Gail,
Sometimes you are berry sweet but other times your humor is plain.
Whatever, we really knead you and just roll with it.
She Sprinkles her posts with lots of little GEMS, you know. As a punster, she's non-pareiled! Yes S'No Caps can do her justice!
As for Olney, by this point I think he's deep-fried and moisted by his own pre-lard. (Fifty points if you get the really obscure pun at the end of that sentence---I was really reaching for it.)

You know, he could be deluding himself that changing all those posts is like changing a hyperlink. Except that had he even paid any attention, he'd note that it is a COPY function, not a LINK function we all use.
Pffft.

And I'd like to take a moment to suck up.
Ms. Simone, I haven't read a whole lot of your work. I bought Villains United and loved it, but I am a Marvel Zombie.
If you did the Punisher appearances in Deadpool and Agent x, I have those as well. (I am a Punisher nut)
Mr. Busiek: I have purchased Marvels and a few Astro City trades. I enjoyed them immensely.
Mr Waid: I own Kingdom Come and I bought the FF stories you did with Mike Wieringo (I believe they were 489, #496-500, 501-511)
You are all top flight in my book. I hope to get a chance to meet you all at a con someday.

Yes... And I didn't realize Meat Loaf was practicing law.
Though, I admit I'd like a rock opera defense team in the event that I'm ever in a court room and screwed as bad as Rick Olney; at least my last moments of dignity would be entertaining.

Welcome, Josh. Contrary to the responses to some of the stinky one's comments, we're a very nice group here and retailers are always welcome.
Where's your store, may I ask?
Gail
I don't want to come across as paranoiac, but I'd be a little wary of overly humble and polite new posters signing on to the boards just as The Stinky One is in the midst of a mass-deleting frenzy, especially when both Google and Yellow Pages searches yield no trace of a X-treme Comics and Collectibles, Inc. store in Boca Raton, Florida. Reek does have a history of creating myriad sock puppets during his meltdowns.
I'm just sayin'.

Oh, and I wanted to say, long ago.... This morning, when I checked in here before heading off to work, and read Mark Waid's lovely post on page 260, I wanted to stand up and cheer! It brought tears to my eyes.
Impressive humanity! I hope Mark gets standing ovations at every con he appears at this year. He is a credit to the profession. And an inspiration.
If he doesn't get a standing ovation, I'll have electrodes attached to all the chair seats at the next one he attends.

Enh.
As much as I hate to admit it, it might have worked if he'd held his own and come across as some kind of intelligent maverick. Granted, if he his IQ and the waistline on his pants weren't in such fierce competition with one another, he would have started by paying people he owed BEFORE suing them for NDA breaches.
Which, y'know, that's still possible seeing as how he has yet to do either one.
Had he managed to not erupt into a breakdown and kept it clear and said " No Comment " or " Talk to the PR of my company " . Or answered better he could have done it.

So this is going to be like a Union of sorts?
Ever since I wanted to be a comic creator I've wanted the industry to have a union (or a similar organization) to protect its workers.
But I have discovered (either via the net and/or magazines) that the reason it never materialized is because the publishers blacklist anyone involved in that sort of thing and generally done everything to kill it before it could get any power.
Which is a shame. The comics industry is literally filled with wonderful and talented people who deserve to be compensated for their work.

"Petard"
A petard was a medieval small bomb used to blow up gates and walls when breaching fortifications.
The word remains in modern usage in the phrase to be hoisted by one's own petard, which means "to be harmed by one's own plan to harm someone else" or "to fall in one's own trap". Shakespeare coined the now proverbial phrase in Hamlet.

I think it's for real, Wil. If you do a poster search, on page 7 of his posts, nothing has been changed in the last 15 minutes. I was looking because he'd gotten that far, and was 2 below one where he was (falsely) claiming (again) that Chuck Dixon had indeed signed an NDA. I'd copied that whole post, meaning to repost it here, just out of spite.
But hee.
Still... you know, he's deleted posts on his own blog where he was being jerkish and border-libelous. He's an idiot.

Thanks for posting further info about Olney's claims regarding his military service. Using the information provided, still no luck finding any record of service. That assumes he has given his real name and is being truthful about other info, of course.
Under the Freedom of Information Act, and private citizen can request a limited amount of data about a serviceman's record. However, I still lack important information about Olney, and he would not provide any pertinent information to back up his service claims.
"Preparing Requests for Information from Official Military Personnel Files:
Federal law [5 USC 552a(b)] requires that all requests for records and information be submitted in writing. Each request must be signed (in cursive) and dated (within the last year). Certain basic information is needed to locate military service records. This information includes the veteran's complete name used while in service, service number, social security number, branch of service, date of birth, place of birth, and dates of service.
To request military service records, veterans and the next-of-kin of deceased veterans may use vetrecs.archives.gov. For all others, use the Standard Form (SF) 180, Request Pertaining to Military Records. Although not mandatory, the SF 180 is the recommended method to send a request for military service information. This form captures all the necessary information to locate a record. Provide as much information on the form as possible and send copies of any service documents that you may have. Requests may also be submitted as a letter, containing the basic information listed above.
Follow the instructions for preparing the SF 180. Check the table to determine the location of the record and submit your request to the appropriate address.
Note: Do not use the addresses on the SF 180 for sending requests related to the issuance or replacement of medals and awards. Military Awards and Decorations provides the correct mailing addresses for submitting correspondence for issuance or replacement."
I am very interested to find out if his claim at having served in Norfolk is correct. He'd better be telling the truth. My father was Chief of Security there. I can prove it. I'll be happy to post evidence on request. Too bad Olney refused to do the same.

