View Full Version : Rick Olney--Fibber or Mega-Giganta-Fibber?

The thing that gets me the most is what a tin ear he seems to have for the requirements and responsibilities of business. However unrealistic it may be, he still wants to produce comics, not to mention MiniCons. To run a business, you must be a good businessman. The reputation attached to yourself and your company is exceptionally important; you also need to stay on good terms with the those who will ultimately consume your product. Anyone who sees even part of yesterday’s meltdown will never take Tightlip or Olney seriously again. Would you want to have business dealings with a man who’s shown himself to be an misogynistic, racist, homophobic deadbeat? Even if he DID manage to somehow produce a comic, no one would stock it.Quoted for emphasis.

Tony Isabella is the original Nexus of all Comic Book Realities.
Really.
In a STACK of old Comics Journal interviews I've been rereading, you'd be AMAZED at how many creators credit Tony's influence in getting them their first gigs. And not benchwarmers, either. Guys like Byrne and Perez were naming him.
I know that a lot of retailers took chances on my books back in the day in large part because of a recommendation from Tony that was so keen I STILL use it on the back of new editions.
That's the same kind of support he's given to people on this board. And the same kind of support others have lost because they've taken unwarranted shots at him.
Power and influence isn't always flashy and in your face. Sometimes it's quiet and subtle, and all the more effective because of that.

I'm lawyered upThe expression "lawyered up" generally refers to a criminal suspect exercising his Fifth Amendment/Miranda right to silence to avoid self-incrimination. Not really a flattering choice of words to use in the court of public opinion. The courts treat it differently, of course, but to most people it sounds like an admission of wrong-doing. And the thing is... you haven't lawyered up.
Rick, I'm a non-combatant in this war, and popped my head in here only because a friend thought I'd find it an interesting legal case. But what I find most interesting about it is the posture you're taking here. Surely your legal advisers have cautioned you about discussing the case in public, and in particular with the very parties with whom you have a complaint. I'd strongly suggest you listen to their advice. (And on the off chance they haven't given you this advice, I'd even more strongly suggest you consult with someone who's more on-the-ball than that. I can try to recommend a qualified specialist in your area if you'd like.)

Since no one commented on my earlier "apology" for last nite's actions... I'll have to rethink... and assume I wasn't as out of line as I thought I was.
Hmmmmmmmm... ignore him next time around eh? A good idea,... but it's like a 30 car train wreck... you don't WANT to look, but you just can't help yourself!
Considering everything he said last night I don't see the need. Everyone gets angry and no one can blame you with this guy.

And, uh, while I do like her writing and all, and realize that even if she quit NOW, there's enough work in print that the quality and popularity will never be questioned, I mostly started reading Gail's stuff because:
1) she once made some nice remarks about an anecdote I related hereabouts somewhere, and I am easily charmed;
and 2) I think she's pretty. And I'm a soft touch for someone pretty AND sharp.
James
I'm betting that I can ripe your head off and shit down your neck and give you more satisfaction than when you're watchin' your brand of selective viewing.
No shame in being a person with no balls to serve your country, you lil girl. Be proud that you enjoy your freedom at the expense of others, you liberal piece of shit.

And I would suggest that no matter how insulting or even foul-mouthed we may get, we STILL have the moral highground over Rick. After all, WE didn't shaft anyone out of the pay they earned. WE are the ones who got shafted. Well, some of us. And when I get shafted, my sense of compassion is not large. Petty, maybe. But I'll save my compassion for the shafted. I didn't go anywhere near as far as some here last night. But I say "what the Hell". Maybe the shafted need some time to vent too.
You wanted to punch me real bad once upon a time. Drag that dog ass of yours across country to Pittsburgh. I want to see if you swing your hands as mighty as you shoot your fat mouth off.

Oh wow. I'll skip panels for this. Mr. Olney, please show up and do it!

Hey! Hey!
New guy has another question :D.
I went to his "Mighty Mini-Con" website, just to see what it looks like. What stuck me most was this:
Admission:
$$25.00 each day
$25.00 a DAY? For WHAT?
A pizza bagel and bite-size Snickers?
The Motor City Comic Con, which this year will have guests like Sergio Aragones, David Mack, Wm Messner Loebs, Stan Sakai, and more media people than you can shake a stick at...
...costs only $20.00 a day.
Yes. Motor City costs LESS per day than the "Mighty" Mini-Con.
How can this be? I mean, besides that it's put on by Rick Olney. I mean, seriously? Who does he plan to have there? The ghost of Jack Kirby?

