Alan Cummings and Kelly Hu also had contracts for future X-Men sequels, but they're not back. Its just a way for the studio to settle the exact ammount of money they'd have to spend if they want to bring an actor back.

Probably because the movie is already overstuffed with characters. I don't think Nightcrawler joined the team officially. He was the only one not in uniform when they confront the President.
