Everytime I went to watch Firefly either Fox pre-empted it for a MLB game or it aired minutes after it should have. I did watch Serenity which was kinda cool.
You REALLY want to buy/borrow/rent the boxed set and waych it. I had pretty much the same experience as you and gave up. A friend *FORCED* me to take her set home (of videos, you perverts... keep it clean!) and watch it.

I noticed a clumsy attempt at a legal threat over the satirical song you composed, and just wanted to let you know that in the event you're pursued legally for that post, I've got an attorney who will represent you - and I'll cover all of the costs. Period.
(PS - And before anyone says that this is some sort of Waidian heroic gesture, it isn't. Mark offered to pay costs for people pursuing their own cases for money owed them. I just offered to pay for costs on a legal action that will NEVER, EVER happen. Just making sure Josh knows I've got his back.)

1.) Any small claims cases will be challenged and overturned based on the introduction of credible evidence which the court(s) in question will want to be made aware of.
2.) No, Jim Taylor's timeline is moot. He is more than welcome to pursue his legal claims. I think it is great men like Mark Waid and now, Mr. Coppervale, have stepped forward to assist in your legal fees. I actually may have a bit of news to my closer friends regarding who has intimated recently at assisting me in this very clear case of online bullying.
3.) I didn't show up last Wednesdat because I was instructed otherwise. The court that riled on that matter will be very happy to hear the other side of what was actually alleged to be owed ... versus ... what was actually factually owed. Small Claims Courts don't get much of a pat on the back often publicly, but they do have a recourse for misjudged cases. Fraud is fraud. Having a contract versus only saying one has one are two different things. Just ask Mr. Dixon. He understands the 'game' of it all.

Having 'evidence' to disprove someone else's claim is exactly what people go to court FOR: so each side can present their evidence to allow the court to rule accordingly.
Not showing up at all, which results in a default judgement for the other side, and then expecting that the case can be revisited later, is bad, bad, bad strategy. If time was needed to gather 'evidence' or doicumentation, the attorney involved will ask the court for a continuance. For an attorney to advise the client NOT to show up, as has been publicly posted here, makes the attorney look very, very stupid to a judge.

Side note: My brothr and his wife are heavily into westerns - they even do competitive western shooting (time-and-accuracy course with rifle, shotgun, and pistol) and rank near the top of their classes regionally. They don't *DO* SF. we mentioned the show at a family get-together and he popped up and said that a shooting-buddy of theirs had *FORCED* them to sit down and watch an episode of Firefly and, when it was over, their only response was, "Ya got any more?"

When only one party in a court action actually shows up at court, of COURSE only one side gets told.
And that's the side that wins a default judgement.
Regardless of any other evidence, NOT going to court for the reason that one was 'advised' not to will carry no weight with that court. None.

Side note: My brothr and his wife are heavily into westerns - they even do competitive western shooting (time-and-accuracy course with rifle, shotgun, and pistol) and rank near the top of their classes regionally. They don't *DO* SF. we mentioned the show at a family get-together and he popped up and said that a shooting-buddy of theirs had *FORCED* them to sit down and watch an episode of Firefly and, when it was over, their only response was, "Ya got any more?"
Fox has never been blessed with putting on shows at Friday at 9pm. I'm thinking any show that gets that slot knows its the DEATH NAIL.

Having 'evidence' to disprove someone else's claim is exactly what people go to court FOR: so each side can present their evidence to allow the court to rule accordingly.
Not showing up at all, which results in a default judgment for the other side, and then expecting that the case can be revisited later, is bad, bad, bad strategy. If time was needed to gather 'evidence' or documentation, the attorney involved will ask the court for a continuance. For an attorney to advise the client NOT to show up, as has been publicly posted here, makes the attorney look very, very stupid to a judge.

When only one party in a court action actually shows up at court, of COURSE only one side gets told.
And that's the side that wins a default judgement.
Regardless of any other evidence, NOT going to court for the reason that one was 'advised' not to will carry no weight with that court. None.
Not only that, but even in the event the evidence is a landslide in one direction, showing up actually makes it more likely that your sentence is reduced. At least you can confess in person. Even if there is no chance of winning ANY lawyer would advise showing up. The screwing tends to be less in person.
But I just had a thought, if Olney had a lawyer, wouldn't saying their name put them out of business? I know I wouldn't want that representation.

