Possibly in the Public Domain, assuming Copyright was not renewed when it expired.
Published after 1950: Most likely not in the Public Domain. It might be, if it was Work-for-Hire and the company holding the Copyright is defunct and assets were not transferred to another company.
It might still be protected by Trademark law, so tread carefully. Mad Magazine has successfully defended Alfred E. Neuman against infringement suits on several occasions by proving his image is in the public domain and has been since at least 1865; at the same time they have successfully prosecuted several cases of trademark infringement on the same image. See how complicated this is?
You can find all the real answers about US Copyright law at http://www.copyright.gov

I know Tom, but for some reason it gets under my skin. I know people like this, and it bothers me, not so much it's me they're going after. I will not deny I have a thin skin but I can deal with it. It's life... But these people spend ALL THEIR LIVES tearing down others and never build anything for themselves!
It just makes me sad. That there are people in this world with enough energy to devote to negativity but are too lazy to do anything worth a salt in this world.
Take us for instance. We were burned, hurt, and burdened by this terrible thing. What do we do? We put together something that will not only help EVERYONE who got suckered into this situation, but help anyone else who may fall into a similar trap.
Creating something good out of the bad. Some OTHER people would rather create bad out of good. And I guess that's what bugs me, if it makes any sense what so ever.
I know, Rick is a liar, a theif, and a cheat. So to call me names shouldn't bother me. But you know it's the principal of the matter. I don't think he has room to blog one iota until he's done ANYTHING worth a damn.

People are going to react according to their natures. Whether that's good, bad or indifferent isn't really something you can't do much about. There are people everyday who are sick that could be cured if they worked at it, but don't take it. There are people with gifts and talents that just amaze you, but don't do anything with them. Rick is one of these kind of people. He's the first to complain there's trouble when none exists and the last to do something when things need doing. That's who he is. All he has is his whining voice to comfort him. Like I said earlier, you can almost pity him. Because that's all he knows.
Yet on the flip side there are people who just do wondrous things with what limitations they are given. That overcome things dubbed impossible by others or just make lemonade from lemons. This is a great example. Tom Stillwell is doing a kick ass auction. There's a comic coming out to help recoup some losses. Mark Waid did his heroics earlier in the thread and people are fighting back. As bad as this was, a lot of good has come from this. It's what you dwell on.
All Rick has is a few quips. He has nothing else. Nada. He's never done anything with himself in this hobby he loves so much. Look at what you are doing. Your actions are worth millions of his words. Don't let him get to you. He doesn't know any better.

How about this to make you all smile. Misty (Mercedes Lackey) is contributing the lyrics from her popular old song "Dark And Stormy Night," for the UNSCREWED! anthology. I'll be adapting it as a two-pager.
Sixty-some titles in print, a total of around four million copies in print around the world (most of them Heralds of Valdemar books), and this will be the first time a Valdemar story (or song) has ever been in comics form. (No comics deals? I swear, we need a promoter!)
So, there you go. Another major name joins in, and it's even a first! Another milestone for UNSCREWED!

You are a kind and passionate person.
Unfortunately, such people tend to get burnt out. I understand how you feel, though.
Hopefully, people will keep at it, and he'll get what he deserves. What people are doing now is the best thing, since it's forcing him to be accountable for his actions in a public manner.
He may never stop being a hateful cunt, but at least people can take away his power to do anything with that hate. That's the best revenge you'll have-- that and being the success he won't be.
I know that won't stop the aggravation, but at least, here, there IS justice being done, and that's pretty rare.
Aww thank you. Yeah I do get burnt out at shockingly regular intervals... It is just frustrating to see something that could be so easily fixed become a drama into itself.
Just succeed in what you want to do. Show the fat bastard up like Gail, Tony, Scott, Mark, Tom, and every other creator has. Everything you produce, sell, etc. proves you are a creator. Rick only makes trouble and debt.
Thanks Matt. :)
JP
Thanks JP, and considering I'm a.) working on a rather high profile thing with a fantastic artist that Rick tried to scam but she was FAR too smart for him (I think some of us have taken to refer to her as a sooper genius) and b.) just got a relatively interesting offer considering some of my previously published work.. and c.) I get to share space in an antholgy with Paul Smith and Larry and Misty, as my Ronin story just got accepted by the editorial powers that be... Things are looking more up for me than it is him.

