Looks like Rick has put himself in more legal trouble, putting articles from other people's websites without permission.

And attacking Tony because he's... short?!??!

Attacking people for things they have absolutely no control over? I remember in grade 3 the kids used to call me the N word because I have large lips, (eat your heart out Mrs Brad Pitt!) So, this grown man used the same techniques as 10 year olds to hurt his.. enemies.

Medication and a dark room with a large lock.
That's my recommendation.

So... He compares himself to his "idol" Dave Sim and attacks Tony Isabella; I think that says something about how he WANTS to be regarded.

He can't make it in comics... so he wants to be kicked out?

Well, in any case, given Sim's stance on creators' rights, I figure he'd have some interesting things so say about a publisher who doesn't pay his talent comparing himself to Sim.

Anybody eager to add a fourth ring to this three ring circus should probably let Sim know about this whole scenario.

Beyond that?

I'm waiting for Olney to compare himself to Byrne, Erik Larsen, Todd McFarlane, Rob Liefeld, Peter David... am I missing anyone?

Maybe he could start LOUDLY comparing himself to Harlan Ellison as well?

There are three new examples of Paul's UnTimely Tales. I was immediately happy to see some uncopyrighted art on the story, "The Vandals", written by Carl Wessler with art by Joe Sinnott from a five-pager entitled ADVENTURES INTO TERROR #17 (March 1953).

You know, Matt, I was wondering if it really was "uncopyrighted" or if it was just that he couldn't find the copyright on wherever he got the art from. 'Cause I wouldn't believe a thing he says on anything, but rather would independantly double source any claim he makes. (That's my day-job showing up, heh.)

I believe the line for public domain is like 1953 now. If it's unpublished by the copyright holder, or is renewed after I think it's 40 years now... It falls under Public Domain.

Hence a lot of old school heroes like Jim Ritchey's Green Lama (ok, Jim didn't really create him, but he might as well have considering how many people are getting exposed to him through his revival) are public domain after not being published since the early 50s.

At least I *think* that's right.

We may need the legal goddess Colleen Doran to expand on it.

I did a project for a publisher who asked me to research public domain properties. I don't have my notes, but the line in the sand I was to use was the late 1920s. I don't think the art Olney used is public domain.

Having said that, let's have some perspective. Printing 50-year old comics on his web site from a company no longer in business is a minor sin. It ranks on the Olney Scale at about a 2.3. That poem with the nook ranks about a 3. Putting quotes around Gail's name is around a 5. And so on and so forth...

(New thread meme- name an Olney "sin" and rank it on the Olney scale!)

The law changed a few years ago due to Disney not wanting the Steamboat Willie version of Mickey Mouse to end up in the public domain. I believe now it is the entire lifetime of the artist plus 70 years. I would have to check to make sure. Oh wait found it on Google here it is :

Rick has referred to this entire thread as 'libelous'. A blanket statement, that would include every poster (potentially), but specifically those he's mentioned by name.

I wonder what would happen if one of us with an ACTUAL attorney had said attorney send him a REAL cease and desist, lest he libel US with his statements?

Right! Took da woids right outta my mouth. Hardly any of the golden and silver age comics material was renewed in the appropriate way, outside of Marvel and DC--from which you can surmise how many publishers thought poorly about the potential for longevity and marketability of their product. An easy way to determine whether a property is free and clear in the PD, is to go to both The Library of Congress copyright search, and the Patent Office trademark search. My plans to do 'Vertigoesque' graphic novels of the Spark Publications characters is completely in the clear, because Ken Crossen, regretably, an ardent alcoholic with the ethical issues as a businessman that that would entail, wasn't in business for two years with it, and was required to renew at seven years. Of course, if I used Jerry Robinson's Atoman artwork from that period, I'd be likely legally (and definitely morally) obligated to give him fair value for the use of his work, under the Berne Convention, he owns the copyright--but the use of Atoman is totally up for grabs.

As for Paul Curtis, who would be horrified to know he was being praised by the Vile One...he worked for Marvel several years back on a project to reprint some of this 1950s material. So he researched the copyrights issue. If he says the copyrights weren't renewed, I believe him.

I'm still working on my next TOT, which is now scheduled for Tuesday. The guy what does my website needs some time off, too.

Kelly plays in her rec league all-star game (basketball) tonight. I'm looking forward to cheering her on.

More like forcing his hand. If an actual law firm starts an action against him (as opposed to small claims actions involving no attorneys), and he replies on his own, without any legal cousel from his 'two teams', then the full extent of his lying to everyone will be completely exposed. And I'd like to have a legal impediment against his posting more libelous comments.

Don't forget that a number of publishers went out of business or stopped publishing comic books when the markets got tighter. When they did that their characters simply vanished. The publishers ceased to exist so they didn't renew copyright and since they simply went out of business they didn't bother to sell their characters to another company (if there were any company that would want to buy them... some characters were such blantant rip-offs of other, more popular characters it wasn't even funny).