I thought the point was to ignore the child... See he wants to get all mad and leave in a huff (as we have seen several times here and elsewhere) and then he cannot stand the thought that people are talking about him, or even worse, NOT talking about him and he needs to come back.

When only one party in a court action actually shows up at court, of COURSE only one side gets told.
And that's the side that wins a default judgement.
Regardless of any other evidence, NOT going to court for the reason that one was 'advised' not to will carry no weight with that court. None.
I've been to court enough over the past 2 years against the ex to have gained some insight about 'not showing':
Judges, magistrates, even clerks don't take a very sympathetic view to not appearing when subpoenaed. It presents a waste of time, a waste of tax-payers' money, and diverts attention from far more important matters to the legal system.
Default judgments also carry with them certain restrictions, often handed down as penalties for not showing. Because my ex refused to attend 3 times in a row, the magistrate added an amendment that she cannot apply for an adjustment to the child support on the ruling for 5 years. There was also interest added on, compounded monthly from the date of last payment.
Appearing before a judge or magistrate is a privilege; you are given the opportunity to present your side of the case so a fair and equitable decision can be reached by weighing both sides of the evidence. Second chances are not easily come by, especially if you just don't feel like going. If you cannot attend a hearing, you are supposed to inform the courts and apply for a postponement, the validity of which will be decided upon by the judge or magistrate. 'Not showing' equals 'not caring' in the eyes of the law. Do it enough times, it also equals a complete disregard for the laws, the plaintiff, the judge.
So attending is out of the question? There's depositions, legal representation, I've even heard of live phoned-in testimony being allowed. If you are required to be in court, the legal system provides a great multitude of ways for you to be there, even if you can't do so physically. The most important action is for you to inform the courts; they take a rather dim view on lack of communication.
And an even dimmer one on lack of cooperation.
Attorneys are hired to advise you on the proper way to act. During the divorce, my lawyer suggested attire, attitude, even the tone of voice I should answer questions with. It was recommended I show up early and show respect; at one point I apologized to my ex's attorney for her actions. Judge still issued a bench warrant for her arrest.
Every time you are listed as a 'no show' is a mark against you. Files are kept on your record in an easily accessible internet database that can be called up in the middle of a courtroom, information that is not available to the layman. There's still knowledge about my ex (quite damning knowledge from what I understand) that I'm not privy to. But the judges called it up quite easily -- and rapidly -- for use in their decisions.
I've never heard of an attorney advising a client to not show some sort of representation at a pending hearing. That'd be like counting on winning a football game because the referee will call another one when your team won't board the bus.
Ain't easy to overturn a ruling if you weren't there the first time.

He let Rick back the same reason we ALL gave him as much slack as we did, because we felt sorry for him. People were still posting after Rick left. He tried to come back to the group and Jim asked if anyone had an issue with it, and we all said as long as he behaved himself we don't care.

Really Rick your case reminds me of a case that actually happened back in 2001/2002. The person who thought he could get a whole website tossed for mean comments and all...Mike Brown. Brown owned the Cincinnati Bengals of the NFL.
The website was a rip on Brown's horrible running of the Bengals as a NFL Franchise. After a decade long losing streak and various blunders on draft picks and Brown's unwillingness to spend for certain key free agents the fans had , had enough. So they created a website ripping Brown.
The name of the site was MikeBrownsucks.com . It had stories of how horrible the team was and how Brown's cheapness for players and coaches had ruined the once great franchise. Mike Brown was pissed....he was pissed that a website ripping him and the Benagls franchise was getting so much attention.
He went to the NFL to try and have them shut it down. It didn't work as they told him its no lie for someone to critic your running of a team and create something to slam you if its happening in real life. The one contention Brown had was the Bengal on the website looked like one on the official team site. That was proven false as the Bengal on MikeBrownsucks.com looked like it was crying in shame. Where the NFL one looked proud.
It was tossed and the guys kept their website running . Even the website owner had said if Brown and the team started winning again the site would likely die. (It hasn't and is still around by the way )