Published after 1950: Most likely not in the Public Domain. It might be, if it was Work-for-Hire and the company holding the Copyright is defunct and assets were not transferred to another company. You seem to be overlooking things that were published between 1950 and 1963; as you note, everything in 1978 had their -second- term extended to 67 years, but items from those periods were still in their first terms. If their copyright was not renewed 28 years after publication, then they don't have a second term at all, and thus are in the public domain.
Work published after 1950 can also be in the public domain if it doesn't have a notice attached (although that is no longer a limitation for new works) or if it was produced by the government.

Will someone PLEASE tell him who Wertham really was?
I am so sick and tired of seeing him use that phrase as he obviously isn't meaning it as it's meant to be used.
I believe his reference to "Superman Complex" has to do with the classic (apocryphal?) story of the child who reads a Superman comic and believes that, by tying a towel around his neck as a cape, he will be able to fly off of the roof like Superman.
I *THINK* that what he's trying to imply here (and - as usual - doing a bad job of it!) is that groups like this one, having read many books in which characters practice vigilante justice, feel compelled to ENACT vigilante justice. He ignores, here, the fact that he has, thus far, apparently lost in TWO issues at court, which hardly falls within the common understanding of "vigilante" justice. He ignores, also, the racist, sexist, and homophobic hate speech, as well as physically-descriptive insults and personal attacks that he has posted here for the sole purpose of goading reaction, as well as the slander, lies, and breach of contract that have been documented here and elsewhere - and apparently sees them as being, somehow, irrelevant to the "vigilantism" that he perceives.
...And - while I would like to believe otherwise - I can almost guarantee that, if he decides to quote my references to "vigilante justice" he will stop quoting right before the sentence that starts "He ignores, here...".
... I'm just sayin'...!

We're with Archaia, if you're looking at smaller presses. They do good work.
Marvel is adapting Steven King's Dark Tower series. Peter David is adapting King's book series with King as creative director. Not exactly as they made it out to seem as if Steven King was writing a Marvel Comic.
Which actually DID happen back in the 1980s. Where King worked on the Heroes For Hope book Marvel did with proceeds benefiting hunger in Africa. Now it's a bit before my time as someone who had any idea of what was going on besides "Spider-man is like totally awesome."
He did the foreward but didn't he also write or at least plot the Obnoxio The Clown X-MEN story in HFH?
Dark Horse is good people. Image too if you're looking to adapt it straight out and do all the production work yourself.
Arcana is a nice small press outfit that has a few licensed properties. Also Marvel's deal with the Dabel Bros. has a lot of Fantasy-esque adaptions coming out now.

Gail
My guess...he blames it on the "libelous YABS thread" people and then threatens to sue everyone on it for harrasment of his guests (who don't agree to appear), his fans (who don't want to go if no guests are there), and Spider-Man (because the costume shop wouldn't accept his check for the XXXL suit).
Oh...howzabout...The free give-a-way glasses and t-shirts order didn't come in on time, and he didn't want to disappoint everyone attending just to get those great "collectibles?"
Or better yet...his "legal teams" called a last minute strategy session to go over all the impending lawsuits he's handing out to everyone?

If that last bit is true, why can't we get a nice reprint of Will Eisner's comics for the army? As a buyer of the Spirit Archives, those few pages are rather tanatalizing. His style radically changed during the war years, but most of it has gone unseen since he wasn't working on the Spirit feature during that time. I'd love to see that stuff reproduced.