Heh.
Dad was actually Chief of Police a long time after Olney claims to have been there, but if Olney has been untruthful about his record of service, he will be discussed.
And while my dad was a Marine, he's no fake, and doesn't make big claims he can't back up. He was discharged with a heart murmer. Nowadays, a heart murmer will not get you discharged, but in the 1950's, they thought stress would give you a heart attack.
So, he became a cop.

Not necessarily comic book specific, but I figured it couldn't hurt. They're responded asking for documentation, which I intend to send them.
I urge any other creators with grievances against Rick to contact them as well. They'll put a nice entry on him in their database so that other creators will be warned.
Their e-mail address is...

I stand corrected: Olney WAS smart enough to realise that his pictures could be quoted in somebody else's posts, so he removed 'em from photobucket.
Too bad I still had 'em in cache. And the really smart thing? even though the links are now broken? You can still see the address they point to. REALLY SMART using a photobucket account name of "orcafresh". Couldn't more blatantly demonstrate the relationship between offensive material and ownership if you tried, Richard!

It should be noted that under normal CBR rules, creating a second account in order to circumvent a ban is grounds for a permanent one. It usually results in an IP ban.
But we're not playing by normal CBR rules on YABS in a lot of other ways, and this is no exception. Gail has already said that Dick can create a new identity in order to post; his temp ban is entirely to prevent him from editing his previous posts, not to remove him from the forum.
Come on back, Dick. Or at least don't go bragging that you've been banned here. You have a specific explicit exemption from the rules.

'Tis true, 'tis true about the "dood" thing.
But the fight I mean is the one where established professionals such as yourself, Busiek, Waid, et al, kindly use your celebrity to draw attention to this situation and, in the process, empower the lesser-established creators who have also been shafted by this guy to stand up for themselves. That, to me, is a good fight, even if the enemy is sorely outnumbered.
And, speaking of the enemy, I'm an old Marine, so I'm saddened to see another old Marine behaving the way he has been. Not making good on his financial obligations is one thing, but some of the personal attacks he's engaged in are just downright dispicable, most notably those against the women on this board, including yourself. Maybe I'm just old-fashioned, but I hate to see that kind of abusive conduct by men against women. I know the ladies on this site are more than capable of standing up for themselves, but that doesn't change the fact that it truly bothers me. Real Marines are tough bastards, yeah, but they are gentlemen, too.
So, yeah, there's a good fight going on here, even if there is no doubt about who will ultimately win. My main hope, however, is that good side will strive, whenever possible, to take the high road and not stoop to the bad side's lowliness. Angry reactions to his personal attacks are exactly what he is hoping for -- it's a twisted form of attention he is seeking. Ignoring him is our best weapon. I say take him to court, sue his hiney, then forget about him.
Again, just my two cents. As for me, I just dig hanging out with the awesome Gail Simone, even if it is only electronically. :)
Best to you all,
Tom Waltz
That's a good 2 cents spent.
Thanks and Semper Fi, Tom.

Granted. And so has pretty much everyone else. But then he goes ahead and proves the point even further.

And then what Rick said to damn himself. Unfortunately half of what I made up is at present links to killed posts. But I'll being going through quotes of said posts and copying his words over in their place. This way people can get a sense of the grievance against this guy without having to read this whole insane thread.

My brother was in the Corps about 7 years. He also became a cop.

He must really believe that by drawing us out with his derogatory insults and then eliminating his initial taunts will prove once and for all how everyone is against him.
As if saying all those things didn't make him look bad enough, going back and erasing what so many people have proof of is gonna nail him to the floor.

Sad to see the orcafresh account banned, but I hope Rick returns under a new one. That grave could easily get deeper.
As for the edits, doesn't the board do backups? Someone's call but depending on when/how the backups are done, Rick's edited posts could be replaced with the orginial. Or the orginial might be provided to those actually seeking legal avenues along with the edited versions to show how Rick was trying to cover up his bad behavior. This would be something any potential judge or juror would find interesting as cover up by most is considered synomonous with guilt.
Final note, his "most hated" image, is that a recent drawing cause it seems that it supports his claim that people still work and support him. The art isn't half bad, clearly made to his order. Any ideas on who made it?

