On another thread we were discussing copyright and trademark. One ( wrestler) recieved word that due to another company buying an old company he worked years earlier for he can't use a moniker or phrase he used to do " The King of Old School ".
If that is Mr. Corino he may want to check to make sure the WWE still holds the copyright on that. They have let several of their ECW trademarks lapse, including "The Impact Players" since they had no plan to use it.

As someone who's actually seen all the artwork and scripts for Tales of the Spooky, I have to tell you that it actually was (and could yet be) a great book. Any horror fan would definitely love it. It has a great mix of horror, humor, and pathos. Not a dud in the bunch... 'cept maybe my stuff, but the great artwork made up for that. :)

It's also not consistent -- when the Houston Astros sent me a letter challenging my trademark on ASTRO CITY, we sent them back a letter politely inviting them to bite us, and they went away, because they knew they had no real grounds for the challenge, and weren't willing to try anything more than the letter.

When Best Buy sent ST a trademark letter about "Geek Squad" (A "techie" column that hasn't run in some time at ST) we replied back that (a) Our Logo was very different from theirs (b) Our site design, URL, and Logos were very different from Best Buy's, (c) The Geek Squad name/logo as Best Buy uses it, actually advertises a service where as ST's Geek Squad logo did not promote a service; that ST sells no services, and (d) we reserved the right to write and publish future Geek Squad columns using the title and logo.
We never heard from them again.

What got me was that the only real reaction he got out of that long babble, was one poster saying they'd gotten that he was sane. Then two pages of posts before he shows up again, because his entre made not a ripple in the interactions of the (apparent) regulars in that thread. Nothing until he chimes in about season/weather in NY state, with side mention of MightyMiniCon.
How does one manage to make what ought to be hype sooooo boring?
(And that's another reason I do NOT usually bother to trot out my credentials, because it just gets to be a droning dullness. If I can't be engaging in "conversation", why would anyone be interested in what I've done? The only use for my credentials is to brow-beat idiots like Olney who think they can condescend to me. Heh. As for Rick's writing, the book might still be worth reading (not necessarily buying) since he has actually recruited some great artists for these projects. Just read it like a three year old... look at the pretty pictures and ignore the weird scribbles in the little white balloons.

They're links to images from one of Tightlip's own press releases. Anyone could have found them using google. I'm not in any danger for posting them.
If I was to start revealing plot details, dialogue, and other images that weren't readily available to the public, then I'd be on unstable ground.

After going insane on Monday, posting all day, right up till midnight, Orcaflesh stayed silent in posts, but at some point suddenly started panicing, and deleting the content of his posts, replacing text with his silly-ass avatar. Whereupon he got a limited ban, which kept him from deleting anything further on the record.
This, in spite of the fact that several people in recent days have said they were copying the whole of the thread. So the record isn't gone at all, really. But if you want to check it out, in the "Search thread" option, do an advanced search on poster "orcafresh", and you'll see how many posts he did delete. Too bad people not only copied him in other posts, but off the board entirely.
No one has heard for sure, but the suspicion is that the first of legal filings against him was delivered to him yesterday. That and the talk and action of posters here of contacting his local news teams about his fraudulant behaviors.
As for Gail's tid-bit: no, she hasn't returned with that news yet. We need to nudge her on that again.

Since I was going to law school to specialize in copyright/trademark law
I will in the future be very clear when I am referring to either copyright or trademark. The WWE tends to usually go for both things on any item, phrase, or wrestler's name, so as to lock up all legal avenues and to guarantee the ability to sell said phrase on shirts, posters, and any other ancilliary merchandise they can think of. As for Ms. Doran, I would never wish any harm to come to her, as the few times I have met her she has been the consumate professional.
And I found this as well:
The distinction between Trademark and Copyright protection is not always clear. Think, for example, of a logo with which you are familiar. The amount of original authorship that goes into a logo can vary greatly. Most of the highly recognizable logos out there are extremely simple objects such as a "swoosh." However, one can imagine a much more ornate logo that includes a great deal of original authorship. Such a logo could possibly qualify for both Trademark and Copyright protection.

Trust me, as one of the bunch that was supposed to work on F3... it wasn't going to be a killer book. The only one that would have liked it... is Rick, and perhaps some asylum residents. That's about it. He said he had lined it up to be sold at military PX's all over the world... I think the poor lads and ladies are suffering enough these days... they don't need this to be added.

Well, HERE'S an encouraging little story.
I just returned from my weekly trek into Hollywood to Meltdown Comics And Collectibles, arguably Los Angeles' finest funnybook emporium.

