No. The hold harmless is what my attorney requires for Ronee to get paid. I initially required her to sign her NDA and Contract, and I was corrected recently and told that a hold harmless will do, Colleen.

Amboy is not Colleen. Colleen is not Amboy.

My original post clearly noted that the NDA request had changed to a hold harmless order.

A hold harmless will do for the person who is concerned with being sued. It is not a requirement for getting paid, except when one's lawyer fears liability issues. Then the lawyer extorts the complainant for the hold harmless order in exchange for prompt payment.

I've been gone a couple of hours, and find a huge bunch of pages, so I'm catching up.

Colleen, you are so right about how none of this adds up. I was in the Navy, and remember OrcaPoop making the remark that he was in the Marines when we talked on the phone (actually, HE did most of the talking). If he says he's 52 on his blog, you are correct about him being too young to have been in Vietnam. Even if he is lying about his age, which I have reason also to believe, he would not have done the hitch the way he keeps "rearranging" it.

About as bad as saying he was in several places in NC. If he was in the Marines, he would probably have been on Okinawa for at least six months, especially back then. Don't think he's added that to his score yet. Still...no MOS either.

More full of crap than a Christmas goose, it appears.

No-one said my panel sucked. If you'll take the time to re-read (sorry, in your case read for the first time), you'll see that Gail and JoAnne both said they enjoyed it immensely. And the few attendees agreed. Which means my panel didn't suck, despite my having a fever and the flu.

Sorry, Moby, what everyone was saying was that attendance sucked. There were more guests at the show at any one time than paying attendees.

Mr. Olney, since it appears that you don't want to answer my (or anyone's, for that matter) question, I'll say this:

If it does, miraculously, turn out that you were indeed in the Marines, no one here has anything to apologize for.

People here questioned the veracity of your statements because, well, you don't have the best track record as to telling the truth, you were less than forthcoming with information that most veterans would have no problem recounting, and your story changed early and often.

Matters like this ALWAYS change as people better define what they experienced, truthfully, versus off-the-cuff verbal replays. I get defensive and stupid when attacked. I normally pull back. And I did. But I'm here now.

Don't attempt to push the responsibility onto everyone else.

Personally, I cannot understand how you can refuse to pay people who did work for you.

I am not refusing. I simply can't pay certain talents on a story when one or two of the others have compromised themselves legally. My attorneyt is working to sort it out and any actions needing to be filed, shall.

Apologize to the people you have harmed. Then, maybe, you might be able to begin to claw back and reclaim some amount of dignity.

I shall when this matter reaches that stage.

I am actually 53. I was an E-4 in just 13 months, including basic and speciality training. I took my NCO training at Ona Point on Okinawa, and was TDY for 4 months, along with 2 months in Korea, 30 days in P.I., and I saw Japan several times on R&R. Got two Meritorius Masts, and was up for Sargeant twice. 'Course, I had so much salt that the Staff NCO's treated me like a Sargeant. Stateside, I was TDY last at Camp Elmore. I also ran dispatches from Fleet HQ there at Norfolk, VA. Beyond that, I am like anyone else serving in the Marine Corps during that period of time.

I will answer NO MORE personal questions.

I was an E-3 when I freaking enlisted, because of the rate I signed up for, and an E-5 within 3 years. So what?

Why would anyone think that? It's not like working under a pen name is an uncommon practice among writers. Even Stephen King did it for a while and he's debatably the most famous writer alive.

Well, I do.

Look a hold harmless agreement is the oldest trick in the book and I've been having bad clients pull this one on me since the 1980's, so I've been a few rounds.

With real professionals, I mean.

Basically, it's a form of settlement. The defendant is in trouble, or fears the cost of a lawsuit. Instead of going to court, but not wanting to admit guilt, he gets the complainant to sign an agreement that they won't sue, no matter what the defendant did. In exchange for this agreement, you get the money or property you are owed. Right now. No more muss, no more fuss. You don't get damages, you don't get your day in court, but you get what you need right now.

Happens all the time, actually.