I think this needs to be clarified, since it seems we've become the new center of attention of Olney's continually mis-directed ire:
Olney's inactions -- that is, his unwillingness to pay for work contracted and completed and subsequently used -- are what have driven us to create the UNSCREWED! relief efforts. We exist because of him, not for him.
When an unscrupulous business is revealed, whether it be those of Olney or someone else with similar motives of 'screwing' creators for their efforts, those creators who have suffered financially will be able to apply to us for assistance. Those details will be worked out in the future; right now, we're concentrating on the circumstances before us.
Olney will not be relieved of his debts. We are not going to court against Olney. The content of the anthology, just as the items up for the auction, will not be centered around Olney or any of Olney's supposed 'endeavors'. We editors have, in fact, been forced to ask for a re-working of a story because the content was far too recognizable for our theme.
Consider us a creative version of the Red Cross or the Salvation Army; we hope to help those unjustly denied proper wages for their contracted and completed creative efforts, proper wages they may have depended on to exist because they were promised either verbally or in writing. The recent talk of 'libel' and 'legal actions' is the stuff of utter nonsense. It's akin to Hurricane Katrina coming in and suing the state of Louisiana for being in the way, or suing the Red Cross for bringing in blankets and food. It's nothing more than scare tactics, and the exact sort of bullying we're attempting to expose.
Olney's walk-by ramblings on Gail's YABS, various websites, certain Yahoo groups, even his rather pathetic attempt at 'parodying' our cause at the MMC site, seem to be done just to draw attention back to himself; he's trying to make himself out to be 'David' to our 'Goliath'. Sure, everyone roots for the underdog. But under normal circumstances. A 'David' who threatens with vague legal actions, tosses insults and then runs away, continually badgers supporters, and does so all in the name of 'clearing allegations' really won't do themselves a favor in public opinion.
If anything, Olney is strengthening our cause.
And our resolve.
We know what we're doing here, and we're making our actions well known everywhere. There's no hidden agenda, no matter what's being inferred.
We're not looking to declare a 'winner' or a 'loser'. That's for the courts to decide. Gail gave us a place to voice our complaints against one individual, and his heinous business decisions against us. We're presenting factual incidents as they happened to us. There's no need for us to present 'evidence' for any court, legal or public opinion.
It's a way to give a warning to those creators who love their craft so much that they, too, may be duped into working for unscrupulous publishers, just to see their work in print.
No creator deserves to be treated that way.

In answer to your questions, and please copy my answers for posterity...
1.) Any small claims cases will be challenged and overturned based on the introduction of credible evidence which the court(s) in question will want to be made aware of.
2.) No, Jim Taylor's timeline is moot. He is more than welcome to pursue his legal claims. I think it is great men like Mark Waid and now, Mr. Coppervale, have stepped forward to assist in your legal fees. I actually may have a bit of news to my closer friends regarding who has intimated recently at assisting me in this very clear case of online bullying.
3.) I didn't show up last Wednesdat because I was instructed otherwise. The court that riled on that matter will be very happy to hear the other side of what was actually alleged to be owed ... versus ... what was actually factually owed. Small Claims Courts don't get much of a pat on the back often publicly, but they do have a recourse for misjudged cases. Fraud is fraud. Having a contract versus only saying one has one are two different things. Just ask Mr. Dixon. He understands the 'game' of it all.

Those details will be worked out in the future; right now, we're concentrating on the circumstances before us.
Olney will not be relieved of his debts. We are not going to court against Olney. The content of the anthology, just as the items up for the auction, will not be centered around Olney or any of Olney's supposed 'endeavors'. We editors have, in fact, been forced to ask for a re-working of a story because the content was far too recognizable for our theme.
Consider us a creative version of the Red Cross or the Salvation Army; we hope to help those unjustly denied proper wages for their contracted and completed creative efforts, proper wages they may have depended on to exist because they were promised either verbally or in writing. The recent talk of 'libel' and 'legal actions' is the stuff of utter nonsense. It's akin to Hurricane Katrina coming in and suing the state of Louisiana for being in the way, or suing the Red Cross for bringing in blankets and food. It's nothing more than scare tactics, and the exact sort of bullying we're attempting to expose.

Sure, everyone roots for the underdog. But under normal circumstances. If anything, Olney is strengthening our cause.
And our resolve.
We know what we're doing here, and we're making our actions well known everywhere. There's no hidden agenda, no matter what's being inferred.
We're not looking to declare a 'winner' or a 'loser'. That's for the courts to decide. Gail gave us a place to voice our complaints against one individual, and his heinous business decisions against us. We're presenting factual incidents as they happened to us. There's no need for us to present 'evidence' for any court, legal or public opinion.

