If the judge ordered him to get tested by a psychologist and they said he was insane would that let him off the hook or what?

I don't think he meets the definiton of insane. I don't know much about law. One would be insane by public standards to do what he's done, but not legal standars. The "man" is petty, vain, and a sadist. No so much insane as an idiot.

Maybe there will be dancing with mythical attorneys on retainer, a team of police friends who will haul enemies off to jail without benefit of the review of a magistrate even when they are not in the same state as the nefarious Knights Who Say YABS, former bench sitting buddies who aren't actually attorneys but play them on the internet, and the 27 and 3/4 never-actually-went-to-Viet-Nam-potato-peeling-clerks Marine Brigade.

That's another thing any creators from here can do to help out the SPA/IF/Palavers - stop in at the live chats we have. We used to have regular guest speakers for chats, ("BRO" = "Before Rick Olney", and things got all splintered. It was a grea way to announce a new project cause we'd have like 15-25 people at the chats, but then we also post the transcripts for everyone else to read...

For a while we had it so the speakers would sponsor a giveaway each week. Not sure if we're ready to bring that sort of thing back, but...Whoever made it to the chat would get a free item of the Sponsor's choice. That's what Darediva was mentioning many pages back, having never received the item RO said he'd send out. I don't know of anyone that did get one, myself included. But anyway, if anyone here wants to help us out by being NAMED GUESTS at the chats, let me know off-board, and I'll put you on schedule in our Kick Start newsletter (which appears on the Dimestore home page each week).

Heck, I'll do it.

I think what bert is asking is this: If you have someone ELSE served with papers, are you notified when those papers are served to the other person.

~Bev

yep, that's what I was asking PeeG

but who-hoo! I got a response from Colleen (I'm gonna print that out and frame it next to the original art I bought from her a few years ago -- a GORGEOUS costume design she did for "Bloodstorm" that got rejected for odd reason).

Whoever serves the summons and complaint on the party (sheriff or process server) generally makes note of who, when and where the service was made and returns proof of service to the courthouse. If it is service by sheriff, a copy may be mailed to the attorney filing suit (here in PA). When I was clerking in Chicago, we just went to the courthouse to check up on service. We generally didn't do this until after the date the defendant had to file his/her appearance. When we used a process server, he sent the proof of service to us and we turned it into the courthouse. But in either case, it wasn't an immediate thing.

The defendant also has a specific amount of time after service to file his appearance at the courthouse and then the whole thing begins. Should the defendant not file an appearance, a date is set for the plaintiff to prove their damages and a default judgment would be entered and then collection proceedings would begin.

And that's your civic lesson for today.

GO Bears!

and information is *always* appreciated!

select the area you don't want. start a new file..set it up to have a transparent background...cut out the part you want and then drag it over tothe new file...or you can select the area you want and then hit Edit:clear...but unless your background is transparent you willstill have a background color when you save it (unless you save it as a gif i believe..anyone?)

I don't get it. That's Jabba devouring Ric Olie from Star Wars. A character who, in the absence of any evidence whatsoever, I assume has nothing to do with our Rick. What's the relation? Yes, I realise they have the same initials and Ric gave Anakin his first flying lesson just like Rick gave some kid a comic, but I'm still not seeing the relevance to the thread. :D
The names sound somewhat similiar and Rick once saw a Star Wars movie. The connection's pretty obvious, I think.

Also, he's eating him!

Hi all,

Just wanted to say how much I enjoy this thread. As a small-business man who relies on customers paying up on time I am very familiar with the frustration of getting screwed over. The loss of faith always hurts more than the loss of cash.

It's interesting to see how high up on the list this thread is getting when you do a Google of Rick Olney. Right now it is number eight; number one is my favourite  - http://www.jazmaonline.com/interviews/interviews2.asp?intID=290, with this quote from Rick "To all those that feel I've hurt them; Forgive me. To all those that know the warmth of my friendship; Remember me. To those that loved me, know that I love you still today. I was only here in the spotlight of life a brief time, but you've all made my life the richer for my exposure to you."

I guess some of you folks did make his life richer. I hope you get paid.

Long time reader, first time poster.

Welcome Uber Steve!

I don't know if your business is in comics, but the community is made up of so many small businesses in publishing and retailing. This thread is so fascinating to me because I can see how easy it would be to follow down the path.