Then I found this. Enjoy:
http://www.jazmaonline.com/interviews/interviews2.asp?intID=290
Oh dear.
I see this quote:
I also spearheaded the efforts that created pathways for comic-books and sequentially driven graphic novels and trades to gain acceptance in public libraries and schools with success.
Am I right in thinking this is crap?
Y'know, I noticed something last night when I googled his name, but didn't go back to check it until now.
I found this website, Comics In The Classroom (http://comicsintheclassroom.net/) run by Scott Tingley. Here's what he says about how he started:
Hello, my name is Scott Tingley, the owner of this site. I am an early years teacher in the New Brunswick (Canada) public school system (this site is in no way connected to the NB Department of Education). I am hoping that my knowledge of differentiated learning and my love of comics will help you in the motivating and teaching of the children in your lives.
I may be new and small, but I am one of the few sites of its type out there, so if you are a creator or publisher and you would like to send comp or preview copies of your books for review, or want to send us press releases or news tips you can email me at comicsintheclassroom@gmail.com (comicsintheclassroom@gmail.com) And sorry, these books will not be returned, nor do I promise to post a review of every one sent to me. I will not trash your work, that's not what the site is all about. If I like it, and it fits the site, I will find a place for it on my site.
If possible, please include a solicitation and release date for the material.
Also, if anyone out there would like to sponsor me or run adds on my site, or you just want to comment on the site
drop me a line. (comicsintheclassroom@gmail.com)
Special thanks to Christian and Kevin for ideas and tech support. And to Mike for his interest, contacts and support.
Now the page that actually comes up in the search is this one:
One Year Later! Comics In The Classroom Turns One! (http://www.comicsintheclassroom.net/oo2006_oct20_first_birthday.htm)
Where he has this to say:
It has been a long year, but never in my wildest dreams did I think when I launched this thing twelve months ago that it would have grown as fast as it has. I first uploaded the site on October 22, 2005, and I am currently on my third version of the site – each getting more and more professional looking.
I could not have done it without a lot of great people giving me a hand along the way. John Taddeo, Rick Olney, Ian Feller and Mike Bullock have given me support within the comic industry. My friends Christian and Kevin are my site design and graphic gurus. My Principal and School District have supported me along the way, as has my wife – letting me click-clack away at the keyboard for all hours of the night. Thank you to all of the people kind enough to send samples of their work for review, and thanks to my sponsors.
Finally, I would like to thank the new writers that have graciously offered their writing talents to CitC. John “Figaro” Norris came on board a couple of months ago to begin writing “THE CAT'S MEOW: What's Good on the Shelf This Week” column. Tracy Edmunds has written a couple of great pieces for me and writes the Newsarama.com all-ages column. Both have been terrific additions. Thanks so much.
I didn't even know how to attach a document to an email 14 months ago. I'm wondering what this next year will bring.

Note to Richard "orcafresh" Olney:
1. when three or four people each individually quote your posts to take them apart, we have enough independant verification of what your original post was.
2. when we have independant corroboration of your post content, it's pretty futile to hope that by deleting your posts, we'd somehow magically forget what you wrote.
3. when we've seen you do the same post deletion revisionism before at other forums, it's even more futile to believe that we wouldn't be ready for it this time.
4. when we've flat out said on multiple occasions in this thread alone that we've been copying each page for a permanent record, it becomes mind-numbingly stupid to believe that deleting your posts would be able to make those copies magically disappear along with our memories of those pages in their original unedited form, AND the independant quotations of each post.
5. when you go through and delete your posts and replace them with a nice big version of your avatar image, it makes it really, really, REALLY easy to see which posts you've deleted and which ones you haven't, yet.
6. when everybody goes through and sees your big bright version of your avatar image, with "last edited by orcafresh on date.date.date" underneath that image, immediately followed by several posts from other posters quoting the original content of the post before you edited it, it is beyond comprehension that you could possibly imagine nobody wouldn't point and laugh at such feeble efforts to cover your tracks.
and 7. running all over the internet and deleting just about every post you've ever made that still existed after previous purges is the actions of a Very Desperate man. Did you receive anything in the mail today?

Mr. Shires I really like your logo for SPA, I think it is classy and its eye catching.....I wish you all the best with it.......and pleasse tell your wife I read her posts and that I for one would like to say hello to her and welcome the chance to become friends with her...
Cam......your hilarious, I love your comments!!
About Scott...... Mr. TUNA ROTTEN.... Intergrity and Honesty just happen to weigh a little more than a bag of shyte covered lies......I would offer for you to try that approach but seeing that your common sense is non-existant I won't bother....
Colleen......thank you for doing the background work with the military posts, I couldn't find anything on Dicky either.....
Sarah thanks for being such a dear......me and Doc_A know what a sweetie you are......
And for everyone else, EVERY POST FOR THE LAST 3 WEEKS has been copied and are in the hands of my attorney, his paralegals have a file of every post made on here even my not so nice ones......LOL......I don't think he understands that the picture he put up is indeed an act of terrorism and will be dealt with accordingly.......