Meltdown carries EVERYTHING in the way of comics, toys, magazines, etc. Tons of indy and foreign stuff too; I've never seen another store with the breadth of their stock. And the huge store attracts scores of people in comic books, animation, video games, live action movies and television; just about every aspect of the entertainment industry. Clive Barker and Jack Black are regular customers, for example. (This isn't a commercial, just trying to establish the fact that Meltdown ain't your average comics shop; it's sort of a mecca for those in the know.)
Anyway, I wasn't in the shop more than five minutes before Matt, the savvy young dude behind the counter comments to me, "So how about that Rick Olney?" Now, Matt didn't mention CBR or "Lying In The Gutters" or any particular source (and I forgot to ask him, i was so pleasantly stunned) but he didn't even know about Rick Olney's meltdown on this board. He was, however, extremely well-informed about Tightlip Entertainment's super-scam and was very eager to talk about it. When I told him about some of the nonsense that's been going on here - Olney's meltdown (no pun), the threats, the below-the-belt insuts, the arrogance, the sociopathetic behavior...well, his eyebrows were certainly raised to their limit.
Considering the high-power creative types that pass through Meltdown on any given New Comics Day, it's gonna be like that old commercial spot: "And he told two friends, and she told two friends, and so on and so on and so on."
Like I said, "encouraging".

They're links to images from one of Tightlip's own press releases. Anyone could have found them using google. I'm not in any danger for posting them.
If I was to start revealing plot details, dialogue, and other images that weren't readily available to the public, then I'd be on unstable ground.
But I'm positive I'm safe in this case. Thanks for the advice though.

Meh, Meltdown is a tad overpriced on everything but comics, but they are USUALLY well stocked. Golden Apple is actually more fun IMO. But then again, Comics Ink is the best shop in town if you're a regular.

Since I was going to law school to specialize in copyright/trademark law
I will in the future be very clear when I am referring to either copyright or trademark. The WWE tends to usually go for both things on any item, phrase, or wrestler's name, so as to lock up all legal avenues and to guarantee the ability to sell said phrase on shirts, posters, and any other ancilliary merchandise they can think of. As for Ms. Doran, I would never wish any harm to come to her, as the few times I have met her she has been the consumate professional.
And I found this as well:
The distinction between Trademark and Copyright protection is not always clear. Think, for example, of a logo with which you are familiar. The amount of original authorship that goes into a logo can vary greatly. Most of the highly recognizable logos out there are extremely simple objects such as a "swoosh." However, one can imagine a much more ornate logo that includes a great deal of original authorship. Such a logo could possibly qualify for both Trademark and Copyright protection.

Gee.... I tremble at the thought of even venturing to another store! I love the folks at GA. And "we" have our share of celeb customers as well. I've seen Bill Mumy & Robin Williams in the store, just like ordinary folks. And I understand other celebs patronize them too.
But back to topic: I don't know if the GA folks are up on Olney. Ryan & Sharon are great, and do a good job, but ... well, Bill somehow kept on top of everything in the business. (Cripes, I miss him, and I'd only get a chance to chat with him every now and then.) I'm still nudging Ryan to get the store a page on ComicSpace. (Ooops, going off topic again.)
But it's cool to hear that the word is going out.
Oh, and Jim? Cool art there, even if the concept is lame.

I know nothing of this Battle for Blüdhaven of which you speak. My knowledge of the aforementioned teams comes solely from the horrifically-contrived "Batman and the Outsiders" series from the early '80s.

You miss my point. I'm not debating which is our favorite comic shop. I was stating Meltdown's importance as a shopping place for Hollywood's top talent in comics and related fields. And they're gonna hear all about Rick Olney and Tightlip Entertainment there.
This means that the word on Olney has reached the street-level. And, with the register clerk at Meltdown eager to chat about Rick Olney's scam as comicdom's latest scandal, a lot of influential customers in various entertainment industries are gonna learn about him.
The word on Rick Olney's scams is now OUT THERE. Why don't you help share the word at Golden Apple (give my love to Sharon and Ryan; I'll make it by their new location soon, I swear) and Comics Ink, too? Keep those ripples of information spreading.

Hey, I notice he actually acknowledged you in the copyright notice as co-creator. That's good. A little leverage...
You know Olney hasn't a pot to piss in, so you might consider suing for his share of the ownership of the characters. Any competent writer (throw a rock in any direction in this thread, you're likely to hit one) should be able to make these lame concepts work. You might end up with something worth owning. I'll put my money on Monster Squad, but I can see a couple of ways to make Freedom 3 not suck out loud.