Scientific Name: Ricardus Olneyae
Common Name: The North American Comic Book Weasel
Description: As with the penguin and dodo this creature is winged but flightless, much like its hopes and dreams. It can be identified by its head of thin, balding hair - the rest has migrated to its ears, back and nipples - a distended abdomen and unique body order that it uses as a self-defense mechanism, preventing its predators from getting near enough to harm it.
Diet: An omnivore, it largely subsits on cheetos, funyuns and other artificially produced snack foods. It is a scavanger, relying on its mate and others to bring it the resources it needs.
Habitat: It can most commonly be found in its den, where it sits upon an old, soiled chair, the apholstery of which has begun to graft itself to the creature's flesh. Occasionally it ventures out to gatherings, but because of its general disposition is not a social creature.
Mating Habits: Though it has offspring and a mate, the creature prefers the hindquarters of successful men, upon which it obsesses and frequently talks about inbetween a mating dance that involves it encouraging said men to notice its own bulbous backside. As it has never successfully coupled in this way, it is unknown what the resultant offspring would be.

That ebay (http://myworld.ebay.com/orcafresh/)profile is hysterical. He doesn't pay anybody! And then I read about him being angry that people "insinuate" he doesn't pay.
And the replies:
Payment WAS mailed as agreed. I will attempt to correct this matter.
Payment was INDEED mailed out as agreed. I will attempt AGAIN to correct this.
How many times has Gail claimed he's said that and how many times has he called her liar. It's like his mantra:
"Payment is on its way"
It is apparently his version of "the check is in the mail"
Typo Lad

To any and all concerned-
I'd be careful about physically approaching Olney in a public setting, even if you were to be absolutely appropriate and cordial. He strikes me as the kind of person who will bluster but cower from confrontation up until he feels he has nothing to lose.
At that point he might well turn out to be the angry kind of person who will choose to go out in a blaze of "glory." The most likely targets of his destructive rage would probably be his wife, someone he'd formerly felt close to, and/or someone who he'd target as the cause of all his problems. Judging from his postings I'd guess that Sam was most at risk, but an unstable mind could well leap to odd conclusions and target someone who might seem like an unexpected choice to a sane mind, and he does seem to have a strong misogynistic component to his personality.
This is all conjecture, and I don't think that he's yet reached this particular point of self-immolation, but I've been aware of this particular unpleasant individual for years and I don't think that his instability is either a posting ploy or an act. Don't change your behaviour, or avoiding going to any event that you want to go to, but if you're actually around him be aware of his alleged love of firearms and the possibility that you might need to think on your toes.
I don't want to alarm anyone, and I'll be delighted if I'm wrong (and percentages say that the scenario I describe is less a possibility than that he'll just slink away), but I'd just like folks to be aware that dealing with unstable and violent personalities does carry some small percentage of risk.

And might I add the Motor City Con is held twice a year up in Novi MI. It's a really cool little convention.
I went to the tail end of one when I was asked to speak at a library in MI for Teen Read Week.

Ivan, although since I'm in California I'm fairly certain I'm an unlikely target, I've been considering these very points. I'd profiled him as sociopathic, and up to this point so far as I know not actually phyiscally abusive. But as the real life stresses increase, brought on in consequence of his own actions, I think there is a possibility that he might become less restrained and contemplate more direct action. There is a (small) benefit in that he is stuck in Upstate New York, and the targets he'd most like want to get at are in Oregon, California, & Florida. But he is getting less stable.

Yes ma'am.
I am not sure if I was the first sucker, but long before he had you on as PR manager, he asked me to do it. He even offered an hourly pay for it. Hence why I'm rounding off my damages as I am. Instead of the $450 for columns I am adding an additional $50 for the work and the UPFRONT COST TO MYSELF for listing his stupid items.
I'm sure I did more than that but I would feel bad claiming more than $500 considering what he put others (like DocA through)
I must ask Ronnee, did you EVER see any of the items he wanted listed? He just posted pictures on the MMC board for me to use. (not even good pictures, pics he ripped off the internet)
And it never went high enough for him so he never went through with any of the winning bidders (even though I think I did make $250 off his Namors) But because he's going off an Overstreet from 1993, he thinks they're all worth a gazillion dollars each because they're old.
Meh.
Also where's my love? :( I'm just as cute as blake! :pYes you ARE! I actually have a bit of a crush myself ;)
I told him I would not post anything until he sent me some start up monies for the listings, which of course, and say it with me folks... was in the mail! And no, I never saw these wonderful items he was so sure would make money, though I asked for at least pics.

You've got to understand, Danny, Ronee and I have an arrangement of mutual ego-stroking going back several years. :D
Hell, the woman got my second novel published and directed my first play (first one I wrote, not the first one I performed in). Then she let me be her assistant director later so that I could direct my first show (as a director), which she also performed in. And somewhere in there, she's found the time to shop around various comic books, plays and novels of my making.
I owe the woman tons of love. I'm just flattered that she reciprocates.AND.. I just got the publishing agreement for the play in the mail! As soon as I look it all over I'll get to ya darlin'.