Jim, I would love to be in a position to take that on, given that I'm at the beginning of launching a writing consulting service, and in (I feel confident) breaking into the "higher ranks" of the comic book writing field. So I could quite legitimately claim that his libels of me had the potential of being detrimental to my reputation and career. And there wouldn't be any problem covering the "untrue" and "malicious" aspects either.

Except for one thing: for some odd reason, in all his comments (so far) regarding me, he's managed to avoid a direct libel. (Unlike what he's said of Gail, Ronee, Joanna, and others.) Why he's been so careful regarding me, I don't know. Maybe because he realizes how little he knows about me and just doesn't risk it. I don't know.

It's not the insult stuff (which Tony appropriately calls 'bush league', and applies to the fun we've had here at Rick's expense, as well), but the constant threats of legal action, and accusations of actionable issues like libel that are causing concern.

I started considering this when he implied legal actions against friends of mine posting here. But he implied it with me, mentioning my offer (and Mark Waid's) in a post where he states he'll be pursuing others here.

I have a lot of posts here. He's referring to the whole THREAD as libelous. And continues to state that everyone here is in for a legal wake-up call.

I don't like that at all. I get a lot of fan mail. And a lot of people are looking up things on the net about me, and my books, and the people I associate with. And I don't want to end up having to explain why I'm participating in a 'libelous' thread. Because it very clearly ISN'T libelous.

So. An having attorney ask him to stop ANY such proclamations isn't too high a cost. And when he can't even NAME his own attorney, much less reply to or defend against my complaint, then suddenly he'll be silenced much more definitively than just through board bans.

I loved your Matthau story. I am a huge fan of the late actor and I love The Odd Couple play, movie and TV series as well.

I got to play Oscar Madison in a high school production once. I based my portrayal off both Walter and Jack Klugman's performances.

I am also an ardent fan of Jack Lemmon.

I do wish I could have seen Art Carney's archetypal portrayal of Felix Unger though.

The market didn't really get tight (as in the bottom falling out) until around '54-'55. Most of what I'm talking about went under almost a decade before--while these publisher/speculators were riding a wave. Many of the actual characters were no more or less original than Batman--an 'amalgam' of The Black Bat, The Shadow and Doc Savage--or Superman--with heavy reliance on The Gladiator's Hugo Danner with back-story aspects of a previous comic strip--'Olga, The Girl with X-Ray Eyes'--also from National Periodical Publications--most combined 'templates' of creations who'd gone before. Green Lama was a non=murderous variation on the Shadow combined with Captain Marvel, for instance--which turned him into a completely different character from either of them. A whole lot of these characters weren't gone because the market bottomed out, or they weren't original (one meager example--the creators of Atomic Thunderbolt did 'Flowers for Algernon' by Daniel Keyes' plot a decade before)--but because DC and Marvel won out over speculators who were in what they perceived as a 'get in, get out' market. Another reason--the same reason why Eclipse is gone, and Dark Horse is still around. Dark Horse never let their expenditure on peripheral stuff, like big, fancy offices exceed their means. Eclipse were a wonderful company, and I would have done anything to work for them more. They were honest and paid on time--but even mild amounts of hubris seems to have consequences.

EDIT: Around the end of WWII, with the paper shortage, coincides with either diminished production or outright withdrawal, by these speculators, because the profit margin was severely reduced. Just left that out. By today's standards, the profit margin they panicked about would be a godsend.

Actually, on that he's somewhat right... However not quite.

I believe the line for public domain is like 1953 now. If it's unpublished by the copyright holder, or is renewed after I think it's 40 years now... It falls under Public Domain.

Hence a lot of old school heroes like Jim Ritchey's Green Lama (ok, Jim didn't really create him, but he might as well have considering how many people are getting exposed to him through his revival) are public domain after not being published since the early 50s.

At least I *think* that's right.

We may need the legal goddess Colleen Doran to expand on it.

Actually, Bill Black over at AC has been using the Green Lama at least since the 90's.

A friend of mine used to do phone auctions. I would help register, and take bids. Then after the auction I'd call winners back. One auction, I had to call Harlan to tell him he won an auction. When I told him, he cackled like a kid who got everything they wanted for Christmas. Pure joy in his voice. It wasn't a large item, or a high bid, but it made his day. Not the image you generally hear about in regards to HE.

As for Paul Curtis, who would be horrified to know he was being praised by the Vile One...he worked for Marvel several years back on a project to reprint some of this 1950s material. So he researched the copyrights issue. If he says the copyrights weren't renewed, I believe him.

I'm still working on my next TOT, which is now scheduled for Tuesday. The guy what does my website needs some time off, too.

Kelly plays in her rec league all-star game (basketball) tonight. I'm looking forward to cheering her on.