Outsiders is great "leave your brain at the door" fun. If you stop and think about it it's craptastic. Especially Looker.

First you have to pry Dick's greasy fingers off it. That should be fairly easy, especially if you've accepted the possibility of never collecting on any monetary judgments. Accept ownership of the characters and concepts in lieu of part of what he owes you, and then you can run with it. You already own the art half.

Well, it nearly did. But by the time that this Olney debacle surfaced I had already decided to quit. Then all this happened, and I began to see that the creators of the comics are not as..........fractured.........as I had feared, and decided that maybe, just maybe, the third time in the industry would be the charm.
I did work and got screwed by a guy named Pete King, a "Christian" publisher. THen I hooked up with Olney. This time, I dunno, maybe just creator owned stuff of my own or try to break it at a bigger company than just my own pocket book.
And as for me being honest, I didn't used to be honest. I was a shyster for a while, but am now a RECOVERED shyster. heh

True. However this would require me to deal with and listen to Dick rant on and on. It wouldn't be worth the headache. I've been there... done that.
As for owning the art half already, wonder what that allows me to do, if anything with these? I'm just glad he doesn't have the originals... this was all done digitally, files sent back and forth... so... I still have the pencils. Wonder if I could get a quarter for them on Ebay?

Now, from the first moment I saw the art, I felt 'Magnus Grimoire' was a vanity character to represent Rick. A Mary Sue, in other words.
Did he ask you to make the character look a little like him, and was that the 'wise' character that everyone follows in the story?

That makes me wonder... what about a benefit auction of the original artwork from Tightlip? It can go towards the owners of the artwork. I mean collectors might be interested based upon not only the quality of the artwork, but on the air of controversy surrounding the company. Anybody know how an auction or two might be set up at the cons? Or, if anything else, the artists can simply put the artwork up themselves on ebay, with various news sites and forums helping to promote their efforts.

Why thank you Gail. Though it's nowhere near the level of some of the bigger names that were brought on board later and swindled... I'd like to think it's of a decent enough quality that it would have interested folks... if just to view the artwork alone. Like a multitude of "up and comers" (which some here have been accused of keeping down... sigh)... I'm trying my best to get my work out there to be seen... and then... who knows?
Besides, they say, it's now what ya know, but WHO (or should that be whom? I always confuse that one). Perhaps membership here will help me to direct my efforts in an avenue where I can take on bigger (and hopefully profitable) projects!
The concepts... feh, I had no control over. As I like to say "I just draw's da pictures".

Now, from the first moment I saw the art, I felt 'Magnus Grimoire' was a vanity character to represent Rick. A Mary Sue, in other words.
Did he ask you to make the character look a little like him, and was that the 'wise' character that everyone follows in the story?

I am real time friends with the artist who DID do that piece, and I know from his conversations with me, that that is the case. And yes, he's the "wise mystical character" who's followed by his gaggle of misunderstood monsters. The "Professor X" of the Monster Squad... was how it was put, as far as his position in the story.

I suggest you submit to Image and Dark Horse.
- If you don't, I will put together a publishing imprint for you.
- I will get you a website and cover hosting for at least one year.
- I will format and submit your work to a print-on-demand publisher, which I will pay the setup fees for.
- You will receive 100% of any profit. I will not draw any money from the product; the only thing I ask is ownership of the imprint/label -- the logo at the top left corner of the cover. You retain all rights including the right to publish or submit elsewhere and I will put together a standard agreement which gives me "first printing" rights, which will not exclude you from being printed elsewhere.
- Any post production work I do on your behalf (logos/cover formatting/lettering/color flatting -- sorry, I'm really not good enough to do more than these four) will be something that I will solicit your feedback on and the feedback of any professional cartoonist, comic book personality or graphic artist here who is willing.

Battle For Blüdhaven was a mini series following Infinite Crisis were some baddies dropped some sort of bio-warfare/nuclear device on Bludhaven. No good came of it, and well, I can't recall most of it, but while it wasn't bad I can't say it was... good. (sorry to whoever wrote it! Not my cuppa!)

Well, he may very well be sitting and reading this, only the mods/admins know for sure. You can use the VBB control panel to look up his IP address, then use it to see if he has any sock puppets. Additionally, mods/admins can see exactly what every user is doing, and the list includes IP addresses. So unless he's smart enough to figure out how to change his IP address (and I seriously doubt that) you should be able to find him.
EVEN if he's viewing as a guest. Guest IPs show up as well.