For everyone else... I was told that a statement will be sent to me that was drafted by Mr. Olney's lawyer and I need to read and sign before payment. I gave him my mailing address again and told him to send this release then asked for an ETA on it.
Problem is... he's made that offer/statement (that his lawyer will be in touch), to so many for months and months on end... it starts to sound less and less credible. No email, no snail mail... not even smoke signals. It's merely a delay tactic. Each day you wait for that letter to come, is another day he doesn't have to face the reality that he STILL owes you money. Do as you wish... but I think you've waited long enough.

Yeah, I'm not all that keen to encourage a lot of back and forth stuff, especially when it's pointless (arguing with his non-logic logic). I didn't post here for HIM - I did it for Josh. Because I think the kind of (I'll say it again) candyass passive aggressive stuff Rick's doing with these "I'll have YOU looked into" threats deserves a response.
We all know it will amount to NOTHING. But sometimes people might worry - which is exacly why Rick does it - and I wanted to ensure Josh wouldn't, in ANY circumstance.

A Mary Sue is a character in a work of fiction, which is nothing more than an idealized self-image of the author.
Basically, the Mary Sue would have all the traits the writer would like to have, and the fact is transparent to anyone who reads it.
Also, creating that character is usually the ONLY reason the piece exists.

Another thing. If I understand and recall correctly small claims/civil courts can only be appealed on matters of law, and not of proof. Sorry Jim I went off on Rick about my article in Comic Fan,he said what he said to goad me and I tookm it but I feel better.
Rick like I said is everything bad about Comics, Recently I paid the renewal fee for Jerry Bails' Who Who site and it was quite a bunch of money I didn't expect to pay and caught me by surprise. I paid it as I want to keep Jerry's dream alive. But I did e-mail his wife Jean for assist and the Timely Yahoo group came through in spades and even got an e-mail from Roy Thomas. After this Rick crap it was nice to see that Fandom still has a lot of great people and gave me hope (as this thread has) in people again.

I'm afraid that I my have bad news on the embroidery front.
I've found software that SHOULD be able to generate the correct format from the Unscrewed logo and downloaded the demo, but it doesn't seem to want to install on any of my Windows VMs that I have running on Virtual PC (I'm a Mac-Geek).
I have access to a couple of Windows boxes through friends and family - and, in fact, have an older one that a previous tenant abandoned up in the attic that I've never checked out, so I may drag that down and see if it's functional.
I've got a few tricks yet to try, and I'll keep poking, but it's beginning to look shaky.

Sorry Jim I went off on Rick about my article in Comic Fan,he said what he said to goad me and I tookm it but I feel better.
Rick like I said is everything bad about Comics, Recently I paid the renewal fee for Jerry Bails' Who Who site and it was quite a bunch of money I didn't expect to pay and caught me by surprise. I paid it as I want to keep Jerry's dream alive. But I did e-mail his wife Jean for assist and the Timely Yahoo group came through in spades and even got an e-mail from Roy Thomas. After this Rick crap it was nice to see that Fandom still has a lot of great people and gave me hope (as this thread has) in people again.
No problem...Rick saw fit to reply to past posts...why should you not have the chance?

The big thing is, his whole life he's dreamed of being a big wheel in comics. But he has no talent, no brains, no money, and no organizational skills. In short, all he's got is a huge mouth and the willingness to lie and cheat.
So, I wonder what it feels like to be utterly despised in the industry you've dreamt of actually being a part of for so long. Knowing that when people say your name, they're thinking of words like deadbeat, liar, cheat, and loser.
All his lies and fake achievements have been disproven and catalogued, and now he can't even take credit for THAT meager list. We know he was never a Star Wars figure, we know he had nothing to do with the 99 cent comics. We know he didn't come up with the Comics In The Classroom idea, and we know that working for him is the surest way of never being paid.
Former friends keep coming forward to say what a cheat and liar and screw-up he is.
All he's got is his fake threats which become more hilarious as the weeks go on, and the ability to brag about things in the future that will never, ever happen. Because he certainly can't brag about his repulsive past, now, can he?
This is his one way to pretend he isn't ruined in the industry. To come here and say that the future will be better, even though the whole industry has rejected him and his ilk completely, all by the simple act of revealing him by his own words.
I'd be depressed too. But I wouldn't be delusional, I would hope!