Couldn't happen to a lesser creature.
Not only has he single-handedly destroyed any hope he ever had of publishing, I think he's destroyed ORCA, too. Every single time it's mentioned, people are going to be thinking of his behavior here and elsewhere. Who in the world would trust this guy with ANYTHING charitable?

Wow... Just... WOW. Leave for several months and I miss all the good stuff!
I vaguely recall several years ago, there was some big blow up between Olney and (I think) Scott Shaw. I don't recall the specifics, though. And I remember being surprised when he started posting here. There had been a LOT of accusations of him being a fraud then, too.
Frankly, I'm surprised he didn't melt down sooner.
And to all you who were screwed over by him, you have my sympathies. I will definitely be looking for work from all of you to buy and support.
And to you, Rick... You're a sick and twisted nut job. Seek help NOW.
Hey, Papergirl, long time no see!
As I recall, Rick Olney started to flip out when I asked a few too many questions of Gail and Heidi MacDonald about their disastrous experiences at the Mighty Mini Con here on the YABS board. When I saw that he was warming up his old flamewar routine, I backed off fast and made nice, rather than send him careening off into another take-on-everyone-here-at-CBR screed. Then I warned the other mods in the Back Room of his history of flipping out, but no one seemed to take my warning very seriously. Of course, you can't ban the guy for acting weird on OTHER sites. Too bad that all predated the concoction of his fictional publishing company/scam, Tightlip Entertainment.
I dunno if that thread still exists there, but I'd love to see it again, just to check how many aspects of his pattern of misbehavior I predicted. Not that I'm some sort of funnybook Nostradamus, but Olney is just so pathetically predictable. Sociopathetically, even.
Oh, and Olney's next phase will be frantic apologies and attempts at nice-making. Not that they'll be genuine, mind you, but when he gets hopelessly backed into a corner, he thinks he can charm his way out. At least, that's what he used to attempt at Comicon.com.
But what's going on here is much bigger than pissing off CBR. Between the threats and the Tightlip scam, he's FINALLY gonna have to face the music, thanks to the good work of many people here and elsewhere.
Aloha,
Scott!

Well, 2 of the 4 comics insiders he mentions have been posting here... and one of them we can actually trust. That said, maybe Mike Bullock has some answers.
I don't know what the exact connection is. I do, however, know that Scott Tingley is a great teacher, great comics advocate and all around swell guy.
I emailed him a link to this to see if he can swing by and shed some light on it.
Just to say, although there has been quite of bit of negativism and nastiness in this thread (and I'm guilty of some of that too - see the Sarlacc Pit/asshole reference way back). .
it is a pleasure and a joy to read many of the posts here.
So thank you for confirming my "good-faith" in most of the Comics Community.
Mr. Waid, you are a true hero.
as are Ronee' and Colleen (I may not buy any Marvel these days, but your art in "Book of Lost Souls" was stunning).
Posts by Momma Absurd, Corrina, Kurt Busiek, James Owen and many, many others remind me why I love posting here on YABS (heck, even Cully's posts! (I would put a smiley here, but they have been forever ruined for me).
Seeing MacQ get worked up just underlines how important this issue is.

I doubt that it would have happened already. More than likely if they decide to do anything, they would investigate more first, then do a story that would run to fill air time at some point. But I wonder just how "newsworthy" it would actually be outside of the comics community.

I suspect that this pattern of behavior--promises, then no payment--isn't limited to the comics community, and there may be other debtors out there, for other things we're not aware of. If I were the newsteam, I'd do a full credit check, first, then I'd try to track if any work was contracted for his home or even done on his car--anything involving small contractors, who might walk away from a debt, because it's 'not worth the hassle.'
Oh, and if it is a pattern, there might just be a possibility of criminal fraud. Iffy, because you'd have to prove he never intended to pay, but...
And edited to add that, yes, I'm pretty sure it was the newsteam idea that made him backtrack and delete posts. I was wrong to express concerns about that one. :)

Hey, it's a shot in the dark if they decide to run it. Maybe it'd get one of those consumer reporter type stories. A local guy who uses comics to scam artists out of 5 figures worth of work might make for a story on a slow news day.