I'm reminded of something I read a long time ago, I think it was C.S. Lewis... The idea is that there are layers of laws, and if you don't obey the easy ones, you will be forced to answer to the hard ones. At the top are principles, which are fairly simple. If you violate them, you move to more firm laws with harsher penalties.
The example he gave was If you don't obey the principle of caution, you will be forced to obey the law of gravity.
At any time in this whole fiasco, Olney could have chosen to obey simple principles of honesty and common decency. He didn't. He chose to move to the rocky terrain of the law.

Now, if Rick claimed to have a trademark, he might possibly have a case. It would depend on what category he had that trademark in, whether he maintained that trademark, how generic the term was to the usage at hand, and so forth.
But if he told you that he had a copyright and thus you couldn't use it without his permission, then he misled you, and used you poorly.
You can claim a trademark with a TM for the effort of trying to establish a brand name but you will still need to get it registered. Comics in the Classroom sounds more like it would be an SM rather than a TM type of mark however.

No, but it does establish a prior claim. Since 1978, works are considered to be protected from the moment of creation, and registration is not necessary to secure one's rights. It's just a whole lot easier if the work is registered.

Yes, it's not necessary to lodge copyrights. You can easily prove your righs without registration. The same goes for trademarks, but I do suggest you register your trademarks all the same.

Not to worry. It is complicated stuff. Copyright would cover content you would publish -- that is written text, and specific illustrations & art you might "publish" (in print or on the web).
If it all were a can of soup, the Trademark would protect the look of your label (including standard text you use on the label). The Copyright would protect the contents of your can.

My guess is they don't exist. We did the same thing at Monkey Spit. Had a fictional owner that we had to answer to; that way we could blame him for anything anybody didn't like. Difference is we didn't take anybody's money.

That's not to say that registration doesn't have its advantages -- it certainly does. But copyright is invested in the material from the moment it is placed on a fixed medium.

If it were me, I'd pony up to file copyright registration on anything you've written or designed. The only reason I'd do that is because there was a period of time in which the copyright was erroneously attributed to the slimebucket. Fortunately he's going to be a little too busy now, so it's unlikely he'll try to poach it out from under you.
The banner and logo can be copyrighted as works of art and trademarked as well.
You'll want copyright registration for the site as a whole, for the logo (the banner is probably not crucial), and for any major articles that you've written. You could just copyright the site as a whole, but it might be better to get additional protection for anything you think someone might steal.
Of course, then you have to pay attention and look for people stealing from you. The odds of anyone turning somebody in for copyright infringement are pretty slim.

You can claim a trademark with a TM for the effort of trying to establish a brand name but you will still need to get it registered.Sorry, but that's false, at least in the US.

Depends. Does your agreement with them stipulate that they own copyright on their work? If so, then protecting it is up to them. If your agreement with them doesn't stipulate who owns what, it's presumed to belong to them, and again, protection is their problem.

Legally, yes. If you wanted to be a slimeball and steal his work, the (c) would give you a bit of a toehold for that.
To be protective of yourself and your contributors, you might amend your copyright notice to say something like this:

I think he was trying to swindle you out of something good you've done. It's still yours though. He can't just say otherwise. If he ever were to come after you though, make sure you've dated everything you've done. He'd have the appearance of some legality if he's ever copied and printed the page. It's a good backup if you ever have to prove something is yours.
Man...talk about taking advantage of someone's innocence...he should be ashamed of himself. I really don't know how much lower he can sink.

Judges have gotten pretty good at seeing through that particular gambit in the last couple of decades. Like his NDA, it may not provide the protection he thinks it does. It may not provide the same protection as a lace condom.

You may have copyright in the design of the page, however.
Since 1989, the copyright notice hasn't been needed in the U.S.... which doesn't mean that it isn't still useful. It lets people know that you consider the material worthy of protection, and gives them an indication of who they should contact if they're looking to reproduce the material.