I think perhaps he really is that delusional. At least part of the time. He doesn't care if “talents” or “professionals who are far from it" think about him. It is obvious he sees them as either a means to a personal goal or as "crumb catching, spotlight hogging tokens” He seems to have a real love/hate relationship with his beloved "hobby" and the "talents" who make a living from it.
He seems to exhibit a pathological need to control his public image. The NDA's, the threats of lawsuits over the smallest of slights and his venal reactions seem to demonstrate that. His other professed concern are the "fans” He seems to think that all these faceless and nameless fans all think and feel the same way he does. What he seems to fail to recognize is that just as many "fans" as "talents" are fed up with him.
I think that deep down he has a vision of laying to waste his enemies and his dream empire of what comics should be towering over the ashes of the comics medium as it exists today.
Or maybe not as the case may be. ;)

Yeah, I'm not all that keen to encourage a lot of back and forth stuff, especially when it's pointless (arguing with his non-logic logic). I didn't post here for HIM - I did it for Josh. Because I think the kind of (I'll say it again) candyass passive aggressive stuff Rick's doing with these "I'll have YOU looked into" threats deserves a response.
We all know it will amount to NOTHING. But sometimes people might worry - which is exacly why Rick does it - and I wanted to ensure Josh wouldn't, in ANY circumstance.
Mind over matter with Rick as far as I'm concerned. He can make all the threats he wants...I don't mind because he doesn't matter. He reminds me of a blowhard I knew back in London Ontario. All talk and bluster, but when it came to anything that matters he was the first to tuck legs and run.
But should he press the issue, My uncle is a lawyer so worst case scenario, I give him a call. I'm sure what Rick has posted alone would constitute enough of a defense.
But it verifies what I've said about James Owen in my interview and what I said to him when I met him at the Phoenix Con...a classy, humble guy. Seriously, he's as good as they come. And I'm happy I've had the chance to meet him. That I have to say is the one good thing about this thread, the people I've had a chance to meet here.

Falling out of non-contractual promises is not against any civil law. The work in question was actually never a commission. It it were ... it would've been started, finished, and a notice of completion would've been recieved on this end.

If it were an actual commission, you would have put up a 50% deposit in advance. The only way to paint this is you tried to talk her intod doing work that you had no intention of paying for.

The money I'm raising by running the auction in no way resolves Rick Olney of paying his debts. Those are entirely his burden to carry. Those are his debts. A court of law will hold him accountable for his actions.
See, here's what Rick either fails to understand or simply doesn't care about, I'm guessing it's a combination of both.
Financial burdens don't disappear simply because the guy who promised to pay you something doesn't follow through. A lender doesn't suspend mortgage payments in hopes that a small claim matter will be settled in your favor and a judgment collected. The grocery store doesn't take IOUs based on money someone promised to pay you a year ago. Hospitals don't let you stay for free while you wait months and months for some unknown attorney to contact you.
Living in the real world costs money. The folks who were stiffed needed to be paid in order to make their lives work. Rick didn't just cheat them out of some money. He caused undue suffering to come into their lives.
The auction was started to ease that suffering. Humanity suggests that we care for those suffering. Decency calls us to action.
Rick doesn't understands these things because the only person he cares about is himself. The suffering of others does not matter to him. Otherwise none of us would be here right now. He'd leave them all to spin in the wind if it was possible rather than pay a dime to anyone.
The hope is eventually everyone owed is paid their due by whatever means. That being said, the auction is meant to provide for them now, when they need financial help.

Man, this whole debacle has just made me a little sad and disillusioned regarding the industry. Reflecting on it, I believe Olney's ORCA is a really interesting and different idea, if it was done properley and with some courtesy to the people that actually make the comics industry how it is, and I mean not just the creators and editors and such, but fans and everyone.
I mean, the idea is really sound in getting kids educated in a more entertaining way, lord knows I would've loved that through school. I think Rick might've just gone a bit mad with power. He's the head of the company, and when people don't do things your way one can feel a bit challenged. Unfortunately, from all the comments he's thrown at the people here regarding their personal lives and values, I also think that he is the wrong man to be heading such a company. Not paying for work done is one thing, and it can be settled elsewhere, but insulting and belittling the people you want to believe in your company and perhaps work for you in the future? Man that's dumb. That's dumb bordering on huge personality flaws that might require some counselling.
But yes. In conclusion, Rick had some good ideas initially. Unfortunately the only thing that was keeping ORCA and TightLip back was him. Run properley, they might've been a couple of really well respected companies.