I have been reluctant to speak about him publically. But...
My name is Chuck Satterlee. I am currently a small press writer with a few series out there. I am also an employee of Markosia Enterprises.
My history goes back a couple years with Rick.
When I had two series at Speakeasy, one of those series...(Of Bitter Souls) was drawn by Norm Breyfogle. For those of you who remember, Norm is a legend (at least in my opinion) and had one of the greatest runs on Detective and Batman ever. Norm is also one of the nicest and most generous people in comics. Back then, Rick had contacted Norm and invited him to go to his Mighty Mini-Con. Rick was supposed to pay for the trip, hotel, and give him a $100 per diem. I remember that Norm and I had the opportunity to sign together at a bigger convention but Norm, who NEVER breaks his word, had already said yes to Rick. The days drew closer to the show...and no word about his plane ticket or accomidations. Then the day came...and no word and Norm was blown off. When Norm spoke about this on the Speakeasy boards, Rick went into what can only be described as the mother of all rants. He had a ton of excuses why his behavior was not unprofessional.
Then time passed.
Norm, being the forgiving guy he is, agreed the following year to try it again.
Same result.
Then, because I guess I am an idiot...I fell for it as well.
Rick invited a bunch of Markosia creators to the MIghty Mini-Con. Same promises...
The list included:
Freddie E. Williams II who is a very good friend of mine.
Tom Hall and Daniel Bradford who are doing a book for Markosia.
Me
Brian Augustyn
Chris Dibari
JOse Torres
Sal Cipriano
Freddie...who is exclusive at DC now, and my other friends waited and waited for the travel arrangements and such.
Nothing...
Repeated e-mails asking for clarification...
Nothing...
Then, he told us he had some family problems and deaths...
He siad that is why he did not contact anybody.
Poor Ronee kept trying to get word to us but she knew nothing during that time either.
Now, we're just small press, but we all scheduled that time and believe me, every show counts when you're small press. We all gave up other shows to do this.
Then...and it starts to get weird here...
He started contacting me and asking if I had been talking poorly of him. I really hadn;t. I had kept this to myself and so did ALL of my firends.
I am no angel. I have had my share of public internet fights. But man...this was crazy. He kept quizzing me on who might be talking about him. I tried just to forget the problems and he kept contacting me through myspace. I just don;t get him. Let sleeping dogs lie or some shit like that. Why keep dragging this on with people?
Apparently, Norm and my friends and I were lucky, we were only inconvienienced and not out the money.
This story keeps getting more and more odd. It seems like just about everyone has had a run-in with him at one time or another.
I am sure I am next to get sued now. But hey...if I only said it twenty times, I am small press, I could use a good court case to get some publicity. :)

I wondered if I would be pulled into this. You have a valid question Paul. I created the website comicsintheclassroom.net in the Fall of 2005 after hearing a boys literacy expert speak to all of the teachers in my school district about the importance of valuing all forms of reading. A buddy helped me launch and now two versions of the site later I am what I am. With the help of a couple industry people I had a press release writted and sent out. Rick caught notice of me through that (I think I am remembering that bit correctly) He informed me that he owned the copyright to the name Comics in the Classroom, and after a phone conversation he liked what he heard and he allowed me to keep using the name as long as I gave the copyright credit at the bottom of the screen. That is really all there is to it. He has nothing to do with my site other than the copyright thing. I own the domain name and everything that has to do with it.
I will respond to any reasonable questions, but since my dealings with him have been possitive I don't think I can add much.

Local news here on Long Island did a bit on a North Carolina company that was selling furniture, but not delivering it. Not big news, but they did help get some people their money back. They were talking only in the tens of thousands. Granted, more people know about furniture than comics... but not that many more. :D
By the way all... nice to meet you.
I've been trolling this thread thanks to it being pointed out on another board I frequent.
The only thing I have to say is that I came here with an open mind, and read the first few pages... and couldn't stop till I'd read them all. In the first couple of pages, I'd considered the possibility that perhaps there was some mob mentality going on here, or that some poor guy was perhaps just a bit slow, lazy, or misunderstood... and that perhaps people were ganging up on him. However, since reading every other post on here (who do I bill for the Visine?) it is my opinion that this man deserves to be brought into the spotlight, and made to pay for what he's done.
Mr. Olney,
If you ever get to read this, please be aware that I... your average good customer... will never purchase anything that your company puts out. If your company puts anything out. I'm sure you will say that you do not care, but I believe that you should. You're doing this for people to buy your product. You've said as much. What's funny is that nothing that anyone else here has posted is causing me to not buy your product. It's you. The very things you posted, and your attitude in posting them is why I will not buy from you. I believe that an honest man would not stoop so low as to play the online games that you have played with this community. I believe that someone who was being wronged would have behaved differently. To say the things you've said to these women? (or the men for that matter, but the women especially!) What soldier behaves this way? Certainly none that I've served with. You speak of pride, yet I believe that you have none that matters. I believe with all my heart that you are indeed guilty of everything you have been realistically accused of in this thread. They have not made me believe this... you have. It's sad, but you have lost one potential customer. If I ever hear of your name associated with a product, I will not purchase said product. You've had that effect on me. What's worse for you is that there are probably countless more like me out there.
You're welcome to try and sue me for my opinion. I have no problem showing up for court.
With that said, I'm going back under my bridge now.
I thank the rest of you for allowing me to interrupt. Be well.