You are correct, sir. As of course I would expect you to be.
By the way, I think there's a Licensable Bear story in here somewhere.... Something revolving around the business with Comics in the Classroom, where some innocent guy is told that his original work is not his own, that somebody else owns the "copywrite" on it. Having been on the receiving end of a false accusation of counterfeiting, I'd like to see that side of it addressed.

Here's something that's been gnawing at me for a while, and I'd imagine only JT or Tom or Inkpot can remember:
Middle of last year, before the first adventure was even 'written', Moby was bothering a toy company about producing a line of sculptures (or possibly action figures) based on the Monster Squad. He was going on and on (and on and on ad nauseum) about this prospect, until, just as suddenly as he came up with the idea, it was dropped. He claimed they dropped the ball.
But . . .
The name 'Shocker Toys', based outta NJ, keeps coming to mind. They made a very strong showing at this year's American International Toy Fair (hey, there's another story!) with their biggest push being a series of independent action figures, Monkeyman and O'Brien, SCUD, Strangers in Paradise, Bodybags and Conan amongst the first waves.
I dunno if I'm naming the wrong company, cuz they certainly don't sound like people to blow a deadline. So if anyone involved with the TLE can remember any of those details, lemme know.

You're thinking of Marvel Toys, formerly Toy Biz.
Shocker Toys has announced and announced products and never produced anything to date except a lame Minimates rip off called "Shockinis". They did announce a comic inspired action figure line (Shadowhawk I think was one), but nothing's been made yet. It would not surprise me at all if they had made a deal with Olney. Like Olney's own deals, nothing will come of it.
Shocker Toys kind of are the Rick Olney of toy companies. All talk, no product. And bad ideas. Like a shoulder mounted action figure.

I don't remember an action figure line of any sort. I do remember he had a bust done up of "Kid Mummy"... but I'm not sure for what. Could have just been a bust.
It was Shocker Toys, which by chance, I just signed a deal with last week to make Honor Brigade action figures and Shockinis.

Just like all the no-talent losers in comics lately who want the 'kewl' stuff of being a creator but never seem to actually do the WORK or produce a COMIC.
J-bolt syndrome, same exact thing. "I want to be Stan Lee but I don't want to bother writing thousands of comics, I just want to go straight to doing filmed intros for direct to video superhero movies."
They desperately want to sign autographs, but they don't want to do any work, and pitiably, they think the rest of the world will see their lazy, unimaginative concepts and fall so in love that they hoist these non-producers on their shoulders like gods.
It's delusional, but worse, it's pure laziness.

I hope it works out for you. But Shocker Toys has been showing the same Gwar prototype at cons for years and never released the actual figure.
Here's a 2004 press release:
Shockinis: A New Breed of Action Figures
They’re small but tough. Shockinis, a new fully pose able action figure from Shocker Toys (ToyDirectory), are bound to be the talk of the town. Based on a character from the soon-to-debut Skocker Toys American Manga magazine. The all-white action figures are totally customizable, which allows collectors and kids alike to adorn and change the looks of the figures. The figures are set to dedut in three versions of the Ape-X robot, the first in a line up of 150 different robots. Also new are the Shoulder Action Figures, the only ride along action figure known to date, with cool sculpts and paint jobs that come with a base, decals and a harness for kids to pull.
I don't think any of these things (except for the Shockini) ever came to be.

Or fear. To try to publish something means that you risk being rejected or expose yourself to critics. Not only can they face their fear, they cannot accept the fact that they can't face their fear. In order to look at themselves in the mirror, they tell themselves they did face their fears and succeeded and go to great lengths to maintain this delusion.