HOLLOW!
That is the Book you have created/are creating, correct (Larime's Avatar. I remembered that picture from somewhere)??
Yeah, my avatar is Stan from Hollow. :)
I read that post of yours and Larime and then something *clicked*.
I thought I had read an interview on Newsarama, but as I searched, I found nothing, which had me stumped. I *do* remember tho to have seen a 4 pages preview of the book somewhere, but I cant find it anymore >_<.
Newsarama did a bit on all the new books ASP is putting out. I cannot reccommend them highly enough to ANYONE looking for something more than capes and tights.
I just want to say that I loved what I have seen of it so far and look forward to getting the issues as soon as my local Comicshop has em.
I am also a great Fan of the "Artesia" books as well as of "The Killer", so this is awesome. :D
Artesia's one of my favorite titles on any label.
I have to say I am terribly impressed with how you manage to still uphold a positive attitude and all. :)
I wish I would find that damn interview again! I am sure it was one! >.<
Thanks! We do our best! :o

Last night I brought up Jim Hellwig writing a comic book. He basically wrote it under his character named WARRIOR. And for those who never saw WARRIOR ..here he is in all his glory.
You Now Enter the World of the Warrior !
http://www.youtube.com/watch?v=P39b7v1wzfg
Hellwig produced a comic in the 1990's that was so bizzare , so weird that no one still to this day can figure it out. In one issue he tortured Santa Claus. But thats as much sense as you could get from a Warrior comic.
Happy watching and remember...the video should tell you all ya need to know about the Warrior.
I thought he drew as well which from what I saw wasn't great. Ah the days of the Bladerunners!

I'm about 20 pages away from the end of this thread - took the night off to watch some TV with my wife and sleep - so someone probably responded to this already. But, just in case, here's what I posted:
A message to all my friends and readers...
If you are approached by an individual named Rick Olney or a representive
of this man, if you are approached by Olney or anyone else representing
entities known as The Mighty Mini-Con, TightLip Entertainment, or ORCA, I
strongly urge you to run in the other direction. You can find more details
here:
http://www.unscrewedcomic.com/
Please, if you trust me, do not attempt to do business with Olney. In
fact, please pass along this warning to any comics professionals, aspiring
comics professionals, retailers, exhibitors, media guests, and fans you know.
Olney is not someone you want to do business with.
I'd hoped not to involve myself in this in such a public manner, but, with
Olney again advertising a convention and claiming that he is still planning
to publish comic books, the greater good demands I speak out.
Check out the website.
Tony Isabella
Anyone who wishes to repost this warning has my permission to do so. My goal, as always, is to prevent the unaware from doing business with Olney.
P.S. I probably won't be able to keep up with this thread today as I have to do some of that writing stuff that I get paid for. I'll check in now and again to read a few pages, but that's all I can manage today. But, if something demands my attention - and that would exclude anything Olney says - just e-mail me and I'll get on it.
Thanks Tony gonna post on the front page of the IF site. Take that Rick!

Only because others seem confused, I am indeed contributing to both the book and the auction (auction contribution being the original art from the 2 page anthology story)
Why?
From Olney’s Myspace blog 1/27/07:
<<Is a lie when you take facts and either stretch them or change the base of the story? What "Gail" is attempting to rumor herself are my private emails within the last 48 hours to first, Tim Eldred and second, to Val Staples. Mr. Eldred is wanting to be paid and hasn't compromised himself regarding his NDA understanding with my company, TightLip Entertainment. In order to pay Mr. Eldred, I have to attempt to re-open communication with Mr. Staples, who, after getting my email, responded with this reply:
With all due respect, the only dialogue that needs to take place is knowing when I will receive payment in full.
Now that was perfectly understandable. Mr. Staples wants to be paid. Likewise, there are certain expectations that I have. So I replied with this email:
"Likewise with all due respect, we can discuss the date and details on your payment after you've removed your posts on that message thread on CBR, and any likewise such expressives, and post an apology. Otherwise, I still intend on making as much of a legal matter where you're concerned as necessary. See... you can get paid, and I can obviously clear the matter of anyone awaiting payment still on the Tales of The Spooky #1 book... but I can't retract your words or clear up what you said. You've demeaned and libeled me. And Val, I am told by my attorney that that has taken place.
Ball to move forward is in your court, sir.">>
Let’s recap: Olney admits screwing Val Staples for Val’s money, AND he’s screwing Val for Tim Eldred’s money, too! This after noting Tim satisfied all obligations. Olney claims the money is right there ready to go, “See... you can get paid, and I can obviously clear the matter of anyone awaiting payment still on the Tales of The Spooky #1 book...” he just won’t pay.
Anyway, that's why I'm in.

James
Aw, shucks.
Thanks, James.