While the complainant actually has a case, may actually have a GREAT case - as Ronee does - the cost and stress of the case may not be worth as much to her as getting her $800 now. Assuming the defendant actually follows through with his payment, satisfaction will have been asked and answered and that will end the matter, as far as Ronee is concerned.

It's the defendant's best course where ALL the creators are concerned. If he signs a release disclaiming all rights to the material, returns the material, and pays even a fraction of moneys owed, I bet every creator involved would sign a hold harmless agreement, and the defendant would get on with his life. And so would the creators.

After they sign it, that is it. They can't sue, they can't complain, they can't do anything. HOWEVER, because almost every miniscule detail of this matter is now a matter of public record, demanding confidentiality would be unrealistic, to say the least.


The defendant doesn't want to go to court on this one. It's the biggest loser I have ever seen.

Usually a defendant wants to follow this course because they fear a big court judgement and further public embarassment. Than again, it's doubtful the defendant in this case has any real assets to speak of. Moreover, he has to hold up his end of the deal and pay what he agrees to pay and do what he agrees to do.

600 paying attendees.

Let's do some math, shall we? Bear with me, I'll do the actual figures.

The show was from, say, 10 till 4. That's 6 hours. So 600 attendees divided by 6 hours of show gives us 100 guests an hour (don't worry, I'm not gonna tax you by going into how many per minute). Now, there had to be easily 50 guests at the show, between one major room, one hall, and the smaller room that the hall connected to.

So, 100 attendees divided by 50 guests gives us approximately 2 attendees per guest.

Now, that's not taking into account the various vendors who obviously vied for the attendees' attention and took away from other venues such as talking to guests, stopping in the panel, that sorta thing.

The matter is being handled as any legal matter would be handled. As far as me making apology, that'll come to those talents at the time when they're paid for their work on the book in question. Believe it or not, I am more interested in paying talent versus taking anyone into a court situation. But I'm not making that decision either. It is based on what has transpired, realistically, and to what degree one talent doesn't care to settle any way BUT a courtroom.

Well, I do.

Look a hold harmless agreement is the oldest trick in the book and I've been having bad clients pull this one on me since the 1980's, so I've been a few rounds.

With real professionals, I mean.

Basically, it's a form of settlement. The defendant is in trouble, or fears the cost of a lawsuit. Instead of going to court, but not wanting to admit guilt, he gets the complainant to sign an agreement that they won't sue, no matter what the defendant did. In exchange for this agreement, you get the money or property you are owed. Right now. No more muss, no more fuss. You don't get damages, you don't get your day in court, but you get what you need right now.

Happens all the time, actually.

While the complainant actually has a case, may actually have a GREAT case - as Ronee does - the cost and stress of the case may not be worth as much to her as getting her $800 now. Assuming the defendant actually follows through with his payment, satisfaction will have been asked and answered and that will end the matter, as far as Ronee is concerned.

It's the defendant's best course where ALL the creators are concerned. If he signs a release disclaiming all rights to the material, returns the material, and pays even a fraction of moneys owed, I bet every creator involved would sign a hold harmless agreement, and the defendant would get on with his life. And so would the creators.

After they sign it, that is it. They can't sue, they can't complain, they can't do anything. HOWEVER, because almost every miniscule detail of this matter is now a matter of public record, demanding confidentiality would be unrealistic, to say the least.


The defendant doesn't want to go to court on this one. It's the biggest loser I have ever seen.

Usually a defendant wants to follow this course because they fear a big court judgement and further public embarassment. Than again, it's doubtful the defendant in this case has any real assets to speak of. Moreover, he has to hold up his end of the deal and pay what he agrees to pay and do what he agrees to do.

cLearning alot here tonight,I still highly doubt that there is anything under his name in Tightlip.

600 paying attendees.

Let's do some math, shall we? Bear with me, I'll do the actual figures.

The show was from, say, 10 till 4. That's 6 hours. So 600 attendees divided by 6 hours of show gives us 100 guests an hour (don't worry, I'm not gonna tax you by going into how many per minute). Now, there had to be easily 50 guests at the show, between one major room, one hall, and the smaller room that the hall connected to.

So, 100 attendees divided by 50 guests gives us approximately 2 attendees per guest.