Heh, funny to see stuff from my website getting involved. Olney linked to the Wertham testimony from my webpage and that Kid Melton image is from there (but I got that from elsewhere, wish I had a better scan of it too).
Superman complex as I remember it is that one person (Superman) is invulnerable, but enjoys hurting other people, knowing he can't be hurt back. It's how Wertham descibed the joy kids had in Superman going after regular human crooks.
It 'sorta' applys because people here never ripped anybody off or made bogus claims, but Olney did. So you're able to poke fun at him for that while being invulnerable. Boo bloody hoo.
It's very Olney like to think you should be able to rip people off over and over again and have it be nobody's business but his.

I'm not too concerned. I go into it eyes wide open. I don't lose anything if they don't produce. It's not like Mattel or Hasbro are knocking down my door.
It's in their best interest to do something with the characters.
I can always make deals for other kinds of toys with other companies.

I also have a licensing deal with Shocker for characters from Furious Fist of the Drunken Monkey. The Indy comic figure line has been veerrrryyyy slow getting up and running, but seems to be making progress. They recently showed the painted prototypes for the Shadowhawk, Strangers in paradise, and SCUD figures. I think an early Maxx figure has been done as well. I've seen designs for a Shockini version of my main character, but not for the 6 inch sculpted figure.
I don't know what Tom's deal was, but I wrote a clause into my contract with them stating that thedeal was void if they didn't produce toys by a certain date. I've seen designs for several other Indy comic Shockini figures as well. Some really well known and others not so famous (including mine).

Thanks for the PDFs, Matt. The first two I did read at the end of the week. But the other two, NOT.
Now, I don't know where that pix of you was taken, but I'm guessing that building in the background is a convention center? In any case, it's a pix of someone quite clearly doing a little mugging for the camera on a very nice day. And yet, he of course has to make out like this is one's "ordinary" appearance! Ijit. Plus using a REAL person's image without permission. Pfft.
The most priceless statement in his whole schpiel?
"I did nothing."
How funny is it that this statement plays both as truth and lie?
"I did nothing" (truth) - "I signed contracts and failed to deliver on them", "I've said for three years I was publishing comic books and have nothing in print", "I've promised to pay people money owed them, and paid nothing."
"I did nothing" (lie) - "I went in an email group and did nothing [except lie about and insult other posters in the group, and but in with cappers that had nothing to do with the discussion, just in order to get the last word]", "I talked to pros on the phone recently and did nothing [except trash the names and reputations of even bigger pros in the business, out of sour grapes]"
That "Poor me, I'm such a reasonable guy" song of his is getting real old. Particularly when he can't turn around without proving how much of a jerk he is.
Oh, and also, since he thinks he can "make cute" the use of peanut as a designation for him, I am now demoting him again. Henceforth, the specimen will be referred to as paramecium.

I also have a licensing deal with Shocker for characters from Furious Fist of the Drunken Monkey. The Indy comic figure line has been veerrrryyyy slow getting up and running, but seems to be making progress.
Geoff Beckett (http://www.fwooshnet.com/forum/viewtopic.php?t=34506&postdays=0&postorder=asc&start=15&sid=a7f0d7534fd2fa7c197da5dfdaceff2f) of Shocker Toys sounds familiar...
Geoff Beckett has made it a habit of "hiring" individuals on the board and others and utilizing their talents on everything from web design to packaging and the like, the whole time filling them with statements like "Oh man, you're coming in on the ground floor, if you'll do me a favor, we'll REALLY take care of you when this stuff takes off" and trying to get discounts on all the work since he's doing them the favor of letting them in on a "once in a lifetiime" opportunity. THEN when it comes time to pay up, running and not paying them. I seriously doubt he's out ANY money on these sculpts he's "commissioned" so far since he was going from custom site to custom site seeking "Sculptors wanting experience" and offering them cuts from figures AFTER they sell so I don't think any money's been lost. He finds ways not to pay for stuff that HAS been used, do you really think he would pay for something he HASN'T.
Very familiar... (http://www.fwooshnet.com/forum/viewtopic.php?t=37506&postdays=0&postorder=asc&start=15)
I mean....really...no flame war here. Legitimate question. Can you NOT see the grave you keep digging for yourself? They're only supposed to be 6 feet deep, man. You're at like...85.
You honestly come across as being a horrible, HORRIBLE parody that just won't die.
I just can't see how you won't accept the responsibility for the reputation your company has. How YOU personally have soiled what could have been a terrific thing. "Indie comic book characters? Sweet! The Tick? Hell yeah!
Coming from Geoff Beckett and Shocker Toys? No!!!"
YOU did this.
So you can act like a big ol' hardass on here all you want. You can point fingers all you want. You can blame it on "storms", and legal issues, and unicorns, and whatever else you want, anyone else but Geoff Beckett........but you gotta stand back and look at the big picture here.
Toygeek really had high hopes for you, and high hopes for this company, and high hopes for Indie Spotlight......and look at him now. Dropping all ties he had with you.