Just because you build it doesn't mean they will come. Too many folks have been screwed over by Rick's aspirations to build a great show or a great publishing empire.

Most of the people here have dreams and aspirations of their own. I think we expect some level of work in earnest of building something for that dream. I see it in the small press and individuals bringing their comics into the store.

But the sheer number of folks he's dragged into his aspirations is staggering. Plus the way in which he's treated them is disgusting. These are good people with a passion and excitement for comics.

I read the thread and take so much of it into myself. I just wish I could make it all better.

He'd have to be unable to tell the difference between right or wrong and reality and fantasy for that to happen. And in that case, he'd probably get locked up in the loony bin rather than get away scot free.

So sayeth the Wiki: In most U.S. states, legal insanity is not sufficient to avoid a guilty verdict, rather to be not guilty by reason of insanity it must be demonstrated that the defendant could not tell the difference between right and wrong.
In civil law, insanity renders a person unfit for entering contracts or other legal obligations.

However, a Personality Disorder - which is more likely in this case - is NOT the same as insanity. Someone with PD just thinks everything should be done a certain way, or has strong control issues. They usually know the difference between right or wrong, or reality and fantasy.
And then there's the problem of psychotic vs psycopath vs sociopath:
A psychotic can't tell the difference between reality and fantasy.
A psychopath can't tell the difference between right or wrong.
A sociopath can tell the difference between right or wrong, they just don't care.

Thank you Psych 101!

Does anyone know how to make a background clear in PS? I wanna whip up a T-shirt with the Sock Puppet.

Just double-click the background layer in the Layers palette. That'll turn it into "Layer 0." Then you can just select the area you want to make transparent and hit the delete key. Then just save as a .png or a .eps to keep the transparency.

Does anyone know how to make a background clear in PS? I wanna whip up a T-shirt with the Sock Puppet.Unless something has changed in recent revision: the "background" layer cannot be clear. You need to eliminate that layer altogether, or turn of its visibility on the layer pallet (click the little eye icon on the left of the layer list.)

If you have things on the background layer that you want to keep, use the command LAYER, NEW, LAYER FROM BACKGROUND to copy the background to a new layer before deleting the background layer.

Edited to add: What Les notes, double-clicking it to turn it into Layer 0, also works; it's a shortcut that I forgot about.

Thanks Bev, I learned some great things when I was working distribution for the iHero Ent. project. We're not stuck with the choices everyone tells us we are, as long as you have good backing (not just financial, but people that can quickly mobilize while the buzz is good)

I mean just by looking at simple solutions you can take your projects to some rather unconventional places. such as using that .cbr digital comic file extension to be able to allow people to download your book on a PSP (I believe you'll need that homebrew thing installed but--) selling cheap digital files via a model like iTunes undercuts the $2.99 price tag elsewhere, and gives you zero overhead to work from. Then you can focus on taking the profits from the digital experiment and funding your physical paper comics.

It's a shame the CAA mag didn't last past its first issue, I had a strong commitment from the newsstand which if we had kept it up would have turned some heads..

----

And about the Happy Meal thing, as long as you do it in as satire it falls under Fair Use. Thus there's no way for McDonald's to have a problem. Plus your using it in context with another copywritten thing, Wimpy's excuse from the Popeye cartoons so that also makes it safe via the satire laws.

Please Gail, you're asserting that he was "in" the industry in the first place. I thought we'd already established he was "near" or a bystander at best.

As I like to say, "owning Photoshop doesn't make you an artist", and holding a con (or canceling them endlessly) doesn't put you in the industry.

If he did not have a lawyer before, I am sure he is looking for one now.

So here's my question, I've read through the thread, and isn't this all going to be a small claims court issue? If so, they usually suggest that no attorney is required. Not saying that he can't hire a lawyer, but they say it's usually not needed.

Or has it escalated into a higher case? I only inquire, so that I can decide whether or not I want to jump on the wagon and put in my claim as well. Not that I want this pigslop to get away with what he's done, but I also have to balance the time cost of going after him. Other's have much bigger claims to what's going on then I do.

Well unfortionately it really wasn't my project. CAA (or Cyber Age Adventures) was a project by the fellows at http://www.ihero.net I was just brought on as a freelancer because of my passable marketing skills and connections to certain people.