As far as I'm aware Jeff, no one's broken his precious NDA, other then by saying "he didn't pay me". So unless that particular paragraph is in the NDA (and I must have missed it)... "Thou shall not tell the truth about my cheapness"... or some such... then nope... no NDA violation. If it's something OTHER then that, he won't answer the question of "how exactly did I (in regard's to anyone that's done work for him) break the NDA?". A simple enough question that he won't answer. Much like any straightforward question. Of course, him NOT paying is breaking the contract wide open, but he won't admit that. I do know he's made a few offers to pay off some folks, but ONLY if they sign a release. In essence "I'm going to hold your pay that you're duly owed hostage, until you sign this!" Exactly Dave. And when I've put it to him directly "HOW did I break it". All I get in return is "You'll see." It would be different if he said "because you did this and this and this" and there were a chance to debate out the assertions... but instead it's just "well you did".. and that's it! No specifics, nothing.
Reminds me of a child having the classic "Oh YEAH!" fight.
Perhaps we weren't supposed to discuss TLE properties, etc etc, to each other? I do remember he tried valiantly to isolate each creator from each other if at all possible. Not only did he not want the right hand to know what the left hand was doing, he didn't even want the fingers on ONE hand know the lowdown on any of the other digits! I'm just supposing here. But if that's the case... he's deluded. If we all signed the same NDA, I'm guessing we ALL could speak to each other.
It's mind numbing really.

Okay. I've got a question about NDAs that maybe one of you awesome folks can answer for me, please.
Like, is that for real? Because maybe it's just me, but isn't there supposed to be only 3 or 4 main stories in the world? Man vs. Man, Man vs. Nature, Man vs. Himself... something like that?
Nothing new under the sun? Somewhere along those lines?
So... does this happen often? Because, maybe it's just me, but it seems like from following "A&E Biography : The Rick Olney Story," he's acting like his precious comic properties (which, from what I've read about them, are preposterious. I wonder how many comic ideas he has where at the end, it all turned out to be a dream? Man! Writing stories in third grade RULED!) are the cure for AIDS or something.
Or at the very least, a cure for herpes. But, for real. Is this a common deal? Are there... unbalanced folks who actually do things like this?
And man, I have spent too much time looking at that face in that horse's ass on my compute screen. "Tales of the Spooky" (or whatever it was called) indeed!

Matt, seriously, I think he was drinking all day. I think he drank some and got just far enough along that it lowered his restraint and he decided to post here. And then once here, he just continued. Given how long he went on, it's kind of impressive in an appalling way. Because he had a certain degree of control - to his typing, mostly. The content, the lack of caring, the flat out insulting with no subtlety - those can all be tracked as the effects of drinking. But it wasn't untill he was getting to the end that it really started showing, with the truly bad typos. He types slurring when drunk!
He's not that good a writer or actor, Matt. That was drunk-for-real.
I'm not so sure.
A few years ago, he had a similar meltdown on Comicon, where you could actually see him breaking down in his posts. Last night was just like that. He starts out sidestepping, then goes to the mild blustering and lawsuit threats, then when he starts getting really worked up, the typos, insults, and physical threats start flying.
I think the "drinking" was just another false excuse.

Just for giggles, I decided to check into those precious NDAs. Found this (http://inventors.about.com/od/nondisclosure/a/Nondisclosure.htm):
'Nondisclosure agreements sometimes called NDAs or confidentiality agreements are contracts intended to protect information considered to be proprietary or confidential. Parties involved in executing an NDA promise not to divulge secret or protected information disclosed during employment or other business transactions. For example, an NDA is appropriate for prohibiting others from disclosing a new design, an idea for a new Web site, or confidential material contained in a copyrighted software program. Should one of the parties to an NDA use protected information without authorization, a court can stop the violator from making any further disclosures and may award monetary damages.
Nondisclosure agreements can protect any type of trade secret or any information not generally known, providing a competitive advantage.
However, the use of NDAs is not an end in itself. The purpose of these agreements is to create a confidential relationship between one person who has a trade secret and another to whom the secret is disclosed.
Parties can also establish a confidential relationship informally, either through an oral agreement or through the conduct of the parties. Few people rely on such informal arrangements, however. A one-way agreement is used when only one party is making a disclosure—for example, when a secret is explained to a contractor or investor.
A company may require an employee to sign a nondisclosure agreement or modify an agreement furnished by the employee. Generally, it does not matter who furnishes the nondisclosure agreement, so long as it contains the basic elements limiting disclosure.
Five Important Elements in a Nondisclosure Agreement
There are five important elements in a nondisclosure agreement:
* definition of confidential information
* exclusions from confidential information
* obligations of receiving party
* time periods
* miscellaneous provisions'
Now, look over the TLE NDA; tell me if you see all 5 of the above defined. Tell me if you see any of the 5 defined. Cuz I sure as hell don't.

