Just repeating this for those who might have missed it, from Jazzma online.

What a crappy fake organization Orca seems to have been.

"Unfortunately I have had dealing with Rick as well and he has stiffed me as well. I am a lifetime member of ORCA and have been promised a membership bundle each year which I have not recieved.
He promised to send me a t-shirt a few months ago and I'm still waiting.
And if asked about his promises he says yes i'll get to it but he never does.
Gail who is mentioned above he has told me is one of his best friends. It doesn't seem like it.
Rick is always making promises he has no problem with that but keeping them well he seems to have a huge problem with that part.

Also, let me just say that I received the most awesome Alan Scott picture done for Jim Taylor and Jeff Austin that will be added to the next wave of items in the auction.

Two things.

One, Rick is even more of a moron if he believes their work to be subpar. I'd put their combined artistic skills against any inker/penciller working in comics today. I'd be a lucky writer to work with them at some point.

Two, Jeff Austin is a master taper. He taped that mutha up real good. It took me like twenty minutes to open the package. If he ever gets tired of inking, there's always a fallback job as a gift wrapper or something.

I never like Colan's work when I was first reading comics. It just seemed weird and unappealing to me.

Now I love it and can't get enough of it.

It is probably his use of shading. Not typical superhero stuff so it looked weird at first and not like anything else at the time really. I love it as well and have 3 original Daredevil pages that are awesome.

If you haven't already, check out his 2 Nathaniel Dusk minis. They colored his pencils rather than ink them. Really neat.

NONE of the big complaints about what a fake, shitty organization Orca was originated on this forum, or from these posters. They were other forums and blogs.

But instead of addressing the claims of these people (ie. that Rick lied about the benefits, that the promised material never existed, that Rick was a weirdo in personal correspondance), he instead claims people aren't expressing their love for Orca because of the big meanies on this forum.

MAGICMAN debuted in the 125th issue (February, 1965) of Forbidden Worlds, a horror comic from before The Comics Code Authority had put an end to horror comics, which had survived into the '60s by eliminating its horrific elements. His 12-page origin story was credited to writer "Zev Zimmer", but Zimmer, like other credited writers at ACG, was merely one of many pseudonyms Hughes used. Why are you ignoring those questions and, for that matter, how do you expect to "legally stomp" Matt if you gain a reputation for being in contempt of court? From the paragraph you quote, it appears Mr. Olney is attempting to create some sort of connection between his nascent event and CBR as well as Unscrewed!. This is potentially damaging. As an editor for Unscrewed!, I must say I'm not pleased.

I do believe members of our little endevour are looking into this.


My understanding is Mac will be sending a legal letter/injunction shortly.

I am not sure if he's working with Jonah or if Jonah is going to be filing a seperate claim.

I know its silly for something that'll never happen but you have to protect your IP.

Neither am I. But I am all for proceeding through proper channels to challenge the stupidity of the action.

If for no other reason but its another judgement against someone who's intent on collecting the whole set. I'm a firm believe that we should support collectors whenever possible. :)

I think it was a slight dig at Cohran and his glove doesn't fit defense in a way. That he got the one detail wrong like the glove. Where he was seen wearing it in countless pictures...

Two, Jeff Austin is a master taper. He taped that mutha up real good. It took me like twenty minutes to open the package. If he ever gets tired of inking, there's always a fallback job as a gift wrapper or something.

Jeff also a world class master... never mind.

The SPA started as a Yahoo thing. We closed it down and moved to a full forum system when we had 500 active...it just becomes impossible to follow that way. Groups are good for specific talk over short term...in my opinion.

True, but right now, we don't have 500 members. And we DO have the Unscrewed! forums already. This yahoo group I started was, admittedly, just to tweak Deadbeat Dick's nose. I'm evil like that.

On the other hand, it also helps get the word out there even more. Some people prefer e-mail lists to message boards. This, then, gives those people a place to go.

Don't most states recognize such judgments? I think CA and TX are the only 2 that it gets a little wonky at times..... But whatever state the claimant wins in, it appears NY will recognize it. :D

Just don't say anything that you wouldn't say to younger members of your family. It's supposed to be an "all-ages" group, for the discussion of comics etc, mostly for the older era.. Just general politeness... think of it like you're taking part on a discussion group on network TV. There are just certain things one can't say or due without offending the core demo.

Yes ma'am. It will go on my sigs (everywhere I have an account) it will go on my Myspace, and on my comicspace, as well as when I futz around with my zazzle account to make it look more unscrewed! worthy.

And it will be tossed into the next press release which will probably be in the next few days, as opposed to our usualy once a month thing as we have to announce the next wave of auctions once the current ones end in 3 days.

Actually, I believe (and I could be off here), the judgment just has to be filed with the NY system. So it's not like he's got immunity from it just because he's in another state. Just a matter of paperwork being filed.

I don't think he'd be upfront with his lawyer even if he had one. He might be crazy enough to get a lawyer involved without giving the lawyer all the details. I can see him paint a picture long enough to get a lawyer to take the case. And if this is true...oh boy. Lawyers hate being embarassed.