Just wanted to say I agree. Except for stuff done by grank Miller, all my favorite Batman stories came from the team of Grant/Breyfogle, and all my favorite Batman villains that were created after the 70s were created by those two.
I really wish he would return to DC or Marvel, I loved his stuff!

I did not, but at the time I was brand new and had never even thought of stuff like copyright and (this was my thought at the time - I am not making a joke - seriously!!) I was happy that I was not being sued. I could not at the time justify the expense of a title search, etc. This is not exactly a big moneymaking venture for me.

Um...
You can't copyright a name.
You can only TRADEMARK it. Names are not copyrightable.
Unless the name has been used in commerce and trademark intent affixed, there is no trademark. The copyright law does not apply here.
Intent to trademark is indicated by a TM. A federally registered trademark is indicated by an R in a circle.
Simply writing Comics in the Classroom does not mean you own the phrase.
Geez.

Not on the list. Looks like Rick might ( >gasp< say it ain't so) have once again been fibbing.
I could write a book tomorrow, call it Comics Machine, and it would be legal.
If there is no trademark registration for Comics Machine, there's no foul.
And even if there were a trademark registration for that name, it could be argued that a novel using the name would not interfere with the trademark of a comic book using the name, which is one of the reasons we have a world in which a comic book can be named Love and Rockets and a band can be named Love and Rockets.
However, if you wrote a book called Love and Rockets, and Love and Rockets is a registered trademark that has been used on books, you would have a problem.
But copyright is a non-issue here. You can't copyright a name.

Geez.
c
Not to disagree with you, but you can copyright a phrase or a single word.
However, since Scott's usage is a title, you're absolutely right. And unless the exact logo was trademarked for use in the same field, it wouldn't be enough to sue Scott over.
Simply writing Comics in the Classroom does not mean you own the phrase. But he had the Comics in .... program that was the template for the Briges program.
You can't copyright a name. But at the bottom of Newsarama there is a copyright - so the name CAN be copyrighted, right.
Sorry that I am coming accross as so naive and a bit dumb on this, but I dealt with this over a year ago and kind of put it out of my head. Like I said, I was just happy that it all didn't blow up at the time.

Just a sidebar...
When Barb and I were dealing with a deadbeat contractor, I contacted every single person and organization I could think of...local officials, the attorney general's office, the BBB, a professional home improvement organization, and every TV station and newspaper.
A local official, the AG's office, the BBB, and the HI organization all got invoved to some extent. But it wasn't until a TV station called him that he got back to work on our addition. Even then, we had to hire someone else to lay the floor.
We deducted that expense from our final payment to him. He ranted and even threatened me.
I told him I could put the entire final payment it in escrow until we sued him and reminded him that the TV station was getting regular updates from me. He signed off on the lesser amount. I didn't sue him, but I also didn't drop any of the complaints. They are all on the record should anyone thinking of hiring him want to check him and his company out.
So...don't discount the TV angle. Our story never got to close to getting on the air, but the station's calls to the contractor saved our bacon.

I just want to take a moment to address Rick.
Rick: If it hadn't been for Rich Johnston, I never would have known who you were. Then, after I asked an innocent question, you had to act the ass. That pissed me off, and I decided that you would not get away with it. Lo, and behold, Gail Simone calls you out here. Then others came forward.

And then you need to remember that if you piss off enough of the townspeople, they WILL come charging the castle. Or, in your case, a $70,000 duplex with a van for sale in the yard.
Take this lesson. Do not fuck with anyone here in this thread. YOu are out gunned and over matched. I warned you just about me, but you could not take a hint. How does it feel to be you now, fuckwit?

I did not, but at the time I was brand new and had never even thought of stuff like copyright and (this was my thought at the time - I am not making a joke - seriously!!) I was happy that I was not being sued. I could not at the time justify the expense of a title search, etc. This is not exactly a big moneymaking venture for me.
I hate to break it to you, but the copyright notice you have affixed to your website assures that Olney is declared to be the copyright holder of the content of the site, not that he simply claims to own the name of the site, which, by your account, he has no right to own.
You don't copyright a NAME.
There is no copyright on the logo for SUPERMAN. There is a TRADEMARK on the logo for SUPERMAN.
You COPYRIGHT stories and art. You TRADEMARK the symbols of your TRADE. LIKE NAMES AND LOGOS.
There is no trademark notice affixed on that site whatsoever.