I think the iHero guys are going to try to do something with it, but I think they're looking to have a third party publisher produce the book so it's not out of the top guy's pocket like the first one was.

I had talked to an artist of mine who was thinking about doing something with old golden age characters from the Spark Universe (Green Lama and all them) who are all under public domain, and producing some kind of quarterly coffeetable book "further adventures of:" type of thing.

I'm happy to help anyone who wants to take some of the things I put forward at other places and run with them, if they want. I still have some of the contact addresses, for the newsstand people, and tips on how to get their attention.

At some point I might see what I can do about furthering the distribution angle for people, right now I have a few projects on my table (a manga I'm really excited about) so it might be awhile before I get involved with something as all encompasing as a magazine again, but I'll deffinately let people know if I go down that route again. lol.

Thanks Bev!

My Daphne convinced me to speak out against Blubberous one (she had an odd feeling about him even though she never spoke to him), but I wouldn't even have mentioned it to her if this discussion hadn't already started.

This has been nothing shy of amazing, both from the amount of support and the depravity Moby has sunk to. In my 2 year tour of hell with him, I never imagined he fecked so many creators without dinner and a movie. He kept us all from associating freely with each other, so this has been like surviving a tornado unscathed in the safety of a basement without ever suspecting your entire neighborhood has been destroyed.

I'm still sickened by all this.

And I'm still not entirely happy with myself for waiting so damn long.

Doc, don't knock yourself out over it. As has been said before, you want to think the best of the people you know. And that speaks well of you.

And when one is financially invested in a situation (as you were, in waiting to be paid), one tends to be much more cautious. In my case, in dealing with him on Dixonverse, and letting him expose himself there, I wasn't invested - other than as a friend of Chuck's. It let me be far more impersonal in the situation. And then Gail picked up the ball and ran. (And dang, I'm mixing metaphors all over the place here.) But she too wasn't "invested" in any current situation. If we've given you the support to get you over that hesitancy, then that's great. What is far more important is that you finally DID speak up -- and probably broke the same log-jam for others as well.

Lots of little things came together. And Gail gave it a save home to take root and grow. (And shoot, ANOTHER metaphor. Can't I stick with one? :) )

You're too kind, putting me on any list of valor that includes Gail. She's led this charge against injustice; at best, I simply helped fund some armor for the troops. She's a gem, and if the end of the 21st century comes and goes without someone, somewhere, having erected a bronze memorial statue of Gail Simone, then something's askew. I left her a long, gooey voicemail message on the day of the tenth anniversary of our friendship to tell her much the same, and EVEN THOUGH SHE NEVER REPLIED, I choose to believe it was because she was too busy reading to the blind or somethin'.

We love Gail!

Thanks for the welcome, Dedagda.

I'm not in the comics industry apart from making a weekly contribution as a consumer. I do custom IT solutions. Similar though, as there are a lot of good people but a few deadbeats who spoil the business.

Funny thing is that most deadbeats who I have in my Now Delinquent Account list :) also had such great ideas that I had to sign an NDA to hear them talk. The only two I ever went after for payment are the ones that actually had some money, as small claims courts cost money and I don't like sending good money after bad.

Sadly, small claims court up here in Ontario doesn't help you get payment even if you win. You need a collections agent for that.

Cheers.

That should be sufficient enough to suit you, Colleen. That is me in uniform on my wedding day back in 1975. Note the dress and rank. Shame on the lot of you!
The resolution on that image is far too low to determine (a) the rank or (b) the identity of the man in uniform.

I do have to say, though, the clothing on all the civilians looks to be of an older vintage than 1975. I'd say it looks to be somewhere between 1968 and 1972, but, again, at this resolution it's impossible to be sure.

Anyway, how are people who have never met you supposed to identify you from this photo?

I'd call this "evidence" inconclusive at best.

If you'll take a look right here (http://comicfacts.blogspot.com/2006/06/apology-and-retraction_16.html), you'll see that when I'm wrong, I apologize and retract.

Looking at the pic under a bit of enlargement, it *might* be Olney, but again, there's not enough detail to be certain of it.