Now, that's not taking into account the various vendors who obviously vied for the attendees' attention and took away from other venues such as talking to guests, stopping in the panel, that sorta thing.

Take a MUCH closer look at that picture. You can tell Gail, like Heidi, is not looking at you, but at what's going on off picture. And Gail already mentioned there were 2 girls in costumes there, that we cannot see.

Anyway, I just wanted to point out the body language of the middle two people in the picture. They're both leaning forward with their hands clasped in front of them. (caution and protection) Forced smile from Ms. Simone, because that's what you do when someone points a camera at you. Meanwhile, Mr. looks like he wants to deck someone, but is too polite. Plus his wife would kill him.

You put this picture forward as proof that everything was fine three years ago, Rick. Judging by the picture, it wasn't.

(A couple pointers for the future: 1) When you're in charge of the whole shebang, dress appropriately plus 1. T-shirts don't cut it. and 2) Posture! You're "on" at all times!)

There are facets of truth to what you said, but I'm not the only person that created those scenarios. It takes two people hitting heads to make a bad situation worse. I've got no beef with you. From the tenor of his posts this evening, he probably has talked to someone with legal training, but from the very fact that he IS posting, I don't believe he has a lawyer, yet. NO LAWYER would EVER allow his client to do this. Ever. He contradicts himself, and burns his case with every post.

I can't believe anyone would be this imprudent, but there you have it.

For his own sake, he really ought to shut up and get an attorney and let his attorney handle it. His attorney should write every single thing he says in public for the forseeable future.

I'd say this is career suicide, but he never really had one. Never seen anything like it, regardless. Well, not in public anyway.

Believe it or not, I am more interested in paying talent versus taking anyone into a court situation. But I'm not making that decision either. I've been working professionally in pretty rarified air for over 20 years and I've literally never worked with anyone who referred to human beings whose creativity and hard work ultimately put a roof over their heads and paid their bills as "talents." Not even at talent agencies. Every editor, director, AD or CEO referred to creative people by their names, or their work, and considered it a point of pride-in-workmanship that they had specific, distinct individuals, not just faceless workers from a corral.

The very biggest of the big shots, with seven-figure annual incomes and hundreds of employees, would never be so arrogant and dismissive as to use such a disempowering term as "the talent," if for no other reason than it would demean them as being unworthy of hiring name power.

Tim Tolbolski has said a bit of stuff that needs to get sorted out.

Ronee can be paid once I hear from her on the signing of a hold harmless release.

To equate an attempt to delete every single post with the practice of deleting text of posts that are duplicate, or off point, seems disingenius to me. Although the comment is obviously made in the "reasonable, logical" tone of voice, there's a certain mental misstep here. The whole point of posting anywhere is the public conversation. Deleting whole passages of it is a futile attempt to "unmake" things that were said.

I'm not a copyright or contract expert, but chances are there's no "return" involved. From what's been indicated in this thread, Olney the Lonely has never lived up to his side of the contract. The agreement sounds like it originally (remember, Mr. P mentioned that he signed a revised version that included a clause indicating he retained his rights) included an exchange of rights for compensation. As compensation never occurred, there should be no transfer.

While it would still be worthwhile for Blake (or Ronee, as his manager) to consult an Intellectual Property lawyer regarding the contract, it seems pretty clear that a) Mr. P didn't sign anything that transferred his rights and b) RO didn't live up to his end of the bargain anyway.

Now she has never had anyone banned from what I can tell. But on the other boards you'd be 86'd Rick. Cronin woulda stepped in and gave you the Ban from Hell. I'm sure you should thank Gail and Ozbat for at least holding things so you can post on CBR.

But its their rules. And their game and were just a small part of the ballfield.

"Gail Simone" is able to accept payments. Well, unless they're cash. And I'm not sending cash. So I'll have to ask my attorney about how she figures into all this. Last I knew from 2003 -- She had a claim of $100 dollars that she never sent a receipt in on to be reimbursed. No receipt came in. No monies went out.

Tim Tolbolski has said a bit of stuff that needs to get sorted out.

Ronee can be paid once I hear from her on the signing of a hold harmless release.