Oh, and Jim, if you don't feel like going through eleventy billion pages of stuff here's a hitlist of what you missed.
All dudes that don't side with Rick are gay.
All mexicans and anyone with a bit of pigment on their skin are drains on society and should learn to swim because they're going to be bounced out of the country...
(gee, I wonder what Steve would think of that?)
Bev and Sarah are part of a cabal of evil women that want to see patriotic men imprisoned for the good of their communist matriarchy (ok now I'm making things up)
hmmmm..
And Rick is challenging Matt and Mac to a street fight. I would think it's for seperate dates and not a handicap match. (well 2 on one... someone else can make a handicap joke)
And there's a lot of other malarky.
Steve is PAGES behind, and sometimes doubts that he'll ever catch up again, but I've been getting some stuff done the past couple of days. Running around, doing errands, paying bills, and trying to move into another venture with my company. You know- real world stuff that will affect the future of my publishing.
Real publishing. Something YOR wouldn't understand.
Anyway, having a lot of melanin in my skin (that's called "pigment", YOR), and since we "coloreds" are characterized as being rather aggressive, there are tons of things that I could say that would be appropriate. I'm not going to go that route.
I started typing this paragraph a couple of different times. Basically, it's like this:
He's not worth it. Not to me. It comes down to the fact that he's not important. I have a host of other things to spend my energy on. YOR isn't worth it.
YOR is done. We know it, and more importantly, HE knows it. It's just amusing to me watching his self-inflicted self-destruction.
I watched a great movie a couple of weeks ago, called The Secret. It helped to reinforce something for me that I've been trying to avoid. Basically, he's been asking for this for a LONG time, and the universe has finally obliged him.
So, yeah, I'm watching. It's amusing. And I spread the word where I can about it.
Yep.

I'll add this comment. You may have seen me say, earlier, "In vino, veritas." It's an old saying that means, basically, you discover what someone is REALLY like when they're drunk. It's beyond laughable to me that people use "Oh I was drunk, I didn't mean that!" as an excuse---ever. To me, that is when someone is the MOST honest, and others get to see them in their unvarnished, ugly truth.
Getting someone drunk is a basic interrogation technique. That's the sort of thing that, you know, a Marine would know.
Interestingly, this puts RO in a double bind: If truly drunk, we saw what he's really like inside. If not truly drunk, we saw what he thinks might be a forgivable behavior given the "I was drunk" excuse. It's funny stuff.
Just a couple of thoughts.

GCom,
My money is that he will not be there. Yet, you can meet Glenn Barbis, a really nice fellow though. Bill Lange will probably be there too.
Best,
Samuel
Yes, I will be there, as always. Along with the Barbis girls! It's a family vacation of sorts for us.
Man, the deja-vu from all this is scary. Meltdowns. Threats. Challenges. Where's Buckminster Futter when you need him?!? :D If memory serves, he was the lone attendee of Rick's only Pitt-Con panel, and was also similarly challenged for a Pitt-Con brawl once. Hopefully Buck will make the trip, since I had the misfortune of not seeing him last time he made the trek.
And don't get me started on Billy...!!! LOL!!!!! :D

The Witness protects a mid-sized, middle-aged, Mid-American city in the country's breadbasket. In the Midwest, the crime is just as real, and the villians just as ruthless, but unlike New York or Los Angeles, the chances of gun fights in corn fields and is much higher. The Witness watches over his city, witnessing everything and ready to strike to protect his people. The villains are powerful mobsters, made more reckless and greedy by their relative distance from high-powered law-enforcement. Hmmm... Actually, while the NDA is poorly-worded and doesn't seem to fit the five criteria listed, I will note that the first paragraph would indicate that you're not even allowed to talk about HAVING a business deal with him. Maybe that's what he means by having broken the NDA?
Of course, it's then legally challengable as being unlawful since by suing Rick for payment he withheld, it would be revealing that an agreement with Tightlip had been done in the first place.

Only ONE who was on this thread last night owes an apology, for his words and a whole lot more. That won't happen.
There's a time to be polite, and there's a time to just say what you feel. Last night was the latter. Today everybody's over the rush and life goes on.
I owe an apology. Not to Rick, but to all the other fine folks here who were subjected to my vitriol and invective. I was unbearably rude.
Beyond that, I was not a particularly good example of what a Christian ought to be. If my kids were to pop in here and read what I posted, they would be quite ashamed of me. So again I apologize to all and sundry.
Now, since I post under my real name so that I have to take responsibility for my words, I won't go back and delete or edit them. Unlike some though, you've chosen (as have I0 not to delete or edit your statements (except for a particular word or two). I think it speaks well of anyone who can admit when they acted impulsively. Steve, you're a better llama.. uh, man than I am.
When he went on his native american tangents, I got angry. Being a proud descendent of the Cherokee tribe, I was incensed that a person could be so warped to the world that they would honestly try to marginalize some of the worst instances of humanity, the subjectation of any native peoples.
I am honored to see you take the high road, and meant not offense mentioning you in that post, I just thought how absolutely asinine of him to not only wrongly accuse Guapo of being an illegal immigrant (unless he's really a citizen of China living illegally in Mexico, that's not possible) and make such a negative blanket statement on anyone who has a heritage different than himself.
Jim (Ritchey) and I have had this discussion time and time again, be it an ijit like Rick (oh dear Sarah's a bad influence) or a person who's either the smartest man alive (to create controversy to keep from becoming irrelevent to newer generations) or just a plain old well... bigot such as some that could be named....
It gets my dander up to see supposedly intelligent (at least this is what they want us to believe) people acting so idiotic.
Anyway, kudos to you for being an awesome person. I hope you get caught up in the thread, some interesting things said in that mess.
I'm sure it'll be up on unscrewed soon enough.