I agree on the clothing styles, and the one young guy in the back with the sideburns and period haircut, etc. looks late 60's to very early 70's. By the mid 70's, most people had either gone to the longhair or the disco look.

The car in the background looks to be either an El Camino or a Ford Ranchero, more likely the Camino... but again, based on the photos of the cars I've been able to find, the styling of the rear end looks like earlier models from the beginning to mid 60's... late in the 60's, they rounded and "sportified" the styling on both vehicles. Granted, an older car doesn't mean an older date than given; but had the vehicle been a newer one, it would've supported his statement.

Conclusion: agree with Jim: evidence is inconclusive to support Olney's claim of either time or identification.

(Yes folks, I was frickin' bored.)

Now, for my question:

If you can find at least one set of photos with "you in your uniform"... why can't you find your discharge paperwork, or one single thing online or off, that proves your military service? Even a photo from someplace like Okinawa, with you in uniform that clearly shows your face, would do. Heck, most people got at least one "formal dress" pic done, when they entered back then. My grandmother had one of my uncle, when he entered the Navy in the mid-60's. Surely, between that custom, and the custom of people in a foreign place getting their picture taken there, you've got at least ONE photo of you in uniform that's recognizeably you?

I have seen more standup behavior here in the last month than I've seen over the entire internet in the past several years. And, quite frankly, I want to do anything I can to support people such as yourselves.

I can't promise much, as I've gotta start saving up for my wedding and get through nursing school, but I've got more than many people do, and I figure that exposing myself to the works of people like yourselves can only be to my benefit.

I'll also do whatever I can to spread the word of your works to others.

I left her a long, gooey voicemail message on the day of the tenth anniversary of our friendship to tell her much the same, and EVEN THOUGH SHE NEVER REPLIED, I choose to believe it was because she was too busy reading to the blind or somethin'.

more like his hemmorriod is acting up.

you know, if he would just stop speaking out of his ass, it would give that time to heal.

I actually have a question for Olney:

What sort of thyroid problem do you have, exactly?

I'm asking because two people close to me suffer from Hashimotos. Another of my good friends had thyroid cancer.

I'm sure you know that even with supplements such as Levothyroxine(sp?), lack of energy and weight gain are very prevalent with both types of thyroid problems. With the former, I've been told, it is much harder on women than men(apparently, it can make a female who is going through her monthly ritual sick to the point of bedridden). All of the people mentioned earlier with these afflictions that I am close to are women.

If I follow your logic, the reason why you yourself are overweight and in your own words "somewhat disabled," and thus unable to maintain the level of fitness that you must have had during your alleged time as a Marine, then why do you demean others for obesity? I figure that a person with thyroid issues, of all people, would understand that obesity does not necessarily reflect negatively upon a person's character.

And what's more, your thyroid problems do not excuse any of online outbursts you have been displaying. I've witnessed the mood swings of others with thyroid issues, and even when they felt their worst, they were far nicer than you.

You posted some time ago that you were afraid to disclose the extent of your alleged disability for fear that others would mock it, yet you continue to belittle others, and use whatever malady you have as a shield from possible verbal backlash.

How I wish you could be more like those three great women I know.

From the pic he showed at MMC she looked average weight, not obese or overweight----like him.

Mac, Typo, Larry, Tom, that means you guys(and others).
To date, all of my work has been commercial or educational in nature. If you want my work, you'll have to buy the 1993 edition of Hooked on Phonics, a bunch of different products sold via infomercial circa 2001, SRA/McGraw-Hill textbooks, or other such items. I have no comics credits yet, as all my comics-related work was as an anonymous color-separator with Electric Crayon about 10 years ago. If you have the first Radioactive Man 80-page special, I did color on some pages in that. You could also round up business cards or yellow pages ads from a bunch of my clients.

Or just wait until some of the stuff I'm working on now gets published. There's an 8-page story I'm drawing now from a script by Tom Stillwell, based on a concept I came up with. It should be available at CAPE.

As far as I can see, his reasoning might have been the following:

Firstly, Gail's character is untouchable, so any attempted insult there would fall flat.

Secondly, her talent is undeniable. The quality of her work stands up for itself, while(to my knowledge) Olney has yet to print, let alone receive any critical acclaim for, any work whatsoever.