Holy Batshit.
Just got an email from someone who I'm keeping anonymous for the time being; all I can say is that he worked closely with Ronee on the botched TLE experiment.
I'm just gonna c-n-p a couple pertinent points from his email to the News10 crew:
'I have a contract with him . . . that . . . he terminated December 24th, 2006, blaming me for his own negligence. In the . . . months I worked for him, my invoices totalling [over $14,000] piled up, unpaid. He is further provoking me with legal threats to complete . . . a particular book titled TALES OF THE SPOOKY #1.'
Now we know where the 'legal wranglings' stem from.
'But, his promises to pay myself and the assembled 28 freelance contractors . . . dragged on a further 6 months since, and on one book alone, he amassed a debt of $25,000 more.'
Fuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuu udge.
On top of what's been stated here, that's another $40,480 he owes to creators. He owes more for work completed in the past 12 months than most people earn in a fiscal year.
'60 pages of comic book art and writing are assembled and unheard of by the world because he refuses to pay.'
And I was bitching and moaning about what he owes me for 9 measly columns? I'm ashamed of myself. I got another email this morning from a nearby creator who's gonna have to put off his marriage plans because Moby refuses to pay him and he had counted on that money to help finance their upcoming nuptials. Now that is fucking pond scum.
Note the date of my friend's contract with Olney being terminated: December 24th. That's the week after I spoke out, the very same day he deleted the ICC stuff. He set out to not only screw everyone, but to purposely kill our holidays with these actions.
After yesterday's riotous outbursts and your subsequent deletion of your posts today, I pretty much figured you couldn't possibly sink any lower in my opinion, Moby.
Once again you continue to amaze.

NO. That is NOT what the copyright notice means.
The copyright notice at the bottom of the newsarama site means that the CONTENT of the site is copyrighted. Get it? The interviews, articles, etc. THAT's what that means.
IT doesn't mean a FRICKING THING if he had a program to get comics into the classroom as if that hasn't been done a hundred times before. It doesn't mean he owns the idea. You CANNOT COPYRIGHT AN IDEA. You can only copyright THE EXECUTION OF THE IDEA!!!
ANYONE on the planet can run a comics in the classroom program and there isn't a damned thing stopping you!!!
For God's sake, what this thread needs is a legal primer in the classroom, and there isn't a single creator who has any business not getting to a library and checking out a book on basic art and entertainment law. This is beginner's stuff, folks. EVERYONE SHOULD KNOW THIS FOR THEIR OWN PROTECTION!!!
And ALL of this information is free and available ON THE INTERNET FOR YOUR EDIFICATION at the copyright office website at http://www.copyright.gov
What does copyright protect?
Copyright, a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed. See Circular 1, Copyright Basics, section "What Works Are Protected."
Can I copyright my website?
The original authorship appearing on a website may be protected by copyright. This includes writings, artwork, photographs, and other forms of authorship protected by copyright. Procedures for registering the contents of a website may be found in Circular 66, Copyright Registration for Online Works.
Can I copyright my domain name?
Copyright law does not protect domain names. The Internet Corporation for Assigned Names and Numbers (ICANN), a nonprofit organization that has assumed the responsibility for domain name system management, administers the assignation of domain names through accredited registers.
How do I protect my recipe?
A mere listing of ingredients is not protected under copyright law. However, where a recipe or formula is accompanied by substantial literary expression in the form of an explanation or directions, or when there is a collection of recipes as in a cookbook, there may be a basis for copyright protection. Note that if you have secret ingredients to a recipe that you do not wish to be revealed, you should not submit your recipe for registration, because applications and deposit copies are public records. See FL 122, Recipes.
Can I copyright the name of my band?
No. Names are not protected by copyright law. Some names may be protected under trademark law. Contact the U.S. Patent & Trademark Office, 800-786-9199, for further information.
I don't mean to shout, but by God, I now have a migraine.

Bless you for sharing your story! It's one more bullet in the hail against this man. And if I were you, I wouldn't worry about Olney suing YOU... I think all of that is bluff and bluster. Besides, given the number of people who have been cheated as you guys were, plus the number who have remained unpaid by him, he'd never in a million years have enough money to pay for all the "lawsuits" he threatens he'll level.
Rest easily. He won't sue you, no matter how much hot air he blows about it. First, he's in the wrong, and he knows it; second, he could never afford to sue every person he's threatened.

Thanks Mike.
I just have to ask this... did you ever CHECK to see if he truly DOES own said copyright??? I strongly suspect that he doesn't, or that he filed one AFTER seeing your site.
It's worth checking on. Go for it.

But at the bottom of Newsarama there is a copyright - so the name CAN be copyrighted, right. No, wrong. The notice on Newsarama is saying that Newsarama holds copyright in the website, not in the name.
Even if Rick could be said to own a copyright in the phrase "comics in the classroom", that would not prevent your use of it. Copyright is not intended to protect one against accidental similarity, only copying. Someone else could write a novel that was a word-for-word match of Gone With The Wind, and it would be legal as long as they weren't deriving it (intentionally or not) from Gone With The Wind.
As a phrase, he would be hard-pressed to claim originality anyway. Here's a book from 1975 (http://AAUGH.com/to.htm?B000H5BU7U) that uses that phrase in the title. Here's another one from 1983 (http://aaugh.com/to.htm?0872873579). And here's a book from 1989 (http://aaugh.com/to.htm?B000720IX0) where the phrase is the whole of the title.
Not old enough for you? Well, here's another book of the same name, from before Rick was born! (http://aaugh.com/to.htm?B0007JNEXE)
Now, if Rick claimed to have a trademark, he might possibly have a case. It would depend on what category he had that trademark in, whether he maintained that trademark, how generic the term was to the usage at hand, and so forth.
But if he told you that he had a copyright and thus you couldn't use it without his permission, then he misled you, and used you poorly.