It's not the insult stuff (which Tony appropriately calls 'bush league', and applies to the fun we've had here at Rick's expense, as well), but the constant threats of legal action, and accusations of actionable issues like libel that are causing concern.

I started considering this when he implied legal actions against friends of mine posting here. But he implied it with me, mentioning my offer (and Mark Waid's) in a post where he states he'll be pursuing others here.

I have a lot of posts here. He's referring to the whole THREAD as libelous. And continues to state that everyone here is in for a legal wake-up call.

I don't like that at all. I get a lot of fan mail. And a lot of people are looking up things on the net about me, and my books, and the people I associate with. And I don't want to end up having to explain why I'm participating in a 'libelous' thread. Because it very clearly ISN'T libelous.

So. An having attorney ask him to stop ANY such proclamations isn't too high a cost. And when he can't even NAME his own attorney, much less reply to or defend against my complaint, then suddenly he'll be silenced much more definitively than just through board bans.

i REALLY hate bullies.

When Rick wakes up each day, he's still Rick.

Normally, that'd be punishment enough.

My story with a few famous guys...


My uncle and my 2nd or 3rd cousin were in a diner after working that day. We sit down and looked over and it was the Rock n Roll Express sitting beside us. They ( Ricky Morton & Robert Gibson) chatted with us awhile and told us about their homes and all while they ate. Plus said they were on their way to do a card for Smokey Mountain Wrestling.

I've met Morton again last year ( at a small indie card where we chatted for 20 minutes) after the times I met him at SMW's shows in the early 90's. He's a pretty sweet salt of the Earth guy. Had his kid and wife/gf with him as he said he was tryin to pay his bills. I respected that a lot and bought a DVD from him.

Back in the mid 90's met Jimmy " Boogie Woogie Man " Vallient at a gas station. He came out and talked with me and my dad sayin he was on his way to Indiana to do a indie show. Gave us a t-shirt. I still have it put up.

Down in Charlotte I was doing some work and I noticed that this guy was pretty damn big to be wearing a suit and tie. As we worked we joked around and started chatting as he said to me .. " You ever watch WCW back in the early 90's ? "

I told him yes as my mind started wondering. Because this dude was clean shaven and was about 6-3 to 6-5 . So he tells me he was Norman the Lunatic. The guy who used to play a mentally challenged guy who carried a teddy bear to the ring. We talked a long while as he told me that the business wore him down and he was in it to make some quick money and get out. That he wasn't a " lifer " like Flair and the others. Guy ran a software or computer business and seemed to be doin awesome .....nice guy.

Well, we all already decided that no matter what he digs up, we're not going to let it divide us. When Olney divided the SPA, I'm sure there were nasty things said by some members about other members, and Rick just enjoyed every minute of it I'm sure. SO, he'll probably be posting emails from that era, attempting to hurt people, when all he's going to do is confirm the fact yet again that he's a small minded child who gets satisfaction in other people's misery.

I used to pity him, I don't anymore. I pity every person and organization he comes in contact with.

and I'm not dumb enough to try to spin that into an entire military career that includes being a Viet Nam War Vet who paid to do the horizontal rhumba with Asian women while keeping the world safe from communism, and trying to prove it by posting photographs of real enlisted people in cammies, none of whom are me.

Folks: Don't forget to post Feedback on the seller's account. It should increase the chances in getting off-the-street traffic to bid. I know some folks don't bid online if the seller does not have at least 10 positive feedbacks.

The action is in it's infancy right now until I know how to proceed exactly but rest assured Olney will fear the "Cookies of Justice!" I was also wondering if pooling the evidence of everyone on the Unscrewed site might benefit others who are taking up action against him? I have a lot of damning emails typed by his own pudgy little hands. If it would help anyone else then I'd definitely share.:)

By the way, anyone who loves Kurt's work should check out a book he didn't do: Dr. Blink, Superhero Shrink by John Kovalic, Christopher Jones, and Melissa Kaercher. The first trade just came out, and it's a hell of a good time. The dedication went out to Busiek and Bob Newhart. Now how can you ignore that?

Hey Tim! You know what would be a cute cartoon for the website? Carl Banks' Uncle Scrooge donating a sack of money to Unscrewed! and saying "some people give tightwads a bad name!"

It could be altered slightly so Disney doesn't get all up in your grill, but I don't think they have Carl's version locked down. They have their Ducktales version.... but I could be completely wrong. ;)

I'm pretty sure that Disney has Uncle Scrooge completely under lock and key. Even Barks had to have their permission to sell his paintings of Scrooge (which they gave him, to their credit).

Still, artists sell original artwork (sometimes comic pages, sometimes not) of copyrighted characters on eBay all the time. I don't know if it's strictly legal or not, but I've never heard of anyone having a legal issue over it.