MacQuarrie's suggestion is good here.
Another would be that you copyright everything, and add the notice that it is copyright of first publication, and that all other rights revert to the individual authors.
That would allow the various writers to collect their work and publish it elsewhere if they wished. It's what I've been doing with my old columns from Mythlore. But since I'm also doing a bit of revision of them when I put them on the web, they're not exactly as they were when first published. So, I just give them a current copyright notice.
By the way, don't make yourself too anxious. From the sound of it, you're getting it together, and not likely to be in any "danger" from poaching. Plus, I'd assume that you have folks on your end who are, basically, witnesses to the things you have done, that the authors are the authors, the artists are the artists, and none of them connected to Olney at all. Those are things not to be overlooked. It doesn't ride only on the protection of the symbol.
All articles are (c) by their respective authors and used here by permission, unless otherwise noted.
I will add that to future articles and emailk anyone that has written for me that the ownership of their work is theirs and I hold no claim over it. Until that happens they can count this as their written promise.

Battle For Blüdhaven was a mini series following Infinite Crisis were some baddies dropped some sort of bio-warfare/nuclear device on Bludhaven. No good came of it, and well, I can't recall most of it, but while it wasn't bad I can't say it was... good. (sorry to whoever wrote it! Not my cuppa!)
But no ragging on Batman and the outsiders! 'Twas brilliant! And such lovely 80's fun.
Ok, we are talking about creators with class, right?
You don't need to apolotize for not liking Bludhaven. It was written by Jimmy Palmiotti and Justing Gray. they are two of my favorite writers. They wrote the excellent series Monolith and are currently writing one of my favorite series currently in print, Jonah Hex. Jimmy Palmiotti is the nices profressional I ever met at a convention, seriously! And Justing Gray comes off as a heck of a nice guy online.
Lot of respect for both.
That being said, Battle for Bludhaven sucked. It was horrible. And I went to their boards and said so (keep in mind I regularly go there to tell them how much I love their other stuff so it was not like I was being a troll.
Justin Gray agreed. Well, maybe not that strongly, but he said that they had about half the time to write Battle for Bludhaven than they normally do to write a comic, and he was not happy with the final product. He was genuinely concerned that people would decide wether to base some of his future projects based on Bludhaven.
Anyway, this is the cool part. After I told them I didn't like it, I got an e-mail from Justin Gray. He said he was sorry that Bludhaven was not up to my expectations and if I gave him my address he would make it up to me. I was pretty sure he was not mad at me so I gave him my address. 3 days later I got a free copy of Freedom Fighters #1 by Gray and Palmiotti and a #1 of Red Sonja by them.
THAT is a class act!

Because right now, you could claim it's all yours.
Publication=/=copyright in all cases.
If that were so, Gail Simone would own every BoP story she's written. She doesn't. DC comics has the copyright. She's doing them on a work for hire basis, and copyright law is pretty clear that if you agree to work for hire, you don't own the copyright, and can't make a claim to it.
(You and Mike need to sit and have a chat about how you want to handle copyright on that work.)
A few years back Sirius published a very good comic that served as a primer about Copyrights and Trademarks. I'd suggest hunting a copy down.

As for the Globe/Blok rip, totally unintentional. I was never a reader of LoSH. So,... but the subject did come up... and it was decided I had made enough of a change, for there to be no issue. Again, I was trusting others who were "in the know", and I wasn't. Besides, at first, DingDong DUllney had him with no pants at all. He looked more like Mr Hankey from South Park!!!

There's this cool piece of software called Sitesucker (http://www.mightyminicon.com/).
Thanks to Sitesucker, I have two folders on my desktop now; one contains the entire Orcafresh website contents, the other the mightyminicon site. Sadly, it doesn't retrieve database contents, so I don't have any forum postings, but do have all the images and articles.
Tragically, somebody told him how to use a robots.txt file, so I was unable to collect the Tightlip site. So far...

Jim, you might want to copy those images to your own hard drive. The front page for the website is no longer accessible on the net, and who knows what else he's going to eliminate.

I'm sorry to say I don't remember -- it's strange, I've gotten a few e-mails over the years from folks wanting to know about the folks who published my books and other various topics. I've always been amazed anyone wants my advice, because as anyone can tell you, I really don't have the foggiest idea what I'm doing. Half of any meager success I've had is because of blind luck, and the other half is because I was smart enough to agree to making Ronee my manager.
(Actually, that's probably closer to 25/75.)

I did the same when I realized after 2 weeks (the same 2 weeks I was moderating him down on the Dixonverse board) that he wasn't going to cough up a mere $35 to have me rewrite his crappy front text. And after that amount of time, I didn't want to do it. But I also didn't want "the job" hanging out there, since I had sent him a formal invoice before beginning.
His reaction to my "Pro Forma Termination of Job Agreement"? He said that now that he'd seen my "true colors" there was not chance that I would ever work for his company.
Like it was supposed to crush my dewy dreams.