You have no reason to feel stupid. You were a reasonable human being, and expected the same of others. And as many great people have proved in this thread, 90 percent of the time, that assumption would be correct.
It wasn't in this particular case, but please don't feel as if the fault is yours. Olney apparently is very, very good at fraud.
I agree with this, and her prior post, 110%. Do it NOW, exactly as she said to do... and don't look back. Quit worrying about him suing you... he CAN'T. Besides, he defrauded you on the rights with a lie.
And don't feel dumb, please! Most people would have done the same, having the same amount of knowledge, and being approached by someone pretending to be a real "professional in the industry." I know I would have. :)

40K? On one book? ONE book, maybe two at most?
How the hell was he ever going to break even on the project? Maybe I don't really know the logistics of an indy book, but if he somehow managed to clear $1-2 after printing and distributor discounts, he'd have to sell 20-40 thousand copies! There are Marvel and DC books that don't sell that well!
Did he EVER intend to pay anyone?
By the way, your friend rocks. Tell him to come onto the thread. There's safety in numbers. We got his back.

40thou for one project, plus the scattered thousands here there and everywhere for all the other people he's stiffed, just in the last few years alone.

Hm, I wonder just how impotent (speaking of shooting blanks) Olney is feeling right about now..?
He essentially has a horde of people gunning for him and he's little or no recourse but to run away & hide. And I have absolutely NO pity for the poor man.
Given the way he's treated the multitudes of his victims, neither do I. It was his choice to do so... now he has to face the music.
As to references someone made earlier to him being sociopathic, I think they were dead on. It's all about Rick: his life, his tragedies, his rep, his flak he's getting "undeservedly". He doesn't seem to give a flying fuck that other people involved in his work and/or cons have had tragedies going on while they were trying to keep their obligations to him, including Gail's mother being in the hospital, that guy who's had to postpone his wedding, etc.
That sounds pretty textbook sociopath to me, as it's been described to me. Con Artists (like Olney) often do see life in such an uberly-egocentric fashion. So (sounding textbook) does his talent for charming, using, and discarding people... and turning on them after they wise up or he has no further use for them.
Con men always think that they'll find *some* way out: someone to finagle, to charm, to "let them off the hook" when the chips finally hit the fan. Funny thing is, while this works sometimes, it DOESN'T work when too many people are "in the know" about it. That's why he's rabbiting, and that's why he was deleting his posts, and cutting access to his other net contacts/forums: he's scared. He knows his number has finally come up, and he's trying to cover his tracks. Sad thing is, he's too stupid to realize that such efforts are not only worthless, but are simply further proof of the kind of amoral egocentric scumbag he is.
Fortunately for the rest of us, there really aren't that many Rick Olneys in the world... and when we *do* encounter them, hopefully sooner or later people will do exactly as they're doing now: shining the spotlight on his multiple various and nefarious activities, seeing his bluffs for what they truly are, and taking steps to put him exactly where he belongs: under the impartial scrutiny of law enforcement and the justice system.
Run, Rabbit, Run.

You call me troll? You call me "Mickey Mouse"?
I call you "finished", peanut.
Stick a fork in you...you are DONE.
I am sad that you will not be attending MegaCon. I wanted a chance to call you on your bullshit to your face. But like a coward, you lied even about that.
The thing about lies is, you have to remember what lies you told and to who. You do not possess the brainpower to keep all your lies straight.
How. Does. It. Feel?
There are many good people that wish you no ill. I ain't one of them. A pox on you and everything you do, asshat. May clouds rain on you daily and the wolves tear you apart. And for every baseless threat you issued, may your suffering increase tenfold.
Now piss off.
Don't hold back Doc, how do you really feel about it?
I have to say, as one of the first to get the shafters by this guy, it's amazing and sort of heart warming that there are others that are standing up against this debacle. Not that I like seeing others get the same treatment as I did, that's just wrong. But to see a whole community stand up, when I felt sort of alone in this (at the time)... it just makes me feel better about being involved and working (in my own small fashion) in this field.
Thanks...

Suppose you're an artist, you've never self-published. And you're talented but don't have much work. And someone comes along and quotes a great rate and you check him out and he seems to have hosted a Con, and he seems to have the Bridges to the Classroom program, and he's been involved in the indy publishing community.