So that left him with the only method of belittling he could think of: the physical. Of course this was shortsighted and stupid. For one, Gail looks great. Secondly, only the shallow-minded actually believe that weight says anything about a person's character. Thirdly, one only needs to look at Olney himself to realize that he's being a hypocrite.

However, like many who pretend to be in the armed services but aren't, or find themselves dishonorably discharged because they lack the discipline, Olney holds to others a ridiculous standard of "disclipline" that he himself ignores. Because he has a thyroid problem(and I'm giving him the benefit of the doubt here), he has an excuse for his obesity, but everybody else who does not conform to his physical preference must be a slob.

sadly, I dont have anything out there for people to buy, but you can join my site at www.michaelnetzer.com/wagw if you wish.

As for my repeated requests for lawyer info, Olney did send me an email saturday with one sentence enclosed. "You will get that info Monday"

As you can guess, I am still waiting.

Consider yourself lucky Ronee. I didn't even get THAT email. So if you finally do get the information (whatever Monday that might be in the turd's universe), can you pass it on?

This reminds me of that whole Kevin Smith/Prince thing. Where Prince's manager called Kevin and would go " Prince will be calling you in 25 minutes " , then call again " He'll be calling you in 10 minutes. "
In Kevin Smith's world that's really early though.

Scott, Gail's husband, is a very strong and gentle man who chooses to be gentle. He is considerate because he knows that is the harder path. He is insightful, emotionally stable and analytical enough that he makes Joe Dubois from Medium look like Homer Simpson. And if Gail is a pistol, oh good freaking lord, he is artillery.
Do not ever mistake "gentle" for "weak."

This is what gentle looks like:

No, that isn't the reason at all. "Gail Simone" is a non-person, and as such while being a pen name for "Gail's" real person, meaning herself, I'm merely noting that "she" isn't real.

That is the stupidest attempt at evasion I have ever read.

Alas, Jared, reason seems to have nothing to do with how peanut chooses to insult people.

Gail's character is indeed unimpeachable, except that he did try to smear it, by implying she'd done porn, on film.

Gail's standing as a writer is unimpeachable (hello, peanut! Have you been favorably reviewed in Entertainment Weekly?), but that didn't stop him from calling her a token and a hack.

Me, I think he belittled her weight because she's prettier than him. And she has great hair! (Why can't I get my hair to have that kind of body and life? *sniff*)

Really, he'll throw any kind of insult he can think of. But if he knows something pisses you off, he'll throw that even more. And he doesn't distinguish between "Pissed off because disgusted" and "Pissed off because it hurt". Therefore, humor and mockery (and there's been such brilliant displays of it in this thread!) are the way to deal with him. It takes the air out of his balloon. He doesn't know where to get traction with you, where he can needle you, when he can't figure out what's going to "get at" you.

Interesting tactics...I prefer straight and unyielding. Olney can't face the truth. As such he crumples. And I'm sure your hair is fine. But hey, if nothing else I'm sure you have a winning smile.

As for Gail, I have huge respect for her for voicing this problem and coming forward. It takes guts. And I'm glad to see she has done this. A lot of other creators have been ripped off by this guy for years. Who knows how many more would have fallen victim if she hadn't? This guy now has a huge black mark on his reputation and based on his responses, his credibility has been shot to hell. My only question at this point, is what more can be done to him?

Now, mind you, my address WAS on the invoice, which was sent as a PDF, so even if it looked too small when one initially opened the file, you can always enlarge a PDF! Duffus. (Plus, my cell phone number was on the first email. How hard is it?)

Anyway... his reference to thyroid & adrenal problems causing memory problems prompted me to do a little research. And as far as I could tell from what I found on-line, such things are usually easily treatable with medications. Yeah. Oh, and "adrenal problems"? That's usually natural steroids flooding one's system (again, treatable with medication) -- and... "'roid rage", anyone?

But I think that would be letting him off too easily. He's got a pattern of behavior going back at least 8 years, a consistent pattern of dublicitous behavior. I've ceased to care about his "medical conditions", and have no sympathy.

I feel badly for the guy even though it was brought on by his own decisions. I hope he gets things under control, and is able to have a good program down the line he put together.

I'm sorry that the only way I can think of to help with this debacle is to do what I do anyway: be a consumer. But please, take the time and let me know so that I can partake of your product, whatever it may be.