I don't think I've seen any of you guys comment on the following from the www.mightyminicon.com site. I don't know how new it is:
TightLip Entertainment Never Left Publishing!
It appears that many people have been sideswiped by the infamous "Gail Simone" (legally quoted to denote a pseudonym) You'll All Be Sorry (YABS) CBR forum thread.
I'd just like you all to know that my nonsense of posting or replying to that message thread or any of the other online libel carrier websites is over.
As a business, we're moving ahead with our publishing goals. Our CBR string of websites are now moving forward also into their completion.
Do yourself a favor and go here to read what a Non-disclosure agreement signifies legally. The civil actions, and two small courts claims cases being taken into a higher court for reversal will be reported where you'll find the truth. Thank you.
Rick Olney
TightLip Entertainment
First off: "(legally quoted to denote a pseudonym)" -- Huh? So far as I know, there's no such thing. You will find books and such were, in order to protect private individuals, an author will put in an alias "John Smith" in order to designate a specific person. But otherwise, for literary pseudonyms? Nah. And "Legally quoted" -- the paramecium once again demonstrates its inability to handle the English language, as that would mean that it was a "legal quotation", ie, something allowed by law to be copied/quoted. It would NOT mean that that is the proper legal designation of a pseudonym, as the paramecium seems to believe.
The paramecium says that's its "nonsense" of replying to stuff is over. Yeah, like that will last.
This line:
Our CBR string of websites are now moving forward also into their completion.
"CBR" there links to the tightlip domain, but I got a WordPress stop page (I don't use WordPress). "Websites" goes to the Orca site, announcing its pending return.
Nowhere on the MMC site is there an indication of what he means the initials /C/B/R/ to signify. Which he'd better do soon, because in the arena of comic books, CBR pretty much MEANS "Comic Book Resources" and nothing else. He's trying to cover his ass about the stupid glass offer without having to recind it, but he's trying to tell the tide go back.
Also love the denial that the court cases against him are anything to worry about. So certain is the specimen that they will be overturned on appeal. Heh. Tell the appellate court that you couldn't even be bothered to communicate with the civil courts! (You know, making a direct address to a paramecium is soooooo counter productive!)

Yes - that's one of the reasons an appeal of any kind needs to be filed by an attorney. It's not something that can just be requested at will. And the very FIRST issue that would be addressed (by the attorney and the court) would be the default judgment for not showing up at all.
Since it's been stated here that Rick was advised not to show - he would be required to back that up. And since any attorney WOULD have gone and asked for a continuance while they assembled the counterclaim, then either the attorney is an idiot, and will be asked to appear before the court to explain, or it would come out that there WAS no attorney.

Why is it that even in that case... where a judge is asking him for his attorney's contact info... the response would be "you'll find out in DUE time buster!"

Yep. It just becomes more and more obvious that 1) he has NO attorney advising him; and 2) he has NO idea how the legal process works.

IIRC, I think people taken to court over using a person or a company's name as a url to clearly educate and inform people about the bad activities of that person were allowed to keep that name, but I don't remember.
I could be wrong, but I don't think I am?