Holy CRAP Dave, I think I figured it out finally! After much soul searching, and fact finding. I realize what it was that broke the NDA for me. I told my wife I was going to be doing work for Rick, and she was NOT in the loop! Curses!!!! There goes my defense! I never had her sign the Spousal NDA! Damn, now she's gone and cost me money again.
Still, like I said before, it actually looks like just by saying you were in business with Rick Olney, you were breaking the NDA, which someone should probably bring up as a non-valid contract since it doesn't allow a plaintiff to ever file any charges against Rick.
I'm not even a lawyer and yet I get this stuff. ^^;

Actually Dave, the parking garage has been razed to make room for the TLE Theme Park. (and since, as evidenced by his not caring about ripping off other creator's characters)... (sorry Walt)... First up, it's "Extreme FantasyLand" where you're led to believe you're actually going to get paid for work produced. Next on the drawing board is "Tomorrow... or Eventual Land"... where you get to rummage through a slew of scattered paperwork, while automaton "actors" of incompetent accountants, mailmen, and invisible lawyers laugh at you endlessly. All the while, on hidden speakers that have been salvaged from the local landfill, you hear a loop tape of "it's on it's way, it should have gotten there, I'll have to look into it". I hear there's more of the park to be developed... but I'm not at liberty to divulge that at this time.

Or:
The first rule of a TightLip NDA is you don't talk about TightLip.
I'm gonna say that the court will find his interpretation a bit broad.
Definition of Confidential Information: Each party agrees that all information and materials disclosed by TightLip Entertainment and Rick Olney and Recipient regarding a proposed business deal between the parties, including the terms and conditions of this Agreement and the existence of the discussion between the parties, will be considered and referred to collectively in this Agreement as "Confidential Information".
I read this as information and material disclosed between the two parties. (Well technically 3 parties because of the way this was written). Anything TightLip told the "Recipient" is confidential. Anything TightLip told Rick Olney is confidential. Anything "Recipient" told Rick Olney or TightLip is confidential. This is reasonable as it protects TightLip from someone disclosing anything that is proprietary, such as ideas, client lists, whatever TightLip has that is unique.
However, the fact that TightLip or Rick Olney did not pay "Recipient" is not confidential, since it is not information or materials disclosed from one party to another.
Also, the term "proposed" is troublesome. It indicates that the deal has not been agreed to or finalized and this is only covering intial discussions prior to coming to an actual agreement.
I also recall a post of his stating that only lawyers can understand the language in the contract. But I also recall him stating that he drafted the contract. Poor draftsmanship, I'd say. And sadly for him, a contract should not have to be interpreted. It should be clear on its face. And any ambiguities will be held against the drafter. There is no room for "But I meant".
I would love to see a copy of his contract to see how convoluted it is that all of his attorneys have not been able to determine what it means.
Oh well, it's late. Time for bed.

That would probably depend on whether or not they keep in touch in any fashion. If not, Augustyn may be blissfully unaware of anything that is Olney. (Though from what Gail said, that's become less and less the case, his name and rep are getting around).

During a phone conversation with Olney early last year, I happened to mention something about a book I remembered reading when I first worked at a bookstore in '93, something to the effect of 'Legal Forms for Visual Artists'. Couldn't remember much beyond the title and some of the basic contracts contained.
Yup, blame me for sparking the legal fires in Olney's . . . 'mind'. Seriously, it was my fault. He went on a hunting spree to track that bloody thing down. Looks like he got hold of it (http://www.allworth.com/Business_and_Legal_Forms_for_Illustrators_p/1-58115-364-3.htm).
The author is Tad Crawford, and he's done an absolute ton of such reference books for just about every aspect of the arts.
Here's a description of 'Business and Legal Forms for Illustrators':
'The 3d edition of this popular guide contains 25 of the most essential business and legal forms to meet the everyday needs of today’s successful illustrators. Each form is accompanied by step-by-step instructions, advice on standard contractual provisions, and unique negotiation checklists to guide in making the best deal.
New forms for trademark application, commercial lease, sublease, and lease assignment agreements have been added to forms that include: estimate; confirmation of assignment; invoice; illustrator-agent contract; illustrator-gallery contract; contract for sale of artwork; merchandising agreement; nondisclosure agreement; release forms; permission to use copyrighted work; transfer of copyright; copyright application; and much more.'
Since I never did any work for TLE, I only know about the NDA and subsequent contracts. Anyone else sign anything other than those 2?