I caught the clockwork orange thing, I liked it alot, but what I'd like to see is a long program, akin to what he had with The Sandman, where he got in trouble for the crucifixion thing...

I remember hearing a story about everywhere he and Gregory Helms travel they carry these little briefcases everywhere and how funny Gregory Helms thought that everyone looking at them thought they were off to some big meeting somewhere but the briefcases were filled with comics.

He did a nice story for Spider-mans Tangled Web about the wrestler Petey fought in his first apperance. I'd love to see him give a shot at doing more comics during his downtime. I was surprised they never let him write the WCW one Marvel published in the 90s.

I hope he gets better soon, I know the draw of TNA (for the performers) is the lax work schedule, unlike the WWE where you're on the road 300 days out of the year. I hope he uses the time to rest up and comes back as a somewhat major player. It's sad that after a certain age people don't seem to have much of a use for talent, when they could be great as teachers to the younger performers.

I caught the clockwork orange thing, I liked it alot, but what I'd like to see is a long program, akin to what he had with The Sandman, where he got in trouble for the crucifixion thing...

On Hardcore Homecoming he said that after the Crucifixion of the Sandman , he walked backstage. Kurt Angle was going completely fuckin crazy. Claiming that it was a blaspmahy and that he was offended. Sandman looked at Raven and the 2 started laughing.

Heyman wanted Angle badly. He comes up and tells Raven he needs to apologize for the image. To go and apologize. Raven bals at 1st but Heyman and the others push him. Sandman said it best: " You honestly think Angle was offended ? The guy worked for Vince when they crucified Steve Austin 2 years later. Get real , he wouldn't dare pull that crap on Vince. "

Sandman made another fun statement was that people were yelling " Why didn't you use a Jewish Star ! " Sandman goes... " It would roll of course and roll me outta the ring. "

Levy claims he walked out and did an apology that was so unsincere that you could tell he was being an asshole.

I remember hearing a story about everywhere he and Gregory Helms travel they carry these little briefcases everywhere and how funny Gregory Helms thought that everyone looking at them thought they were off to some big meeting somewhere but the briefcases were filled with comics.

I actually heard that too. In WCW he would carry the briefcase and all. Its said Bischoff even thought he was doing some serious business. :p

He did a nice story for Spider-mans Tangled Web about the wrestler Petey fought in his first apperance. I'd love to see him give a shot at doing more comics during his downtime. I was surprised they never let him write the WCW one Marvel published in the 90s.

I have that issue. Its a shame that he never did more comic book work. You can tell he loves the business. I'd love to see him do some more. With TNA catching on more and more now with mainstream fans ( last week on RAW , we saw this) he could do more.

I hope he gets better soon, I know the draw of TNA (for the performers) is the lax work schedule, unlike the WWE where you're on the road 300 days out of the year. I hope he uses the time to rest up and comes back as a somewhat major player. TNA has Shane Douglas and Raven backstage. The 2 its said do help the young guys. Douglas to me ( if I was a wrestler) would be someone I'd hang around. The Franchise was and is someone who is just awesome to watch cut a promo.

GAHHH! An EWOK !!!!

KILL IT. . . KILL IT !!!!!!

Mexican Chilli Ewoks:
After collecting half a liter of blood, cook the Ewok in its own juice. Then fry 200 grams of "Chile Chipotle" in the Ewok's blood. Use the blood to season the Ewok. Enjoy, serves for 6.

And better than wrestling stories!

yeah. . I know what you mean.

even tho it's kind of neat that Raven is a comcs fan, and even tho CBR *is* a comics site, and even tho your username contains ECW in it. . .

it does get a bit tiring for almost every post to have a wrestling reference in it.

Kinda how DDM almost always manages to squeeze Siouxsie and the Banshees into every post he makes on the Music board.

all that said, more power to SuperECWfan -- hell, I'm sure folks get tired of my penis-centric/gay-centric posting sometimes.

but yeah, I know what you mean :)

It's possible Olney or his wife have a Hummer, but I suspect their 'vette is really a Chevette.

Well I get bored since Olneymania is obviously running on low as many take Waid's offer. The whole thing just spun out by accident when they discussed Olney's " thyroid " problems.

Besides I ain't knockin the people posting the cat pictures . :p