That is of course, if he even has a lawyer. Which I doubt.

And Rick: People don't threaten people on message boards with things like the "I kill" picture when they are charging those same people with harassment. And finally, Libel is only libel if it's false. Matt is saying what all of us have said. You have lied and cheated people and have perpetrated fraud in various forms. That is an interesting question, though: how can someone afford to pay an attorney (or a crack team of attorneys) when they have a glorious track record of not paying creators as far back as 2000? I know of at least 6 of us who can attest to not receiving monies back from 2004.

I talked to my sister this afternoon. According to her, you can file an appeal (she's checking on the statutes of time limits), but your prior actions will count against you and will be weighed with the new evidence you present. Personally, I'd love to know how contracted work is being explained away to the team of attorneys. My sister deals all the time with debtors refusing to pay their mortgage cuz the builders painted the walls the wrong color (no, really). And cases have been literally throw out of court because the plaintiff couldn't be bothered.

In the interest of client/attorney privilege, I don't know if a call would get you that information. Perhaps they can tell you if they HAVE a client named Rick Olney, but not the particulars of a case. I don't think stating that a person is your client, would be breaking any bond.

But I wouldn't waste the toll call. Next he'll be saying he's got the Chief Justice of the Supreme court lined up on his side.

But I honestly can't think of any attorney that's worth their sheepskin, to give such bad information, i.e., not attending a proceeding (or at least some form of representation by proxy, or a letter of continuance, to allow travel to get there... SOMETHING). Upon any sort of appeal (especially on multiple cases of nearly the exact same issue), to the decisions... it's going to look poorly that the ONE defendant, has lost so many judgments for similar claims.

And as has been pointed out. IF he does have a lawyer, I'm sure that it's only be HIS side of the story that's been told. "They're attacking me, mocking me, and I can't for the life of my understand why?". If both sides were given (truthfully), I'm sure any lawyer that wants to continue practicing, would just look him in the eye, and state for the record "Just pay them, and throw out your computer while you're at it. I don't think he understands that retaining even a small two or three man law firm and holding supposed regular legal meetings would have already cost him several tens of thousands of dollars. The billable hours would be big.

Lawyers only work on the hope of being paid when they do it for plaintiffs with winnable cases that promise a big payoff.

Nono, I meant 'plaintiff'. My sister's been to cases all across the country to defend the bank against the mortgagors who brought up lawsuits cuz the bank had the gall to request their due payment.

Judges do not take kindly to absenteeism or lack of representation. I cannot stress that enough.

So far, there's only 2 cases where he's a defendant. So far. If he attempts a preemptive strike, then he becomes the plaintiff (although how'd that work if he does file an appeal to a higher court, I have no clue). I dunno why he'd bother, though; he's starting up another 'publishing venture', he's praying for momentum on the Mighty Money Con, he's got 2 teams of lawyers (which, if he's intimating he has 2 law firms working on the same case, he cannot do legally; you can only have one law firm at a time). He's got 'money' to burn for all these other enterprises and he's admitted he owes many many people money. How's he gonna explain to a judge -- who will have access to every bit of information stated here and in the prior 2 cases -- why he hasn't paid?

Oh, and if he had a 'meeting' this afternoon, how does he explain his activities all day? I know Mohawk is small, but it still takes time to make all those wide turns in the Van of Justice. He either had very brief meetings ('You have a case, Mr Not-Your-Father Olney) or . . .

Exactly when is the judge in the case supposed to issue this order? Mr. Olney is the only one who failed to appear as required by the court. For him to now demand the judge issue an Order to Show Cause against the Plaintiff is assinine.

Mr. Olney, you had your day in court and chose not to appear. You may be able to get the judgment vacated, but it won't be easy with the Plaintiff providing the court with evidence that you willfully did not attend the hearing. And bragged about it in a public forum. Kind of hard to claim you did not know about it, forgot about it, were otherwise indisposed, something came up, car broke down, cat ate summons defenses.

The fraud claim also does not make sense. What fraud was perpetrated by or on the court? A hearing was held, you chose not to appear. The Plaintiff presented his evidence. No one was there to dispute it. The evidence satisfied the court.

Just for fun (again from law.com):

n. the intentional use of deceit, a trick or some dishonest means to deprive another of his/her/its money, property or a legal right.

So you now claim that the Plaintiff used fraud to get his judgment. Being a contract case, he would have had to have presented the contract, which you allegedly wrote. The he would have had to show evidence that he performed persuant to said contract. And you are now saying that any evidence that he presented was created for the sole purpose of deceiving the court to get it to enter judgment against you? Good luck on that one.

And your harrassment and libel claims take a hit everytime you come and post here. You have a duty to limit your exposure to such injuries. Purposefully coming here hurts your case. And you have over 400 posts just under this screenname and however many inder "orcafresh". And then there is the matter of the contents of your posts. Not that I want you to stop. This has been a lot of fun.

Plus, courts LOVE it when someone tries to use the legal system as a threat.