I'll add this comment. You may have seen me say, earlier, "In vino, veritas." It's an old saying that means, basically, you discover what someone is REALLY like when they're drunk. It's beyond laughable to me that people use "Oh I was drunk, I didn't mean that!" as an excuse---ever. With apologies to Monty Python and Eric Idle (http://www.youtube.com/watch?v=clPYfaTvHT0): The Rick Olneybitch song.
Enter Rick Olney, stage left. Spotlight on him.
I always wanted to be Rick Olneybitch.
Piano sounds
Leaping from post to post, as they appear down the mighty forums of C.B.R.
The demands of answers! My mighty racism!
With my best rum by my side!
I'm a giant deadwood.
I like to lose!
Come to Pittsburgh!
We'd sing:
I'm Rick Olneybitch and I’m not okay
I lie all night, I cheat all day.
Olney’s Orphans : He's Rick Olneybitch and he’s not okay.
He lies all night, he cheats all day.
I write down crap. I spew much piss
I make up phony cons.
On the internet I go trolling
I inspired Ric Ollie.
Olney’s Orphans: He writes down crap. He spews much piss
He makes up phony cons.
On the internet he goes trolling
And he inspired Ric Ollie.
Chorus : I'm (He's) Rick Olneybitch, and I'm (he's) not okay.
I (He) lie(s) all night and I (he) cheat(s) all day.
I swindle folks. I skip my bills.
I like curse your mothers.
I put on airs of grandeur
I may start smoking crack.
Olney’s Orphans : He swindles folks. He skips his bills.
He likes to curse your mothers.
He puts on airs of grandeur
He may star smoking crack.
Chorus : I'm (He's) Rick Olneybitch, and I'm (he's) not okay.
I (He) lie(s) all night and I (he) cheat(s) all day.
I write up posts. I tear them down,
wishing they’d go away.
I wish I had some talent,
But no, I’m just a hack.
Olney's Orphans : He writes up posts, he tears them down
Wishing they’d go away??
Chorus : I'm (He's) Rick Olneybitch, and I'm (he's) not okay.
I (He) lie(s) all night and I (he) cheat(s) all day.
I'm (He's) Rick Olneybitch, and I'm (he's) not okay.

Hey, 'Peanut', when are you going to pay the people mentioned in the above comment?
Point of order. Olney doesn't owe me anything. He might owe the charity I told him to give my mileage money to, but he doesn't owe me anything.
I'm involved because the history of comic books is the history of freelancers and other folks being cheated by publishers. Few will take on the big outfits, but, in Olney, we have a problem well within our means and will to solve. The ultimate aim of my efforts is to make sure that he doesn't hurt anyone else in comicdom.
Further information. Daniel Best is a friend of mine. I contributed the foreword to his book on Andru and Esposito, have helped him on other books, and fully expect to work with him in the future. Daniel is a person with some legitimate beefs with his publisher.
Olney isn't a victim. He's a victimizer.

Now, look over the TLE NDA; tell me if you see all 5 of the above defined. Tell me if you see any of the 5 defined. Cuz I sure as hell don't.
I'm seeing nuffin. I did see this bit though:
Confidential Information does not include information that is now or subsequently becomes generally available to the public through no fault or breach on the part of either party
Is it just me or is the contract saying that once someone revealed that Rick wasn't paying creators, wouldn't that mean it was no longer confidential and everyone who'd signed an NDA could now freely blab? Not only is his NDA not really legal, its own wording could interfer with his "you broke the NDA!" tactic.
I watched a great movie a couple of weeks ago, called The Secret. It helped to reinforce something for me that I've been trying to avoid. Basically, he's been asking for this for a LONG time, and the universe has finally obliged him.
I watched Hot Fuzz and learnt anyone who thinks they're above the law will be kicked in the face by Simon Pegg. Especially if they're an old woman.

Over the years, I've discovered more than a few people whom I suspected were arseholes were revealed to be complete arseholes after they got a few drinks in them.
And that is why I never drink.
That and because I might sober up to find, with my inhibitions gone, I viciously eviserated every single student who was loud & obnoxious outside & inside my hall of resident after 1AM.

I have printed the page as it appears on the web and will scan.
It's easier to copy the content of your screen with the obscure "print" key on the top of your keyboard and then do a "ctr-v" in any image software (paint, corel, photoshop etc.).

I don't think it would even be a matter of waiting until someone blabbed "first" or whenever. The practice of not paying is NOT what I'd consider a "standard business practice" nor is it some sort of "corporate secret" that is covered under the NDA or subsequent contract. That goes for TLE or any business. I don't care who you're working for, or what contract you've signed. If that business does not pay you for work tendered, you (the unpaid) have the right to go out and shout it from the mountains if you so choose, that fact. As long as that's your only statement, and NOT about the inner workings of the company, it's properties, it's customer list, or whatever, I would think you're safe. But I'm no lawyer. Then again, neither is Rick. (But he like's to play one in his deluded mind.)

Thank you very much for the kind words! We really dig ASP, and were so honored they decided to take us on.
Here is the newsarama (http://forum.newsarama.com/showthread.php?t=102224)thing, and there is also an all the rage column thing here (http://www.silverbulletcomicbooks.com/rage/index1.htm) in which they discussed stuff with Larime. XD
This is so cool, thank you for making my day. XD
*Laughs softly*
Had a total Geek out moment as I recognized who you two are ^^.
But that is because I am really looking forward to read the book.
And YES! It was "All the Rage" article which brought that comic to my attention :) That was the link I searched for.
Thank you!
Yeah, my avatar is Stan from Hollow. :)
The design is very cool. I guess that is why it did stay with me. There was something about him in those preview pics, suave and yet cruel beyond words. Very strange, and therefore very well done.
Newsarama did a bit on all the new books ASP is putting out. I cannot reccommend them highly enough to ANYONE looking for something more than capes and tights.
Agreed on that.
I've come to enjoy the Books published by ASP very much. And already look forward to read the new line up. So far Books published by ASP are very mature, nearly Vertigo'esque, which is <3 ^^.
Artesia's one of my favorite titles on any label.
MAJOR Fan of that book here ^^.
I even got the Roleplaying supplement, lol.
Thanks! We do our best! :o
And its breath taking ^^.
Seriously, I read that article on All the Rage and was terribly impressed.
Not only that you manage to get a very interesting book to be published, but also because of how you manage to have such a positive outlook despite what harsh cards life dealt to you.
So, totally congratulations to landing the Book at ASP and Good Luck with it! :)
I'll make sure to plug the book on the other Forums I visit, because I am sure its worth it!

Geesh, and it's not just the years that are screwy, but look at those amounts! Does he honestly think anyone (at least anyone who's familiar with his checkered monetary past) is going to hand over those amounts? Those appear to be ad rates for a rather successful magazine or publication of some sort. Hardly what I think anyone would pay for a one time, one shot program for a convention (that will probably be canceled for a myriad of reasons). I've never put an ad into something like this, so I could be totally wrong... thoughts from anyone who HAS gone this route before with reputable con organizers?
(Or perhaps this is how he's planning on paying for his legal team? Real life breathing lawyers tend to want to be paid... often upfront, at least a retainer)

On topic, I think someone politely contacting those listed as guests with a brief "I saw your name listed on such-and-such a site as a guest at an upcming convention. Is this information accurate?", would not be out of line. No mention of Olney, Unscrewed, etc... just a simple verification e-mail.
Who has free time?
Paul D. Storrie
02-28-2007, 06:23 AM
(edited to correct date typo from 2/27/07 to the correct 1/27/07)
The confusion was entirely mine. Sorry about that. I'd been in New York for the convention and lost track of who was participating in which ventures. Given some of Olney's previous typing and cognitive difficulties, I mistakenly though he was referring to me as I had been (last I checked) the only "Paul" involved in any of this stuff.
Glad to hear that, for once, Olney was right and you are indeed a part of this effort. Love your work and look forward to seeing what you come up with for the anthology!
Best,
PDS

First, allow me to apologize to the majority of the community here (but never to YOR) for my jumping into the hog waller with dimwit last night. I should have tried to keep my comments totally above board (and feel I did a fairly decent job). But the guy could piss off the Pope with his rantings. Drunk or not.
Secondly, I was thinking, it would be interesting if someone were to print out his various diatribes, and bind and sell them. Sadly, this would do two things... it would be a tough sell, trying to quantify that it is NON fiction.. (these are real comments)... and it would mean that pin head FINALLY has something in print... just not through his own doing. (at least not directly).
Next time he drops in (and let's face it, he can't help himself, it's like a moth flying straight into a flamethrower), I'll try to keep my cool, and not allow the lunatic rambling's get to me. (not that they really did, but I should have responded much better then I did).

I am going to let the person who did the action post details later today, but here is what I can say about it now.
I went to court today to watch Rick lose. And he did.
Of course, Rick did not show. I guess being served with a subpoena means nothing to Rick Olney's "legal team". Or maybe Rick was out of formal wear. I just don't know.
Anyhow, when you skip court cases, bad things happen to you.
Rick, you will be getting more paperwork in the mail.
I am so happy I am skipping my anti-depressant today.
I LOVE our court system
Rick lost...BIG TIME!
And again, his deleted address and phone number for more subpoena fun!

That's outstanding. Can't wait to see how he tries to spin this one.

And I ask again, has Rick Olney ever, and I mean ever, taken an English class?
""In my own particular case, replying only because my name was brought into this matter, the likes of 'Gail Simone', Tony Isabella, and several others will pass soon enough from such loose-lipped, untruthful lie spreading of me."
What the hell is THAT sentence?
Gail
Untruthful lies.... Hmm, sounds like he's saying you are telling the truth. Don't 2 negatives make a positive...?
:p

You guys is still playing CoH?
Gail
You betchum, Gail. And my dad too: yes, the ex-career-Delta Force commando/rock musician/race car driver 64 year old school teacher. You should see his CoH gaming rig. Huge lust. Boomslang mouse, speedpad, THX-certified Bose surround, dual 20" 4-millisecond LCDs, quad-core CPU, 2 gig of DDR3 RAM, bleeding-edge video card. And he has something like twelve level-50s now.
We miss you and Howard Porter, Gail. One of these months when you get the time we'd love to team up again.
Misty sends SUPER HUGS.

As a Mac user, I object to all this talk of CoH playing. It depresses me.

May I just say that I am madly in love with the judge? She ROCKED! I damn near jumped up and down with joy when she made her pronouncement!

Hey, Dick! You should have been there! I was!
